Minnesota Statutes 2024, section 325F.676, subdivision 1, is amended to read:1.7Subdivision 1. Definitions. (a) For the purposes of this section, the following terms have1.8the meanings given.1.9(b) "Broadway show" or "Broadway touring engagement" means a live theatrical1.10production presented by a professional producing organization under a limited-run1.11engagement agreement that includes variable or market-based ticket pricing established by1.12the producing organization or place of entertainment.1.13(b) (c) "Commissioner" means the commissioner of commerce.1.14(c) (d) "Entertainment" means all forms of entertainment, including but not limited to1.15theatrical or operatic performances, concerts, motion pictures, entertainment at fairgrounds,1.16amusement parks, athletic competitions and other sports, and all other forms of diversion,1.17recreation, or show.1.18(d) (e) "Internet domain name" means a globally unique, hierarchical reference to an1.19Internet host or service, which is assigned through a centralized Internet naming authority1.20and which is composed of a series of character strings separated by periods with the rightmost1.21string specifying the top of the hierarchy.Section 1. 103/10/26 REVISOR RSI/NS 26-078532.1 (e) (f) "Online ticket marketplace" means the administrator of a website or other electronic2.2 service, including an agent, employee, or assignee of the administrator, that sells tickets or2.3 maintains a platform to facilitate the sale of tickets.2.4 (f) (g) "Operator" means a person, including an agent, employee, or assignee of the2.5 person, who:2.6 (1) owns, operates, or controls a place of entertainment;2.7 (2) produces entertainment; or2.8 (3) sells a ticket to a place of entertainment for original sale.2.9 (g) (h) "Person" means a party, individual, partnership, association, corporation, or other2.10 legal entity.2.11 (h) (i) "Place of entertainment" means an entertainment facility, including but not limited2.12 to an amphitheater, theater, stadium, arena, racetrack, museum, amusement park, venue,2.13 club, or other place where performances, concerts, exhibits, athletic games, contests, or2.14 other forms of entertainment are held. For the purposes of this section, place of entertainment2.15 does not include movie theaters.2.16 (i) (j) "Ticket reseller" means a person that offers or sells tickets for resale after the2.17 original sale to an entertainment event located in this state and includes an operator to the2.18 extent that the operator offers or sells tickets for resale. Sales by a ticket reseller include2.19 sales by any means, including but not limited to in person or by telephone, mail, delivery2.20 service, facsimile, Internet, email, or other electronic means. A ticket reseller does not2.21 include a person that purchases a ticket solely for the person's own use or the use of the2.22 person's invitees, employees, or agents.2.23 (j) (k) "URL" means a uniform resource locator for a website on the Internet.2.24 Sec. 2. Minnesota Statutes 2024, section 325F.676, subdivision 2, is amended to read:2.25 Subd. 2. Disclosures. (a) An operator, ticket reseller, or online ticket marketplace must,2.26 at all times during the ticket listing and purchasing process, disclose in an easily readable2.27 and conspicuous manner and in dollars:2.28 (1) the total cost of the ticket, inclusive of all fees and surcharges that must be paid in2.29 order to purchase the ticket;2.30 (2) the portion of the ticket price that represents a service charge; and2.31 (3) any other fee or surcharge charged to the purchaser.Sec. 2. 203/10/26 REVISOR RSI/NS 26-078533.1 (b) A ticket reseller and online ticket marketplace must at all times during the ticket3.2 listing and purchasing process disclose in an easily readable and conspicuous manner and3.3 in dollars:3.4 (1) the ticket's original purchase price, inclusive of all fees and surcharges; and3.5 (2) the percentage markup above the ticket's original purchase price, inclusive of all fees3.6 and surcharges.3.7 (b) (c) The disclosure of subtotals, fees, charges, and all other components of the total3.8 price must not be false or misleading, and must not be presented more prominently or in3.9 the same or larger size than the total price. The disclosure of subtotals, fees, charges, and3.10 all other components of the total price may be displayed in a manner that allows the purchaser3.11 to hide or minimize the itemized list. The price of a ticket must not increase with respect3.12 to a particular person after the ticket is first displayed to the person, excluding reasonable3.13 fees for the delivery of nonelectronic tickets based on the delivery method selected by the3.14 purchaser and any additional purchases made by the purchaser, which must be disclosed3.15 prior to accepting payment.3.16 (c) (d) A ticket reseller and online ticket marketplace must disclose in an easily readable3.17 and conspicuous manner on the ticket reseller's or online ticket marketplace's website or3.18 electronic service:3.19 (1) that the website or electronic service is owned or operated by a ticket reseller or3.20 online ticket marketplace and that the price of a resale ticket offered for sale may be higher3.21 or lower than the original purchase price;3.22 (2) that the purchaser is responsible for checking with the place of entertainment for3.23 information on changes to the event or cancellations prior to the event's start time; and3.24 (3) the refund policy of the ticket reseller or online ticket marketplace.3.25 A ticket reseller or online ticket marketplace must require a purchaser to confirm having3.26 read the disclosures required by this paragraph before completing a transaction.3.27 (d) (e) A ticket reseller or online ticket marketplace must provide to the purchaser proof3.28 of purchase, which must include all event and ticket information, within 24 hours of the3.29 purchase, including:3.30 (1) that the purchaser is responsible for checking with the place of entertainment for3.31 information on changes to the event or cancellations prior to the event's start time; and3.32 (2) the refund policy of the ticket reseller or online ticket marketplace.Sec. 2. 303/10/26 REVISOR RSI/NS 26-078534.1 (e) (f) An online ticket marketplace must not use any combination of text, images,4.2 trademark, copyright, web designs, or Internet addresses that is identical or substantially4.3 similar to text, images, trademark, copyright, web designs, or Internet addresses associated4.4 with a place of entertainment without the written permission of the place of entertainment4.5 duly authorized to provide the permission. This paragraph does not prohibit an online ticket4.6 marketplace from using text containing the name of a place of entertainment or of an event4.7 in order to describe the location of the event or the event itself. This paragraph does not4.8 prohibit an online ticket marketplace from providing information or images identifying the4.9 specific seat or area the purchaser will occupy in the place of entertainment.4.10 (f) (g) The obligations of paragraphs (a) to (d) (e) do not apply to any person, unless the4.11 person engaged in annual aggregate transactions that were equal to or greater than $5,000.4.12 Sec. 3. Minnesota Statutes 2024, section 325F.676, is amended by adding a subdivision4.13 to read:4.14 Subd. 3a. Price limitation; exception. (a) A ticket reseller or online ticket marketplace4.15 is prohibited from reselling a ticket for more than 115 percent of the ticket's original purchase4.16 price, inclusive of all fees and surcharges.4.17 (b) Paragraph (a) does not apply to a:4.18 (1) professional or collegiate sporting event; or4.19 (2) Broadway show or Broadway touring engagement.4.20 Sec. 4. Minnesota Statutes 2024, section 325F.676, is amended by adding a subdivision4.21 to read:4.22 Subd. 6. Private right of action. (a) A person injured by a violation of this section has4.23 a private right of action. The court must award:4.24 (1) actual, incidental, and consequential damages;4.25 (2) statutory damages of not less than $500 per violation;4.26 (3) costs, disbursements, and reasonable attorney fees; and4.27 (4) injunctive relief.4.28 (b) Remedies under this subdivision are cumulative and do not limit remedies available4.29 under other law.Sec. 4. 403/10/26 REVISOR RSI/NS 26-078535.1 Sec. 5. REPORT.5.2 By January 15, 2028, the commissioner of commerce, in consultation with the attorney5.3 general, must submit a report to the chairs and ranking minority members of the legislative5.4 committees with jurisdiction over consumer protection summarizing enforcement activity5.5 under Minnesota Statutes, section 325F.676. The report must be prepared using existing5.6 resources.Sec. 5. 5
