1.2relating to public safety; requiring the Bureau of Criminal Apprehension to perform
1.3background checks at the request of the Office of the Legislative Auditor; amending
1.4Minnesota Statutes 2025 Supplement, section 299C.76, subdivision 1.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6Section 1. Minnesota Statutes 2025 Supplement, section 299C.76, subdivision 1, is amended
1.7to read:
1.8Subdivision 1. Definitions. (a) For the purposes of this section, the following definitions
1.9apply.
1.10(b) "Federal tax information" means federal tax returns and return information or
1.11information derived or created from federal tax returns, in possession of or control by the
1.12requesting agency, that is covered by the safeguarding provisions of section 6103(p)(4) of
1.13the Internal Revenue Code.
1.14(c) "IRS Publication 1075" means Internal Revenue Service Publication 1075 that
1.15provides guidance and requirements for the protection and confidentiality of federal tax
1.16information as required in section 6103(p)(4) of the Internal Revenue Code.
1.17(d) "National criminal history record information" means the Federal Bureau of
1.18Investigation identification records as defined in Code of Federal Regulations, title 28,
1.19section 20.3(d).
1.20(e) "Requesting agency" means the Department of Revenue; Department of Employment
1.21and Economic Development; Department of Human Services; Department of Children,

2.1 Youth, and Families; board of directors of MNsure; Department of Information Technology
2.2 Services; attorney general; Office of the Legislative Auditor; and counties.
