hb5749/introduced.txtHOUSE BILL NO. 5749A bill to amend 1990 PA 319, entitled"An act to prohibit local units of government fromimposing certain restrictions on the ownership, registration, purchase, sale,transfer, transportation, or possession of pistols, other firearms, orpneumatic guns, ammunition for pistols or other firearms, or components ofpistols or other firearms,"by amending section 3 (MCL 123.1103), as amended by2015 PA 29.the people of the state of michigan enact:Sec. 3. (1) Thisact does not prohibit a local unit of government from doing any of thefollowing:(a) Prohibiting orregulating conduct with a pistol, other firearm, or pneumatic gun that is acriminal offense under state law.(b) Prohibiting orregulating the transportation, carrying, or possession of pistols, otherfirearms, or pneumatic guns by employees of that local unit of government inthe course of their employment with thatlocal unit of government.(c) Regulating thepossession of pneumatic guns within in the local unit of government by requiring that anindividual below the age of 16 who is less than 16 years of age who is in possessionof a pneumatic gun be under the supervision of a parent, a guardian, or anindividual 18 years of age or older, except that an ordinance shall notregulate possession of a pneumatic gun on or withinin private property if the individual below the age of 16 whois less than 16 years of age is authorized by a parent or guardian andthe property owner or legal possessor to possess the pneumatic gun.(d) Prohibiting anindividual from pointing, waving about, or displaying a pneumatic gun in athreatening manner with the intent to induce fear in another individual.(e) Except as otherwise provided in subsection (2), prohibiting the opencarry of firearms inside a government building owned or leased by the localunit of government.(2) A local unit of government shall not prohibit the open carry offirearms by a law enforcement officer.
