hb895/chaptered.txtENROLLED2026 Regular SessionACT No. 852HOUSE BILL NO. 895BY REPRESENTATIVES BOYD AND CHASSION1AN ACT2 To amend and reenact R.S. 40:1216.1(A)(2)(e), relative to survivors of sexual assault; to3provide for medical treatment by a healthcare provider; to provide for a minimum4supply of post-exposure prophylaxis; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6Section 1. R.S. 40:1216.1(A)(2)(e) is hereby amended and reenacted to read as7 follows:8§1216.1. Procedures for survivors of a sexually oriented criminal offense;9immunity; regional plans; maximum allowable costs; definitions; documents10requested by victim11A. All licensed hospitals and healthcare providers in Louisiana shall offer12every sexual assault survivor information to receive the treatment provided for in this13Section. A licensed hospital or healthcare provider shall adhere to the following14procedures if a person presents for treatment as a sexual assault survivor:15* * *16(2) All sexual assault survivors shall be examined and treated, without undue17delay, in a private space required to ensure the health, safety, and welfare of the18survivor by a qualified healthcare provider. Examination and treatment, including19the forensic medical examination, shall be adapted as necessary to address the unique20needs and circumstances of each survivor. All survivors shall be afforded an21advocate whose communications are privileged in accordance with the provisions of22R.S. 46:2187, if one is available. With the consent of the survivor, an advocate shall23remain in the examination room during the forensic medical examination.
