Minnesota Statutes 2024, section 363A.08, is amended by adding a subdivision1.6to read:1.7Subd. 9. Use of artificial intelligence. (a) "Artificial intelligence" as used in this1.8subdivision means a machine-based system that, for explicit or implicit objectives, infers,1.9from the input it receives, how to generate outputs such as predictions, content,1.10recommendations, and decisions that can influence physical or virtual environments.1.11(b) It is an unfair employment practice, with respect to recruitment, hiring, promotion,1.12renewal of employment, selection for training or apprenticeship, discharge, discipline,1.13tenure, or the terms, privileges, or conditions of employment, for an employer to:1.14(1) use artificial intelligence that has the effect of subjecting an employee or applicant1.15for employment to discrimination because of race, color, creed, religion, national origin,1.16sex, gender identity, marital status, status with regard to public assistance, familial status,1.17membership or activity in a local commission, disability, sexual orientation, or age; or1.18(2) fail to provide notice to an employee or applicant for employment that the employer1.19is using artificial intelligence for the purposes described in clause (1).Section 1. 1
