sf2473/introduced.txtSenateFile2473-IntroducedSENATEFILE2473BYCOMMITTEEONAPPROPRIATIONS(SUCCESSORTOSF2141)(SUCCESSORTOSSB3028)ABILLFORAnActrelatingtomattersunderthepurviewofthe1departmentofmanagement,andincludingeffectivedateand2applicabilityprovisions.3BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:4TLSB5269SZ(1)91sc/nsS.F.2473Section1.Section8.57C,subsections2,3,and4,Code12026,areamendedtoreadasfollows:22.Moneysinthefundinafiscalyearshallbeusedas3appropriatedbythegeneralassemblyfortheacquisition4ofcomputerhardwareandsoftware,softwaredevelopment,5telecommunicationsequipment,andmaintenanceandlease6agreementsassociatedwithtechnologycomponentsandforthe7purchaseofequipmentintendedtoprovideanuninterruptible8powersupplytothedepartmentofmanagementtoprovide9astablefundingsourceforimplementationcostsofstate10informationtechnologyprojectsthatenhancethestate’s11technologyinfrastructure,improvegovernmentservices,12andpromoteinnovationandeconomicdevelopment,including13butnotlimitedtonewinformationtechnologyprojects14andinfrastructurereplacementeffortsofadepartmentor15establishment,whileprotectingtheprivacyofresidentsof16thisstate.173.a.Thereisappropriatedfromthegeneralfundofthe18statetothetechnologyreinvestmentfundforthefiscalyear19beginningJuly1,2026,andforeachfiscalyearthereafter,20thesumofseventeenmillionfivehundredthousanddollars.21b.ThereisappropriatedfromtherebuildIowa22infrastructurefundforthefiscalyearbeginningJuly1,2025,23andendingJune30,2026,thesumofeighteenmilliontwo24hundredsixty-ninethousandtwohundredseventeendollarsto25thetechnologyreinvestmentfund,notwithstandingsection8.57,26subsection3,paragraph“c”.273.a.Thedepartmentofmanagementshallprioritize28proposedprojectsbasedonallofthefollowingconsiderations:29(1)Whethertheprojectalignswiththestate’sstrategic30priorities.31(2)Whethertheprojectpromotesorintroducesnew32technologyorsignificantlyimprovesanexistingsystem.33(3)Whethertheprojectisfeasibleandwhetherthe34departmentorestablishmenthasestablishedreadinessforthe35-1-LSB5269SZ(1)91sc/ns1/15S.F.2473projecttoproceed,includingaclearassessmentoftimelines,1budgets,andmeasurableoutcomes.2(4)Whethertheprojectincludesaclearchangemanagement3strategytosupportuseradoptionandalignswithlean4enterpriseprinciplestomaximizevalue,minimizewaste,and5ensurecontinuousimprovement.6(5)Whethertheprojectprovidesapositivereturnon7investment,consideringbothfinancialreturnsandnonfinancial8benefitssuchasimprovedpublicsafety,education,orhealth9care.10(6)Whethertheprojectresultsininfrastructurethatis11scalableacrossthestateenterprise.12(7)Whetherthedepartmentorestablishmenthasidentified13howthecompletedprojectwillbesustainedbeyondtheinitial14fundingperiod.15(8)Whethertheprojectimprovesaccesstogovernmental16services,particularlyinruralcommunities.17(9)Whethertheprojectinvolvesaninfrastructureproject18asopposedtomaintenanceorstandardupgradesofexisting19technology.20b.Thedepartmentofmanagementshallprovideaprioritized21listofproposedprojectsforfundingtothegovernor,who22shallusethelistindevelopingabudgetaryrecommendation23forthegeneralassemblypursuanttosection8.21forthe24fiscalyearbeginningJuly1,2027,andforeachfiscalyear25thereafter.26c.Notwithstandingsection8.33,moneysinthetechnology27reinvestmentfundthatremainunencumberedorunobligatedat28thecloseofafiscalyearshallnotrevertbutshallremain29availableforexpenditureforthepurposesdesignateduntil30thecloseofthefiscalyearthatendstwoyearsafterthe31endofthefiscalyearforwhichtheappropriationwasmade.32Notwithstandingsection12C.7,subsection2,interestor33earningsonmoneysinthefundshallbecreditedtothefund.344.Annually,onOnorbeforeJanuary15ofeachyear,a35-2-LSB5269SZ(1)91sc/ns2/15S.F.2473stateagencythatreceivedanappropriationfromthisfund1thedepartmentofmanagementshallreporttothelegislative2servicesagencyandthedepartmentofmanagementgeneral3assemblythestatusofallprojectsfundedunderthissection4thathavebeencompletedsincethepreviousreportwas5submittedorthatareinprogress.Thereportshallmust6includeadescriptionoftheproject,theprogressofwork7completed,thetotalestimatedcostoftheproject,alistof8allrevenuesourcesbeingusedtofundtheproject,theamount9offundsmoneysexpended,theamountoffundsmoneysobligated,10andthedatetheprojectwascompletedoranestimated11completiondateoftheproject,whereapplicable.12Sec.2.Section8.78,Code2026,isamendedtoreadas13follows:148.78Backgroundchecks.15Anapplicantforemploymentwiththedepartment,or16anapplicantforemploymentwithasupportedentityfora17positionasinformationtechnologystaff,maybesubjecttoa18backgroundinvestigationbythedepartment.Thebackground19investigationmayinclude,withoutlimitation,aworkhistory,20financialreview,requestforcriminalhistorydata,and21nationalcriminalhistorycheckthroughthefederalbureauof22investigation.Inaddition,acontractor,vendor,employee,or23anyotherindividualperformingworkforthedepartment,oran24individualontheinformationtechnologystaffofasupported25entity,maybesubjecttoanationalcriminalhistorycheck26throughthefederalbureauofinvestigationatleastonce27everytenfiveyears,includi dorservicetothestategovernmentalentity.28“Statedata”doesnotincludeaggregatedordeidentifieddata29collectedbythevendorandusedexclusivelyforthevendor’s30internalpurposesdirectlyrelatedtoevaluatingorimproving31systemperformance,ensuringreliability,evaluatingproduct32functionality,conductingsystemanalytics,projectingneeds33throughcapacityplanning,ensuringlicensecompliance,or34evaluatingsecurity.Statedatashallatalltimesremainthe35-6-LSB5269SZ(1)91sc/ns6/15S.F.2473soleandexclusivepropertyofthestate,andthevendorshall1usestatedataonlyasnecessarytoprovidethecontracted2servicestothestate.Uponrequest,thevendorshallprovide3thestate,atnocost,acurrentcopyofallstatedataina4commerciallyreasonableandstate-acceptabledigitalformat5thatenablesthestatetoreadilyuse,transfer,ormigrate6thestatedata.Excepttotheextentretentionofstatedata7isrequiredbylaw,thevendorshall,afterconfirmingthat8thestatehasreceivedacopyofthestatedata,permanently9deleteallstatedataupontheconclusionorterminationof10thecontract.Atalltimes,includinganypost-contract11periodinwhichstatedataisretainedduetorecordretention12obligations,thevendorshallprotectstatedatainaccordance13withcurrentstatedataprotectionpolicies.14Sec.5.NEWSECTION.8.96Contracts——limitationof15liability——prohibitedterms.16Notwithstandingsection8A.311,subsection22,andrules17adoptedpursuanttothatsubsection,thedirectormayinclude18acontractuallimitationofvendorliabilityininformation19technologygoodsandservicescontracts.Acontractual20limitationofvendorliabilitymusttakeintoconsiderationthe21publicinterestandthemitigationofrisksassociatedwiththe22useofinformationtechnologygoodsorservices.Anyportion23ofacontractuallimitationofvendorliabilitythatincludes24arepudiationofallliabilityforcybersecurityincidentsor25alimitationonthevendor’sliabilityforintentionaltorts,26criminalacts,fraudulentconduct,intentionalorwillful27misconduct,grossnegligence,death,bodilyinjury,damageto28realorpersonalproperty,intellectualpropertyviolations,29liquidateddamages,compliancewithapplicablelaws,violations30ofconfidentialinformationobligations,orcontractual31obligationsofthevendorpertainingtoindemnificationshall32bevoidasamatteroflawascontrarytopublicpolicy.A33contractuallimitofvendorliabilitythatdoesnotapply34equallytothecontractedpartiesorthatlimitsavendor’s35-7-LSB5269SZ(1)91sc/ns7/15S.F.2473liabilitytolessthanthecontractvalueinclusiveofall1possibleextensionsisvoidasamatteroflawascontraryto2publicpolicy.3Sec.6.NEWSECTION.8.97Confidentialityofcommunications4withchiefinformationsecurityofficer.5Intheinterestoffacilitatingcommunicationbetween6thechiefinformationsecurityofficerandotherentities7concerningsecurityincidentsandsecuritybreaches,allsuch8communicationsandanydocumentsgeneratedbasedinwholeorin9partonsuchcommunicationsareconfidential.Notwithstanding10chapter22oranyotherprovisionoflawtothecontrary,the11departmentshallnotreleasesuchcommunicationspursuantto12stateopenrecordslaws,andsuchcommunicationsshallnotbe13receivedintoevidence,subjecttodiscovery,orotherwise14usedinatrial,hearing,orotherproceedinginorbeforeany15court,regulatorybody,orotherauthorityofthestateora16politicalsubdivisionofthestate,unlessthecommunications17aresubjecttoaprotectiveorderthatprohibitsfurther18disclosureofsuchcommunicationsandrequiresanycourt19filingsofsuchcommunicationstobemadeunderseal.Itis20theintentofthegeneralassemblythattheseprohibitionsand21restrictionsalsoapplytofederalcourts,regulatorybodies,22andotherauthoritiesandforpurposesoffederalopenrecords23laws,totheextentallowedbyfederallawandcourtrules.24Thechiefinformationsecurityofficershallnotreleasesuch25communicationsotherthanforanyofthefollowingpurposes:261.Identifyingacybersecuritythreat,includingthesource27ofthecybersecuritythreat,orasecurityvulnerability,and28thenonlytogovernmentofficialsforpurposesofaddressing29thethreat.302.Respondingto,orotherwisepreventingormitigating,31aspecificthreatofdeath,seriousbodilyharm,orserious32economicharm.333.Respondingto,investigating,prosecuting,orotherwise34preventingormitigatingaseriousthreattoaminor,including35-8-LSB5269SZ(1)91sc/ns8/15S.F.2473sexualexploitationandthreatstophysicalsafety.14.Preventing,investigating,disrupting,orprosecutingan2offenseunderstateorfederallaw.35.Providingaconfidentialcybersecuritybriefingtothe4governororamemberofthegeneralassembly.5Sec.7.NEWSECTION.8.98Criminaljusticeinformation.61.Thedepartmentisauthorizedtomaintainanintegrated7informationsystemthatenablesautomateddatasharingamong8theexecutivebranch,judicialbranch,andlocalagencies.92.ThedepartmentisdesignatedastheIowastatistical10analysiscenterforthepurposeofcoordinatingwithdata11resourceagenciestoprovidedataandanalyticalinformation12tofederal,state,andlocalgovernments.Notwithstandingany13otherprovisionofstatelawtothecontrary,unlessprohibited14byfederallaworregulation,thedepartmentshallbegranted15access,forpurposesofresearchandevaluation,toallof16thedatalistedinthissubsection,exceptthatintelligence17dataandpeaceofficerinvestigativereportsmaintained18bythedepartmentofpublic
