1 AN ACT concerning extraordinary events; authorizing the governor to
2   issue a proclamation declaring the need for enhanced security for an
3   extraordinary event; providing the governor with certain authority
4   during an extraordinary event declaration.

6 Be it enacted by the Legislature of the State of Kansas:
7     Section 1. (a) (1) If an extraordinary event is hosted in Kansas or in
8 any county bordering Kansas that causes a significant impact in Kansas,
9 the governor, upon making a finding that such event will attract a
10 significant number of visitors to the state that would burden the ability of
11 local agencies and law enforcement agencies to maintain public safety,
12 transportation services, security or other essential infrastructure without
13 additional resources and coordination, may issue a proclamation declaring
14 the need for enhanced security for such an extraordinary event.
15     (2) Such extraordinary event declaration may be valid for up to 15
16 days and may be extended by the legislative coordinating council for a
17 period not to exceed 150 days. At any time within such period, the
18 legislative coordinating council may terminate the extraordinary event
19 declaration.
20     (b) A proclamation declaring the need for enhanced security for an
21 extraordinary event shall activate the disaster response and recovery
22 aspects of the state disaster emergency plan and any local and
23 interjurisdictional disaster plans applicable to the areas of the state and any
24 political subdivisions thereof that are affected by the proclamation. Such
25 proclamation shall constitute the authority necessary for the deployment
26 and use of any forces to which the plan or plans apply and the use or
27 distribution of any supplies, equipment, materials or facilities assembled,
28 stockpiled or arranged to be made available for an extraordinary event.
29     (c) (1) A proclamation declaring the need for enhanced security for an
30 extraordinary event shall authorize the governor to:
31     (A) Utilize all available resources of the state government and each
32 political subdivision as reasonably necessary to cope with the
33 extraordinary event;
34     (B) transfer the supervision, personnel or functions of state
35 departments and agencies or units thereof for the purpose of performing or
36 facilitating security activities;

1    (C) require and direct the cooperation and assistance of state and
2 local governmental agencies and officials; and
3    (D) make requests for funding or other aid from the federal
4 emergency management agency.
5    (2) A proclamation declaring the need for security for an
6 extraordinary event shall not authorize the governor to exercise any power
7 described in K.S.A. 48-925, and amendments thereto, other than the
8 powers described in paragraph (1). If the governor determines that
9 additional emergency powers are necessary, the governor may issue a state
10 of disaster emergency proclamation pursuant to K.S.A. 48-924, and
11 amendments thereto.
12    (d) As used in this section, "extraordinary event" includes, but is not
13 limited to, the world cup hosted by the international federation of
14 association football, the olympics, the super bowl hosted by the national
15 football league, a national political convention or an event that is similar
16 thereto in scope and size with respect to expected attendance and security
17 requirements.
18    (e) The provisions of this section shall expire on July 1, 2027.
19    Sec. 2. This act shall take effect and be in force from and after its
20 publication in the Kansas register.
