Minnesota Statutes 2024, section 342.20, subdivision 1, is amended to read:1.8Subdivision 1. Not public data. The following data collected, created, or maintained1.9 by the office are classified as nonpublic data, as defined by section 13.02, subdivision 9, or1.10 as private data on individuals, as defined by section 13.02, subdivision 12:1.11(1) application data submitted by an applicant for a cannabis business license or hemp1.12 business license, other than the data listed in subdivision 2;1.13(2) the identity of a complainant who has made a report concerning a license holder or1.14 an applicant that appears in inactive investigative data unless the complainant consents to1.15 the disclosure;1.16(3) data identifying retail or wholesale customers of a cannabis business or hemp business;1.17 and1.18(4) data identifying cannabis workers or hemp workers.; and1.19(5) data reported to the office using the statewide monitoring system established under1.20 section 342.05.Section 1. 103/05/26 REVISOR EB/MI 26-06096 as introduced2.1 Sec. 2. Minnesota Statutes 2024, section 342.20, subdivision 2, is amended to read:2.2 Subd. 2. Public data on license applicants. (a) The following application data submitted2.3 by an applicant for a cannabis business license or hemp business license are public data:2.4 (1) the applicant's name and designated address;2.5 (2) data disclosing the ownership and control of the applicant;2.6 (3) proof of trade name registration;2.7 (4) data showing the legal possession of the premises where the business will operate;2.8 (5) data describing whether the volatile chemicals that will be used in any methods of2.9 extraction or concentration, if applicable;2.10 (6) environmental plans;2.11 (7) the type and number of other cannabis business licenses or hemp business licenses2.12 held by the applicant; and2.13 (8) the name, address, location, dates, and hours of where any proposed cannabis event2.14 will take place.; and2.15 (9) the status of the applicant's application, except for an applicant's status as a social2.16 equity applicant.2.17 (b) Scoring and other data generated by the office in its review of an applicant for a2.18 cannabis business license or hemp business license are public data.2.19 Sec. 3. Minnesota Statutes 2024, section 342.20, subdivision 3, is amended to read:2.20 Subd. 3. Public application data on license holders. Once an applicant for a cannabis2.21 business license or hemp business license becomes a license holder, all of the application2.22 or renewal data that the license holder had previously submitted to the office are public data2.23 except that the following data remain classified as nonpublic data or private data on2.24 individuals:2.25 (1) data identifying retail or wholesale customers of a cannabis business or hemp business;2.26 (2) data identifying cannabis workers or hemp workers;2.27 (3) tax returns, bank account statements, and other financial account information;2.28 (4) business plans; and, including descriptions of sites, security, and operations of the2.29 license holder;2.30 (5) data regarding the license holder's accounting compliance;Sec. 3. 203/05/26 REVISOR EB/MI 26-06096 as introduced3.1 (6) data contained in vehicle disclosure forms and related documentation required in3.2 section 342.35, subdivision 2, clauses (1) and (2); and3.3 (5) (7) data classified as nonpublic data or private data on individuals by chapter 13 or3.4 other applicable law.Sec. 3. 3
