1A CONCURRENT RESOLUTION urging the creation of an interstate compact for
2 a competitive electric transmission market using competitive bidding.
3WHEREAS, anticompetitive policies in some states constrain efforts to modernize
4 and expand energy transmission assets; and
5WHEREAS, these policies have hindered infrastructure growth and increased
6 transmission costs to ratepayers because the noncompetitive nature of the permitting and
7 siting process of transmission projects does not incentivize the reduction of costs or
8 optimization of benefits; and
9WHEREAS, some of the most popular, anticompetitive laws discriminate against
10 out-of-state businesses, which may violate the commerce clause of the United States
11 Constitution; and
12WHEREAS, market-led consumer demand for better products and services has
13 precipitated an increased need for power generation in the United States; and
14WHEREAS, to maintain a viable and growing economy, ensure a secure and
15 reliable power supply in the United States, and promote economic prosperity for the
16 citizens of the Commonwealth, the transmission capacity of the current utility
17 infrastructure must be modernized and expanded in a way that is responsive to the needs
18 and demands of both citizens and businesses;
19NOW, THEREFORE,
20 Be it resolved by the House of Representatives of the General Assembly of the
21 Commonwealth of Kentucky, the Senate concurring therein:
22Section 1. The General Assembly calls for the creation of an interstate compact
23 for the development of a competitive electric transmission market that would:
24(1)     Be in the best interests of the electric utility ratepayer and the
25 Commonwealth's economy;
26(2)     Deploy the requisite technologies to enhance and modernize the transmission
27 grid; and

1(3)     Improve the electric transmission grid's capacity to transport electric energy
2 while preventing transmission bottlenecks and congestion.
3Section 2. Any interstate compact for the development of a competitive electric
4 transmission market should:
5(1)     Use uniform rules, requirements, and procedures for the permitting and siting
6 of transmission lines, upgrading or reconductoring of the transmission infrastructure, and
7 deploying grid-enhancing technologies across states within a regional transmission
8 organization for all types of electric generating units, regardless of the fuel or electric
9 generating technology used;
10(2)     Allocate costs in an unbiased, holistic manner to all beneficiaries of the
11 competitive transmission market;
12(3)     Streamline all permits and regulatory reviews when deploying innovative
13 grid-enhancing technologies;
14(4)     Open the bidding process to interstate transmission projects;
15(5)     Eliminate redundancies or instances of double permitting for different
16 intragovernmental units in the transmission siting and permitting process;
17(6)     Develop and prioritize what would be known as co-location superhighways
18 for streamlined permitting and coordinated infrastructure development projects when
19 possible; and
20(7)     Apply the compact equally to all states upon each legislature's adoption of the
21 compact.
22Section 3. The Clerk of the House of Representatives is directed to transmit a
23 copy of this Resolution to the Governor and the commissioners of the Public Service
24 Commission.
