1A CONCURRENT RESOLUTION directing the Legislative Research Commission
2 to establish the Performance-Based Education Task Force.
3WHEREAS, an education system grounded in time-based requirements rather than
4 learning acquisition is at odds with our educational aspirations; and
5WHEREAS, the skills and knowledge to meet the needs of the modern economy
6 demand more than seat time as a primary indicator of learning outcomes; and
7WHEREAS, the federal Every Student Succeeds Act of 2015, Pub. L. No. 114-95,
8 defers to states to set the requirements and credit-earning activities for high school
9 graduation; and
10WHEREAS, current administrative regulations in Kentucky permit local boards of
11 education to issue performance-based credit aligned with the Kentucky academic
12 standards, regardless of the number of instructional hours; and
13WHEREAS, despite this option being available, adoption of performance-based
14 credit has yet to receive widespread adoption; and
15WHEREAS, other states, such as Wyoming with its Reimaging and Innovating the
16 Delivery of Education Initiative (RIDE), have seen great success with initiatives to
17 expand performance-based credit earning opportunities among their students; and
18WHEREAS, expansion of performance-based credit earning opportunities could
19 provide opportunities for academic success among students who may struggle in
20 achieving the traditional Carnegie time-based unit; and
21WHEREAS, expansion of performance-based credit earning opportunities could
22 permit for an accelerated timeline in students earning a high school diploma and entering
23 into postsecondary education or the workforce, resulting in substantial economic
24 advantage to Kentucky;
25NOW, THEREFORE,
26 Be it resolved by the Senate of the General Assembly of the Commonwealth of
27 Kentucky, the House of Representatives concurring therein:

1Section 1. The Legislative Research Commission is hereby directed to establish
2 the Performance-Based Education Task Force to:
3(1)   Review statutes and administrative regulations that may permit or serve as a
4 barrier to performance-based credit earning opportunities;
5(2)   Review existing performance-based credit earning opportunities across
6 Kentucky to understand their impact and areas for improvement; and
7(3)   Assess support systems needed by local boards of education to encourage the
8 expansion of performance-based credit earning opportunities.
9Section 2. The Performance-Based Education Task Force shall be composed of
10 the following 13 members, with final membership of the task force being subject to the
11 consideration and approval of the Legislative Research Commission:
12(1)   Three members of the House of Representatives to be appointed by the
13 Speaker of the House of Representatives, one of whom shall be designated to serve as co-
14 chair;
15(2)   Three members of the Senate to be appointed by the President of the Senate,
16 one of whom shall be designated to serve as co-chair;
17(3)   One member of the House of Representatives to be appointed by the Minority
18 Floor Leader of the House of Representatives;
19(4)   One member of the Senate to be appointed by the Minority Floor Leader of
20 the Senate;
21(5)   The commissioner of education or designee; and
22(6)   To be appointed by the Legislative Research Commission:
23(a)   Two members with experience or expertise in developing or administering
24 performance-based credit earning opportunities in secondary education; and
25(b)   Two members who each serve as a member of a local board of education or as
26 a superintendent of a local school district in Kentucky.
27Section 3.      The Performance-Based Education Task Force shall meet as

1 necessary during the 2026 Interim of the General Assembly. The task force shall develop
2 and submit any recommendations for changes the task force may adopt relating to the
3 expansion of performance-based credit earning opportunities across Kentucky's public
4 schools to the Legislative Research Commission for referral to the appropriate committee
5 or committees by December 1, 2026.
6Section 4.      Provisions of this Resolution to the contrary notwithstanding, the
7 Legislative Research Commission shall have the authority to alternatively assign the
8 issues identified herein to an interim joint committee or subcommittee thereof, and to
9 designate a study completion date.
