fiedindividual29reasonablysuspectssuchpermissiblethirdpartyoffinancial30exploitationorotherabuseoftheeligibleadult.313.Aneligibleadultmayvoluntarilyprovidetoaninsurer32contactinformationfortheeligibleadult’spermissiblethird33parties.Aninsurerorqualifiedindividualshallnotbeheld34administrativelyorcivillyliableforfailingtorequest35-3-LSB5465SV(2)91nls/ko3/10S.F.2454thecontactinformationfortheeligibleadult’spermissible1thirdparties.Aninsurerorqualifiedindividualwho,acting2reasonablyandingoodfaith,complieswiththissectionshall3beimmunefromadministrativeorcivilliabilitythatmay4arisefromdisclosingtheeligibleadult’sinformationtoa5permissiblethirdparty.6Sec.7.NEWSECTION.508.104Disbursementsortransactions7——delay.81.Ifaninsurerorqualifiedindividualreasonably9believesadisbursementortransactionislikelytoresultin,10orcontributeto,thefinancialexploitationofaneligible11adult,theinsurerorqualifiedindividualmayinitiatean12internalreviewoftherequesteddisbursementortransaction.132.Aninsurermaydelayadisbursementortransaction14fromaneligibleadult’spolicy,contract,oraccount,ora15policy,contract,oraccountonwhichaneligibleadultisa16beneficiary,ifallofthefollowingapply:17a.Theinsurerorqualifiedindividualreasonablybelieves,18afterinitiatinganinternalreviewundersubsection1,that19therequesteddisbursementortransactionwilllikelyresult20inorcontributetothefinancialexploitationoftheeligible21adult.22b.Immediately,butinnoeventmorethansevenbusiness23daysafterthedisbursementortransactionisdelayed,the24insurerprovideswrittennotificationofthedelayandthe25reasonforthedelaytoallpersonsauthorizedtotransact26businessonthepolicy,contract,oraccount.Aninsureror27qualifiedindividualshallnotnotifyapersonauthorizedto28transactbusinessonthepolicy,contract,oraccountifthe29insurerorqualifiedindividualreasonablybelievestheperson30hascommittedfinancialexploitation,attemptedfinancial31exploitation,committedorattemptedinsurancefraud,or32committedorattemptedotherabuseoftheeligibleadult.33c.Withinsevenbusinessdaysafterthedisbursementor34transactionisdelayed,theinsurernotifiesthecommissioner35-4-LSB5465SV(2)91nls/ko4/10S.F.2454ofthedelayandprovidestothecommissionerthereason1forthedelay,includingthestatusoftheinternalreview2initiatedundersubsection1.3d.Theinsurercontinuestheinternalreviewofthe4suspectedorattemptedfinancialexploitationoftheeligible5adult,asnecessary,andprovidesthecommissionerwithupdates6uponrequest.73.Anydelayofadisbursementortransactionauthorizedby8thissectionwillexpireuponthefirsttooccurofanyofthe9following:10a.Afinaldeterminationbytheinsurerthatthe11disbursementortransactionwillnotresultinorcontributeto12financialexploitationoftheeligibleadult.13b.Fifteenbusinessdaysafterthedateonwhichtheinsurer14firstdelayeddisbursementofthefundsorthetransaction,15unlessextendedpursuanttoparagraph“c”.16c.Providedtheinternalreviewundersubsection2,17paragraph“d”,continuestosupporttheinsurerorqualified18individual’sreasonablebeliefthatthedisbursementor19transactionwilllikelyresultinorcontributetothe20financialexploitationofaneligibleadult,theinsurermay21extendthedelaybeyondtheinitialdelayunderparagraph“b”22fornomorethantwenty-fivebusinessdaysafterthedateon23whichtheinsurerfirstdelayeddisbursementofthefundsor24thetransaction,unlessextendedpursuanttoparagraph“d”.25d.Providedtheinternalreviewundersubsection2,26paragraph“d”,continuestosupporttheinsurerorqualified27individual’sreasonablebeliefthatthedisbursementor28transactionwilllikelyresultinorcontributetothe29financialexploitationofaneligibleadult,theinsurermay30extendthedelaybeyondthedelayunderparagraph“c”forno31morethanfifty-fivebusinessdaysafterthedateonwhichthe32insurerfirstdelayeddisbursementofthefundsortransaction.334.Notwithstandingsubsection3,uponpetitionofthe34commissioner,theinsurerwhoinitiatedadelaypursuantto35-5-LSB5465SV(2)91nls/ko5/10S.F.2454thissection,oranotherinterestedparty,acourtofcompetent1jurisdictionmayenteranorderterminating,extending,or2modifyingthedelayofthedisbursementortransactionandmay3orderanyotherprotectivereliefdeemednecessary.45.Thecommissionermayadoptrulespursuanttochapter517Aregardingtheformandmannerofnotificationsunderthis6section.76.Aninsurerorqualifiedindividualwho,acting8reasonablyandingoodfaith,complieswiththerequirements9ofthissectionorchapter507Eshallbeimmunefrom10administrativeorcivilliabilitythatmayarisefromadelay11inadisbursementortransactioninitiatedpursuanttothis12section.13Sec.8.NEWSECTION.508.105Trainingrequirements.141.Aninsurershallprovidetrainingtosupervisorsand15employeesemployedbytheinsurerwhohandleoradviseon16complaints,possiblefraud,andinvestigationsnolaterthan17June30,2027.Thetrainingshallincludeinstructiononall18ofthefollowing:19a.Identifyingsuspectedorattemptedexploitation20ofaneligibleadult,includingcommonsignsindicating21financialexploitationofaneligibleadultandhowtoprovide22notificationregardingthesuspectedorattemptedexploitation23ofaneligibleadult.24b.Privacyandconfidentialityrequirements.252.Aninsurershallprovidethetrainingrequiredunder26subsection1assoonasreasonablypracticableafterthedate27asupervisororemployeebeginsemploymentwithorbecomes28affiliatedorassociatedwiththeinsurer,butnolaterthan29oneyearafterthatdate.303.Aninsurershallnotberequiredtoprovidetraining31underthissectiontoaqualifiedindividualemployedbythe32insurer.334.Thecommissionermayadoptrulespursuanttochapter17A34specifyingthecontentandmethodoftrainingrequiredunder35-6-LSB5465SV(2)91nls/ko6/10S.F.2454thissection.1Sec.9.NEWSECTION.508.106Records.2Aninsurershallprovideaccesstoorcopiesofrecords3thatarerelevanttothesuspectedorattemptedfinancial4exploitationofaneligibleadulttothecommissionerand5tolawenforcement,eitheraspartofareferraltothe6commissionerorlawenforcement,orupontherequestofthe7commissionerorlawenforcementpursuanttoaninvestigation.8Therecordsmayincludehistoricalrecordsaswellasrecords9relatingtothemostrecenttransactionsanddisbursement10requestsfromthepolicies,contracts,oraccountsthatmay11indicatefinancialexploitationofaneligibleadult.All12recordsmadeavailabletothecommissionerorlawenforcement13pursuanttothissectionshallbeconsideredconfidential14publicrecordsunderchapter22andshallnotbeavailable15forexaminationbythepublicpursuanttosection22.2.This16sectionshallnotbeconstruedtolimitorotherwiseimpedethe17authorityofthecommissionertoaccessorexaminethebooks18andrecordsofinsurersasotherwiseprovidedbylaw.19Sec.10.CODEEDITORDIRECTIVE.TheCodeeditorisdirected20todesignatesections508.1through508.39,asamendedby21thisAct,assubchapterIofchapter508entitled“General22Provisions”,andtodesignatesections508.101through508.106,23asenactedbythisAct,assubchapterIIofchapter50824entitled“FinancialExploitationofEligibleAdults”.25EXPLANATION26Theinclusionofthisexplanationdoesnotconstituteagreementwith27theexplanation’ssubstancebythemembersofthegeneralassembly.28Thisbillrelatestolifeinsurance,permissiblethird29parties,andfinancialexploitationofeligibleadults.30Undercurrentlaw,adelayofadisbursementortransaction31involvingthemoney,assets,orpropertyofaneligibleadult32willexpireuponthefirsttooccurof:(1)adeterminationby33thebroker-dealerorinvestmentadviserthatthedisbursement34ortransactionwillnotresultinorcontributetofinancial35-7-LSB5465SV(2)91nls/ko7/10S.F.2454exploitationoftheeligibleadult,or(2)15daysafterthe1firstdelay,unlessextended,inwhichcasethedelayshall2expirenomorethan25daysafterthedatethedisbursementor3transactionwasfirstdelayed.Underthebill,anydelayofa4disbursementortransactionwillexpireuponthefirsttooccur5of:(1)adeterminationbythebroker-dealerorinvestment6adviserthatthedisbursementortransactionwillnotresultin7orcontributetofinancialexploitation,or(2)15daysafter8thedatethebroker-dealerorinvestmentadviserfirstdelayed9thedisbursementortransaction,unlessextended,(3)ifthe1015-daydelayisextended,25daysafterthedateoftheinitial11delay,or(4)ifthe25-daydelayisextended,55daysafter12thedateoftheinitialdelay.“Eligibleadult”and“qualified13individual”aredefinedbythebill.14Underthebill,ifaninsurerorqualifiedindividual15reasonablybelievesfinancialexploitationofaneligible16adulthasoccurred,wasattempted,orisbeingattempted,the17insurerorqualifiedindividualmaynotifythecommissionerof18insurance(commissioner)whenitisdeterminedthatfinancial19exploitationmayhaveoccurred,beenattempted,orisbeing20attempted.Aninsurerorqualifiedindividualwhomakesa21disclosureofinformationtothecommissionerunderthebill22orunderCodechapter507Eshallbeimmunefromadministrative23orcivilliabilityforfailuretonotifytheeligibleadultof24thedisclosure.25Ifaninsurerorqualifiedindividualreasonablybelieves26financialexploitationofaneligibleadulthasoccurred,was27attempted,orisbeingattempted,theinsurerorqualified28individualmaynotifyapermissiblethirdpartydesignated29bytheeligibleadult,butisnotrequiredto,priortoa30revieworinvestigationintothefinancialexploitation.An31insurerorqualifiedindividualshallnotnotifyapermissible32thirdpartythattheyaresuspectedoffinancialexploitation33orotherabuseoftheeligibleadult.Aneligibleadult34mayvoluntarilyprovidecontactinformationforpermissible35-8-LSB5465SV(2)91nls/ko8/10S.F.2454thirdpartiestoaninsurer,butaninsurerorqualified1individualshallnotbeheldliableforfailingtorequestsuch2information.3Aninsurerorqualifiedindividualwho,actingreasonably4andingoodfaith,complieswiththebillshallbeimmune5fromadministrativeorcivilliabilitythatmayarisefrom6disclosingtheeligibleadult’sinformationtoapermissible7thirdparty.8Ifaninsurerorqualifiedindividualreasonablybelieves9adisbursementortransactionislikelytoresultin,or10contributeto,thefinancialexploitationofaneligible11adult,theymayinitiateaninternalreviewoftherequested12disbursementortransaction.Theinsurermaydelaya13disbursementortransactionfromaneligibleadult’spolicy,14contract,oraccount,orapolicy,contract,oraccounton15whichaneligibleadultisabeneficiary,iftheinsureror16qualifiedindividualreasonablybelievesthedisbursement17ortransactionwilllikelyresultinorcontributetothe18financialexploitationofaneligibleadult;theinsurer19provideswrittennotificationofthedelayandthereasonfor20thedelaytoallpersonsauthorizedtotransactbusinesson21thepolicy,contract,oraccount,exceptifsuchpersonis22reasonablybelievedtohavecommittedorattemptedfinancial23exploitation,insurancefraud,orotherabuseoftheeligible24adult;theinsurernotifiesthecommissionerofthedelay25andprovidesthereasonforthedelay;andtheinsurer26continuestheinternalreviewofthesuspectedorattempted27financialexploitationoftheeligibleadultandprovidesthe28commissionerwithupdatesuponrequest.29Delayofadisbursementortransactionwillexpireupon30thefirsttooccurofafinaldeterminationbytheinsurer31thatthedisbursementortransactionwillnotresultinor32contributetofinancialexploitation,15daysafterthedateon33whichtheinsurerfirstdelayeddisbursementofthefundsor34thetransaction,unlessextended,25businessdaysafterthe35-9-LSB5465SV(2)91nls/ko9/10S.F.2454dateonwhichtheinsurerfirstdelayeddisbursement,unless1extended,or55daysafterthedateonwhichtheinsurerfirst2delayeddisbursement.Uponpetitionofthecommissioner,the3insurer,oranotherinterestedparty,acourtofcompetent4jurisdictionmayenteranorderterminating,extending,or5modifyingthedelayofthedisbursementortransactionandmay6orderanyotherprotectivereliefnecessary.7Thecommissionermayadoptrulesregardingtheform8andmannerofnotificationsunderthebill.Aninsureror9qualifiedindividualwhocomplieswiththerequirementsofthe10billshallbeimmunefromanyliabilitythatmayarisefrom11suchdelayinadisbursementortransaction.12Aninsurershallprovidetrainingtosupervisorsand13employeesemployedbytheinsurer,exceptemployeeswhoare14qualifiedindividuals,whohandleoradviseoncomplaints,15possiblefraud,andinvestigationsnolaterthanJune30,162027.Thetrainingshallincludetherequirementsdetailedin17thebill.Aninsurershallprovidetherequiredtrainingas18soonasreasonablypracticable,butatleastwithinoneyear19afterthedateasupervisororemployeebeginsemploymentwith20orbecomesaffiliatedorassociatedwiththeinsurer.The21commissionermayadoptrulesspecifyingthecontentandmethod22oftraining.23Aninsurershallprovideaccesstoorcopiesofrecords24thatarerelevanttofinancialexploitationofaneligible25adulttothecommissionerandtolawenforcement,eitheras26partofareferralorupontherequestofthecommissioneror27lawenforcementpursuanttoaninvestigation.Therecordsmay28includehistoricalrecordsaswellasrecordsrelatingtothe29mostrecentfinancialexploitationofaneligibleadult.All30recordsmadeavailabletothecommissionerorlawenforcement31shallbeconsideredconfidentialpublicrecordsandshallnot32beavailableforexaminationbythepublic.33ThebillmakesconformingchangestoCodesection34507E.8(1)(a)and(b)(lawenforcementauthority).35-10-LSB5465SV(2)91nls/ko10/10
