3Relating to Talladega County; to establish a service of
4 process fee for the service or attempted service of certain
5 documents by the Talladega County Sheriff's Office in the
6 civil division; and to provide for the disposition of service
7 of process fees.
8 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
9Section 1. This act shall only apply to Talladega
10 County.
11Section 2. (a)(1) The Talladega County Sheriff's Office
12 shall collect a service of process fee of fifty dollars ($50)
13 for service or attempted service of process by the sheriff for
14 matters pending or to be commenced in a court outside the
15 State of Alabama.
16(2) The Talladega County Sheriff's Office shall collect
17 a service of process fee of one hundred dollars ($100) for
18 service or attempted service of process by the sheriff to an
19 inmate at the federal correctional institution in Talladega
20 for matters pending or to be commenced in a court outside of
21 the State of Alabama.
22(b) The clerk of the court or other designee in
23 Talladega County shall collect the service of process fee
24 designated in subsection (a) and shall remit the fee directly
25 to the sheriff for deposit in the sheriff's official account.
26(c) The sheriff's official account shall be an
27 additional account separate from the budget of the sheriff as
28 provided for in the county general fund. The fees deposited

29 into the sheriff's official account shall not diminish,
30 offset, or take the place of budgeted funds or any other
31 source of income established for the sheriff or for the
32 operation of the Talladega County Sheriff's Office. Amounts in
33 the sheriff's official account may be expended at the
34 discretion of the sheriff for law enforcement purposes.
35(d) The district attorney, law enforcement, grand
36 juries, Talladega County, and all other counties in the State
37 of Alabama shall be exempt from payment of the fees provided
38 for in this act.
39Section 3. This act shall become effective immediately.
