No. 418703/12/2026 Authored by Hollins and BergThe bill was read for the first time and referred to the Committee on Judiciary Finance and Civil Law1.1A bill for an act1.2relating to civil law; modifying the terms of a delegation of parental authority;1.3amending Minnesota Statutes 2024, section 524.5-211.1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:1.5Section 1. Minnesota Statutes 2024, section 524.5-211, is amended to read:1.6524.5-211 DELEGATION OF POWER BY PARENT OR GUARDIAN.1.7(a) A parent, legal custodian, or nonprofessional guardian of a minor or incapacitated1.8person, by a properly executed power of attorney, may delegate to another person, for a1.9period not exceeding one year three years, any powers regarding care, custody, or property1.10of the minor or person subject to guardianship, except the power to consent to marriage or1.11adoption of a minor person subject to guardianship.1.12(b) A professional guardian of a minor or incapacitated person, by a properly executed1.13power of attorney, may delegate to another person, for a period not exceeding 30 days, any1.14powers regarding care, custody, or property of the minor or person subject to guardianship,1.15except the power to consent to marriage or adoption of a minor person subject to1.16guardianship. A professional guardian delegating parental rights under this paragraph must1.17submit the power of attorney to the court.1.18(c) A parent who executes a delegation of powers under this section must mail or give1.19a copy of the document to any other parent within 30 days of its execution unless:1.20(1) the other parent does not have parenting time or has supervised parenting time; orSection 1. 102/18/26 REVISOR TW/CG 26-071242.1 (2) there is an existing order for protection under chapter 518B or a similar law of another2.2 state in effect against the other parent to protect the parent, legal custodian, or guardian2.3 executing the delegation of powers or the child.2.4 (d) A parent, legal custodian, or guardian of a minor child may also delegate those powers2.5 by designating a standby or temporary custodian under chapter 257B.2.6 EFFECTIVE DATE. This section is effective the day following final enactment and2.7 applies to a delegation of power signed before, on, or after that date.Section 1. 2
