hb893/chaptered.txtENROLLED2026 Regular SessionACT No. 851HOUSE BILL NO. 893BY REPRESENTATIVE KNOX1AN ACT2 To amend and reenact R.S. 33:4084(A)(1)(a) and (b) and (C) and to repeal R.S.333:4084(A)(1)(c), relative to the city of New Orleans; to provide relative to the4Sewerage and Water Board of New Orleans; to provide relative to purchases of5material and supplies by the board; to provide relative to the requirements of such6purchases; to provide relative to the advertising and letting of contracts; and to7provide for related matters.8Notice of intention to introduce this Act has been published9as provided by Article III, Section 13 of the Constitution of10Louisiana.11 Be it enacted by the Legislature of Louisiana:12Section 1. R.S. 33:4084(A)(1)(a) and (b) and (C) are hereby amended and reenacted13 to read as follows:14§4084. Purchase of supplies; machinery and equipment; emergency purchase;15preference to home merchants16A.(1)(a) All purchases of materials or supplies required by the board for the17conduct, operation, maintenance, and repair of the public systems of sewerage,18water, and drainage exceeding the sum of thirty thousand dollars shall be advertised19and let by contract to the lowest responsible bidder who has bid according to the20contract plans and specifications as advertised shall be made in accordance with the21provisions of R.S. 38:2212.1(A)(1)(a).22(b) However, purchases of ten thousand dollars or more, but not more than23thirty thousand dollars, shall be made by obtaining not less than three quotes by24telephone, facsimile, email, or any other electronic form. If telephone quotes are25received, a written confirmation of the accepted offers shall be obtained and made26a part of the purchase file. If quotations lower than the accepted quotation arePage 1 of 2CODING: Words in struck through type are deletions from existing law; words underscoredare additions.HB NO. 893 ENROLLED1received, the reasons for their rejection shall be recorded in the purchase file made2within the threshold set by R.S. 38:2212.1(A)(1)(b) shall be made in accordance with3the provisions of that Subparagraph.4* * *5C. In the event of an emergency the executive director or the general6superintendent of the board may, with the written consent of the president pro7tempore of the board or the mayor of the city, contract a bill for such supplies and8materials, not exceeding ten thirty thousand dollars in amount. However, all bills so9contracted shall be reported, with the reasons for the emergency, to the board at its10next meeting.11* * *12Section 2.
