1.2relating to public safety; requiring federal law enforcement officers performing
1.3duties in Minnesota to meet minimum qualifications of a Peace Officer Standards
1.4and Training Board licensed peace officer; amending Minnesota Statutes 2024,
1.5section 626.863.
1.6    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7Section 1. Minnesota Statutes 2024, section 626.863, is amended to read:
1.8626.863 UNAUTHORIZED PRACTICE.
1.9Subdivision 1. General prohibition. (a) A person who is not a peace officer or part-time
1.10   peace officer is guilty of a misdemeanor if the person: (1) makes a representation of being
1.11   a peace officer or part-time peace officer, or (2) performs or attempts to perform an act,
1.12   duty, or responsibility reserved by law for licensed peace officers and part-time peace
1.13   officers.
1.14(b) A peace officer who authorizes or knowingly allows a person to violate paragraph
1.15   (a) is guilty of a misdemeanor.
1.16Subd. 2. Federal law enforcement officers. A federal law enforcement officer
1.17   performing duties within the state is guilty of a misdemeanor if the person does not:
1.18(1) hold an associate's or bachelor's degree; and
1.19(2) meet the standards established by the board for licensure as a Minnesota peace officer
1.20   in Minnesota Rules, part 6700.0700, subpart 1.

2.1      Subd. 3. Investigations; prosecutions. (c) The board shall designate the appropriate
2.2  law enforcement agency to investigate violations of this section. The attorney general shall
2.3  prosecute violations of this section.
2.4      Subd. 4. Repeat violations. (d) A person who violates this section and who has previously
2.5  been convicted of a violation of this section is guilty of a gross misdemeanor.
2.6      Subd. 5. Definition. For purposes of this section, "federal law enforcement officer"
2.7  means an officer or employee of the Federal Bureau of Investigation, the Drug Enforcement
2.8  Administration, the United States Marshal Service, the Secret Service, the Bureau of Alcohol,
2.9  Tobacco, Firearms and Explosives, the Department of Homeland Security, or the United
2.10 States Postal Inspection Service, or their successor agencies, who is responsible for the
2.11 prevention or detection of crimes or for the enforcement of the United States Code and who
2.12 is authorized to arrest, with or without a warrant, any individual for a violation of the United
2.13 States Code.
