1AN ACT
2 To amend and reenact R.S. 33:4084(A)(1)(a) and (b) and (C) and to repeal R.S.
333:4084(A)(1)(c), relative to the city of New Orleans; to provide relative to the
4Sewerage and Water Board of New Orleans; to provide relative to purchases of
5material and supplies by the board; to provide relative to the requirements of such
6purchases; to provide relative to the advertising and letting of contracts; and to
7provide for related matters.
8Notice of intention to introduce this Act has been published
9as provided by Article III, Section 13 of the Constitution of
10Louisiana.
11 Be it enacted by the Legislature of Louisiana:
12Section 1. R.S. 33:4084(A)(1)(a) and (b) and (C) are hereby amended and reenacted
13 to read as follows:
14§4084. Purchase of supplies; machinery and equipment; emergency purchase;
15preference to home merchants
16A.(1)(a) All purchases of materials or supplies required by the board for the
17conduct, operation, maintenance, and repair of the public systems of sewerage,
18water, and drainage exceeding the sum of thirty thousand dollars shall be advertised
19and let by contract to the lowest responsible bidder who has bid according to the
20contract plans and specifications as advertised shall be made in accordance with the
21provisions of R.S. 38:2212.1(A)(1)(a).
22(b) However, purchases of ten thousand dollars or more, but not more than
23thirty thousand dollars, shall be made by obtaining not less than three quotes by
24telephone, facsimile, email, or any other electronic form. If telephone quotes are
25received, a written confirmation of the accepted offers shall be obtained and made
26a part of the purchase file. If quotations lower than the accepted quotation are

1received, the reasons for their rejection shall be recorded in the purchase file made
2within the threshold set by R.S. 38:2212.1(A)(1)(b) shall be made in accordance with
3the provisions of that Subparagraph.

5C. In the event of an emergency the executive director or the general
6superintendent of the board may, with the written consent of the president pro
7tempore of the board or the mayor of the city, contract a bill for such supplies and
8materials, not exceeding ten thirty thousand dollars in amount. However, all bills so
9contracted shall be reported, with the reasons for the emergency, to the board at its
10next meeting.

12Section 2. R.S. 33:4084(A)(1)(c) is hereby repealed in its entirety.
