hf2669/introduced.txtHouseFile2669-IntroducedHOUSEFILE2669BYCOMMITTEEONTRANSPORTATION(SUCCESSORTOHF2476)ABILLFORAnActrelatingtodriver’slicensesandnonoperator’s1identificationcardsmarkedtoreflectaholder’s2nonapparentdisabilitystatus,andincludingapplicability3provisions.4BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:5TLSB5121HV(2)91th/nsH.F.2669Section1.Section321.189,subsection10,Code2026,is1amendedtoreadasfollows:210.AutismspectrumdisorderNonapparentdisability3status.Alicenseewhohasanonapparentdisability,4includingautismspectrumdisorder,asdefinedinsection5514C.28,amentaldisability,asdefinedinsection915.37,a6developmentaldisability,asdefinedinsection335.25,orany7otherintellectualdisability,mayrequestthatthelicense8bemarkedtoreflectthelicensee’sautismspectrumdisorder9nonapparentdisabilitystatusonthefaceofthelicensewhen10thelicenseeappliesfortheissuanceorrenewalofalicense.11Alicenseemaychoosetohavethefaceoftheperson’slicense12markedwithabutterflydesignapprovedbythedepartment,or13inamannerthedepartmentdeterminesissufficienttosignify14thepersonhasanonapparentdisability.Thedepartmentmay15adoptrulespursuanttochapter17Aestablishingcriteriaunder16whichalicensemaybemarked,includingrequiringthelicensee17tosubmitmedicalproofofthelicensee’sautismspectrum18disordernonapparentdisabilitystatus.Whenadriver’s19licenseissomarked,thelicensee’sautismspectrumdisorder20nonapparentdisabilitystatusshallbenotedintheelectronic21databaseusedbythedepartmentandlawenforcementtoaccess22registration,titling,anddriver’slicenseinformation.The23department,inconsultationwiththedepartmentofhealth24andhumanservices,shalldevelopeducationalmediatoraise25awarenessofalicensee’sabilitytorequestthelicensebe26markedtoreflectthelicensee’sautismspectrumdisorder27nonapparentdisabilitystatus.28Sec.2.Section321.190,subsection1,paragraphb,29subparagraph(6),Code2026,isamendedtoreadasfollows:30(6)Anapplicantforanonoperator’sidentification31cardwhohasautismspectrumdisorder,asdefinedinsection32514C.28anonapparentdisability,asdescribedinsection33321.189,subsection10,mayrequestthatthecardbemarkedto34reflecttheapplicant’sautismspectrumdisordernonapparent35-1-LSB5121HV(2)91th/ns1/3H.F.2669disabilitystatusonthefaceofthecardwhentheapplicant1appliesfortheissuanceorrenewalofacard.Anapplicant2maychoosetohavethefaceoftheperson’scardmarkedwith3abutterflydesignapprovedbythedepartment,orinamanner4thedepartmentdeterminesissufficienttosignifytheperson5hasanonapparentdisability.Thedepartmentmayadoptrules6pursuanttochapter17Aestablishingcriteriaunderwhicha7cardmaybemarked,includingrequiringtheapplicanttosubmit8medicalproofoftheapplicant’sautismspectrumdisorder9nonapparentdisabilitystatus.Thedepartment,inconsultation10withthedepartmentofhealthandhumanservices,shalldevelop11educationalmediatoraiseawarenessofanapplicant’sability12torequestthecardbemarkedtoreflecttheapplicant’sautism13spectrumdisordernonapparentdisabilitystatus.14Sec.3.APPLICABILITY.ThisActappliesonandafterMarch151,2027,orthedatethedepartmentoftransportationsubmits16totheIowaadministrativecodeeditorforpublicationinthe17Iowaadministrativebulletinastatementbythedirectorof18transportationthattheapplicablephaseofthedepartmentof19transportation’snewrecordssystemisimplemented,whichever20isearlier.Thedepartmentshallalsoforwardacopyofthe21statementtotheIowaCodeeditor.22EXPLANATION23Theinclusionofthisexplanationdoesnotconstituteagreementwith24theexplanation’ssubstancebythemembersofthegeneralassembly.25Undercurrentlaw,apersonwhohasautismspectrum26disordermaybeissuedadriver’slicenseornonoperator’s27identificationcard(IDcard)thatismarkedtoreflectthe28person’sautismspectrumdisorderstatusonthefaceofthe29licenseorIDcard.Thisbillinsteadauthorizesaperson30withanonapparentdisability,asdescribedinthebill,to31beissuedadriver’slicenseorIDcardmarkedtoreflectthe32person’snonapparentdisabilitystatus.Apersonmustrequest33theperson’slicenseorIDcardbemarkedwhentheperson34appliesforissuanceorrenewalofalicenseorIDcard.A35-2-LSB5121HV(2)91th/ns2/3H.F.2669personmaychoosetohavethelicenseorIDcardmarkedwitha1butterflydesignapprovedbythedepartmentoftransportation2(DOT)orinamannertheDOTdeterminesissufficientto3signifythepersonhasanonapparentdisability.Inaccordance4withcurrentlaw,theDOTmayestablishcriteriaunderwhich5alicenseorIDcardmaybemarked,includingrequiring6anapplicanttosubmitmedicalproofoftheapplicant’s7nonapparentdisabilitystatus.8Thebilldoesnotamendthemannerinwhichalicenseor9IDcardismarkedtoreflectthestatusofadeafpersonor10hard-of-hearingpersonpursuanttoCodesections321.189(9)and11321.190(1)(b)(5).12ThebillappliesonandafterMarch1,2027,orthedate13theDOTsubmitstotheIowaadministrativecodeeditorfor14publicationintheIowaadministrativebulletinastatementby15thedirectoroftransportationthattheapplicablephaseofthe16DOT’snewrecordssystemisimplemented,whicheverisearlier.17TheDOTisalsorequiredtoforwardacopyofthestatementto18theIowaCodeeditor.19-3-LSB5121HV(2)91th/ns3/3
