 CIVIL/PROCEDURE: Extends the time delay for filing of oppositions to motions for
  summary judgment
1AN ACT
2 To amend and reenact Code of Civil Procedure Article 966(B)(introductory paragraph) and
3(C)(1)(introductory paragraph), relative to motions for summary judgment; to
4provide relative to the time delay for filing oppositions; and to provide for related
5matters.
6 Be it enacted by the Legislature of Louisiana:
7Section 1. Code of Civil Procedure Article 966(B)(introductory paragraph) and
8 (C)(1)(introductory paragraph) are hereby amended and reenacted to read as follows:
9Art. 966. Motion for summary judgment; procedure

11B. Unless extended by the court and agreed to by all of the parties, a motion
12for summary judgment shall be filed, opposed, or replied to in accordance with the
13following provisions:

Abstract: Authorizes the court to grant extensions without approval by all the parties for
  filings regarding motions for summary judgment.
Present law permits the court, with agreement by all the parties, to extend the time delay for
filings for motions for summary judgment.
Proposed law retains present law but removes language that requires the parties to agree to
an extension for a time delay regarding motions for summary judgment.

Summary of Amendments Adopted by House
   The House Floor Amendments to the engrossed bill:
   1.      Remove proposed language that changes the time delay to file an opposition to
  the motion for summary judgment.
   2.      Authorize the court to determine an extension on a time delay to file an
  opposition or other filings regarding motions for summary judgment without
  agreement from the involved parties.
   3.      Make technical changes.
