1AN ACT
2 To amend and reenact R.S. 17:3703(M), relative to compensation for intercollegiate
3athletics; to provide relative to an intercollegiate athletics revenue sharing program;
4to provide relative to public records; to create a public records exception; to provide
5for applicability; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7Section 1. R.S. 17:3703(M) is hereby amended and reenacted to read as follows:
8§3703.     Intercollegiate athlete's compensation and rights; responsibilities of
9postsecondary education institutions

11M.(1) Any document disclosed by the an intercollegiate athlete to the
12postsecondary education institution where he is enrolled that references the terms
13and conditions of the athlete's his contract for compensation shall be confidential and
14not subject to inspection, examination, copying, or reproduction pursuant to the
15Public Records Law.
16(2) The total amount of revenue expended by a postsecondary education
17institution during each fiscal year as part of an intercollegiate athletics revenue
18sharing program is subject to public disclosure. However, the following records and
19information are not subject to public disclosure and not subject to inspection,
20examination, copying, or reproduction pursuant to the Public Records Law:
21(a) The total amount, and any percentage amount, of those revenue funds
22paid as part of a postsecondary education institution's athletics revenue sharing
23program to any specific intercollegiate athlete.
24(b) The total amount, and any percentage amount, of those revenue funds
25allocated as part of a postsecondary education institution's athletics revenue sharing
26program to any specific intercollegiate sport or athletic program.

1(3) Any document related to or created as part of the process of negotiating
2an agreement with an intercollegiate athlete as part of a postsecondary education
3institution's intercollegiate athletics revenue sharing program, including any
4agreements entered into with any specific intercollegiate athlete, is confidential and
5not subject to inspection, examination, copying, or reproduction pursuant to the
6Public Records Law.

8Section 2. The provisions of this Act shall apply both prospectively and retroactively
9 to all records, documents, information, and requests for disclosure existing, created, or
10 pending on or afer the effective date of this Act. This Act is intended to clarify and confirm
11 the confidentiality of the records and information described in R.S. 17:3703(M), as amended
12 and reenacted by this Act.
