a4763/introduced.txtASSEMBLY, No. 4763STATE OF NEW JERSEY222nd LEGISLATURE�INTRODUCED MARCH 19, 2026Sponsored by:Assemblyman� JOHN DIMAIODistrict 23 (Hunterdon, Somerset and Warren)Co-Sponsored by:Assemblyman ScharfenbergerSYNOPSIS���� Requires DCA to calculate affordable housingobligations on Statewide growth-share calculation method.CURRENT VERSION OF TEXT���� As introduced.��An Act requiring calculationof affordable housing obligations on a Statewide basis, supplementing P.L.1985,c.222 (C.52:27D-301 et al.), and repealing sections 6 and 7 of P.L.2024, c.2(C.52:27D-304.2 and 52:27D-304.3).���� Be ItEnacted by the Senate and General Assembly ofthe State of New Jersey:���� 1.��� a.� Statewide determinationof present and prospective fair share of the housing need in the Statewideregion shall be computed for a 10-year period based on a growth-sharecalculation method determined by the growth of residential and non-residentialdevelopment in the State.� The State shall consist of one single housing regionfor the purposes of determining regional need for low- and moderate-incomehousing.���� b.� The growth sharecalculation method utilized pursuant to subsection a. of this section shallinclude foreclosed and abandoned property, exclude new housing starts duringany administrative rules gap period or during prior round rules adopted by theCouncil on Affordable Housing or the Department of Community Affairs, and shallnot exceed five percent of the Statewide housing stock existing when thisfigure is calculated.���� 2.��� The Commissioner ofCommunity Affairs shall adopt rules and regulations necessary, pursuant to the"Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.),to effectuate the purposes of P.L.��� , c.��� (C.������� ) (pending before theLegislature as this bill), including, but not limited to, rules and regulationsto adjust the timeline established pursuant to subsection f. of section 3 ofP.L.2024, c.2 (C.52:27D-304.1), to ensure that the provisions of P.L.��� ,c.��� (C.������� ) (pending before the Legislature as this bill) areimplemented as promptly as possible.���� 3.��� The following sectionsare repealed:���� Section 6 of P.L.2024, c.2(C.52:27D-304.2); and���� Section 7 of P.L.2024, c.2(C.52:27D-304.3).���� 4.��� This act shall takeeffect immediately.STATEMENT���� This bill establishes thegrowth share calculation method to be used for the calculation of Statewidepresent and prospective fair share of housing need in the Statewide region.�The bill replaces certain calculation methods that were enacted pursuant toP.L.2024, c.2 (C.52:27D-304.1 et al.) with a growth share calculation method.�The bill requires the State to consist of one single housing region for thepurposes of determining regional need for low- and moderate-income housing.���� The bill directs the Commissionerof Community Affairs to adopt the rules and regulations necessary to effectuatethe purposes of the bill, including rules and regulations to adjust theexisting deadlines required by the "Fair Housing Act," P.L.1985,c.222 (C.52:27D-301 et al.), to ensure that the provisions of the bill areimplemented as promptly as possible.���� The bill repeals sections 6and 7 of P.L.2024, c.2 (C.52:27D-304.2 and 52:27D-304.3), concerning municipalpresent need and present and projected fair share housing obligations.� Thebill would take effect immediately.
