1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6Section 1. Minnesota Statutes 2024, section 142B.65, subdivision 7, is amended to read:
1.7Subd. 7. Abusive head trauma training. (a) Before caring for children under school
1.8age, the director, staff persons, substitutes, and unsupervised volunteers must receive training
1.9on the risk of abusive head trauma during orientation and each calendar year thereafter.
1.10(b) Abusive head trauma training under this subdivision must be at least one-half hour
1.11in length. At a minimum, the training must address the risk factors related to shaking infants
1.12and young children, means to reduce the risk of abusive head trauma in child care, and
1.13license holder communication with parents regarding reducing the risk of abusive head
1.14trauma. The training must be interactive and must not consist only of reading or viewing
1.15information.
1.16(c) Except if completed during orientation, training taken under this subdivision may
1.17be used to meet the in-service training requirements under subdivision 9.
1.18(d) The commissioner shall make available for viewing a video presentation on the
1.19dangers associated with shaking infants and young children, which may be used in
1.20conjunction with the annual training required under paragraph (b).
1.21EFFECTIVE DATE. This section is effective January 1, 2027.

2.1    Sec. 2. Minnesota Statutes 2024, section 142B.70, subdivision 6, is amended to read:
2.2      Subd. 6. Sudden unexpected infant death and abusive head trauma training. (a)
2.3  License holders must ensure and document that before the license holder, second adult
2.4  caregivers, substitutes, and helpers assist in the care of infants, they are instructed on the
2.5  standards in section 142B.46 and receive training on reducing the risk of sudden unexpected
2.6  infant death. In addition, license holders must ensure and document that before the license
2.7  holder, second adult caregivers, substitutes, and helpers assist in the care of infants and
2.8  children under school age, they receive training on reducing the risk of abusive head trauma
2.9  from shaking infants and young children. The training in this subdivision may be provided
2.10 as initial training under subdivision 1 or ongoing annual training under subdivision 8.
2.11     (b) Sudden unexpected infant death reduction training required under this subdivision
2.12 must, at a minimum, address the risk factors related to sudden unexpected infant death,
2.13 means of reducing the risk of sudden unexpected infant death in child care, and license
2.14 holder communication with parents regarding reducing the risk of sudden unexpected infant
2.15 death.
2.16     (c) Abusive head trauma training required under this subdivision must, at a minimum,
2.17 address the risk factors related to shaking infants and young children, means of reducing
2.18 the risk of abusive head trauma in child care, and license holder communication with parents
2.19 regarding reducing the risk of abusive head trauma. The training must be interactive and
2.20 must not consist only of reading or viewing information.
2.21     (d) Training for family and group family child care providers must be developed by the
2.22 commissioner in conjunction with the Minnesota Sudden Infant Death Center and approved
2.23 by the Minnesota Center for Professional Development. Sudden unexpected infant death
2.24 reduction training and abusive head trauma training may be provided in a single course of
2.25 no more than two hours in length.
2.26     (e) Sudden unexpected infant death reduction training and abusive head trauma training
2.27 required under this subdivision must be completed in person or as allowed under subdivision
2.28 11, clause (1) or (2), at least once every two years. On the years when the individual receiving
2.29 training is not receiving training in person or as allowed under subdivision 11, clause (1)
2.30 or (2), the individual receiving training in accordance with this subdivision must receive
2.31 sudden unexpected infant death reduction training and abusive head trauma training through
2.32 a video of no more than one hour in length. The video must be developed or approved by
2.33 the commissioner or online each calendar year.

3.1      (f) An individual who is related to the license holder as defined in section 142B.01,
3.2  subdivision 15, and who is involved only in the care of the license holder's own infant or
3.3  child under school age and who is not designated to be a second adult caregiver, helper, or
3.4  substitute for the licensed program, is exempt from the sudden unexpected infant death and
3.5  abusive head trauma training.
3.6      EFFECTIVE DATE. This section is effective January 1, 2027.
3.7    Sec. 3. Minnesota Statutes 2024, section 142C.12, subdivision 3, is amended to read:
3.8      Subd. 3. Abusive head trauma. A certified center that cares for a child under school
3.9  age must ensure that the director and all staff persons, including substitutes and unsupervised
3.10 volunteers, receive training on abusive head trauma before assisting in the care of a child
3.11 under school age. The training must be interactive and must not consist only of reading or
3.12 viewing information.
3.13     EFFECTIVE DATE. This section is effective January 1, 2027.
