Minnesota Statutes 2025 Supplement, section 241.021, subdivision 4f, is1.6 amended to read:1.7Subd. 4f. Provision of medications in correctional facilities. (a) Correctional facilities1.8 licensed by the commissioner shall administer to confined and incarcerated persons the1.9 same medications prescribed to those individuals prior to their confinement or incarceration1.10 upon such prescriptions being verified as current and valid by the correctional facility under1.11 a procedure approved by the facility's licensed health care professional.1.12(b) Unless a confined or incarcerated person is subject to a Jarvis an order issued under1.13 section 253B.092, subdivision 8, that dictates otherwise, paragraph (a) does not apply when:1.14(1) a licensed health care professional determines, after consulting with the licensed1.15 health care professional who prescribed the medication, that the prescribed medication is1.16 not medically appropriate for the person based on the person's medical condition or status;1.17 or1.18(2) a licensed health care professional determines a medication that is at least as effective1.19 as the current medication the person is prescribed is available to treat the condition and the1.20 licensed health care professional who prescribed the current medication approves the change1.21 in medications; orSection 1. 102/27/26 REVISOR VH/MG 26-06729 as introduced2.1 (3) (2) the person provides written notice to informs the licensed health care professional2.2 who is responsible for inmate health care at the correctional facility or the licensed health2.3 care professional's designee that the person no longer desires to take the medication and the2.4 decision is documented in the person's medical records.2.5 (c) As used in this subdivision, "licensed health care professional" means a physician2.6 licensed under chapter 147, physician assistant licensed under chapter 147A, or advanced2.7 practice registered nurse as defined in section 148.171, subdivision 3.Section 1. 2
