1AN ACT
2 To amend and reenact R.S. 40:1216.1(A)(2)(e), relative to survivors of sexual assault; to
3provide for medical treatment by a healthcare provider; to provide for a minimum
4supply of post-exposure prophylaxis; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6Section 1. R.S. 40:1216.1(A)(2)(e) is hereby amended and reenacted to read as
7 follows:
8§1216.1.    Procedures for survivors of a sexually oriented criminal offense;
9immunity; regional plans; maximum allowable costs; definitions; documents
10requested by victim
11A. All licensed hospitals and healthcare providers in Louisiana shall offer
12every sexual assault survivor information to receive the treatment provided for in this
13Section. A licensed hospital or healthcare provider shall adhere to the following
14procedures if a person presents for treatment as a sexual assault survivor:

16(2) All sexual assault survivors shall be examined and treated, without undue
17delay, in a private space required to ensure the health, safety, and welfare of the
18survivor by a qualified healthcare provider. Examination and treatment, including
19the forensic medical examination, shall be adapted as necessary to address the unique
20needs and circumstances of each survivor. All survivors shall be afforded an
21advocate whose communications are privileged in accordance with the provisions of
22R.S. 46:2187, if one is available. With the consent of the survivor, an advocate shall
23remain in the examination room during the forensic medical examination. With the
24consent of the survivor, the examination and treatment of all sexual assault survivors
25shall, at a minimum, include all of the following:

1(e) Any medication provided during the forensic medical examination, which
2may include examination. A healthcare provider shall make available to each
3survivor, when medically indicated, emergency contraception and HIV and STI post-
4exposure prophylaxis administered in accordance with the Drug Information
5Handbook.
