No. 474503/26/2026 Authored by FreibergThe bill was read for the first time and referred to the Committee on Public Safety Finance and Policy1.1A bill for an act1.2relating to public safety; prohibiting firearms in buildings owned by or under the1.3control of state or local governments; providing criminal penalties; amending1.4Minnesota Statutes 2024, section 609.66, by adding a subdivision.1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:1.6Section 1. Minnesota Statutes 2024, section 609.66, is amended by adding a subdivision1.7to read:1.8Subd. 1i. Felony; possession in state or local government buildings. (a) A person1.9who possesses a firearm within a building owned by the state or a local government, or1.10within a portion of a building leased or otherwise controlled by the state or a local1.11government, and used for the purpose of government administration, is guilty of a felony1.12and may be sentenced to imprisonment for not more than five years or to payment of a fine1.13of not more than $10,000, or both.1.14(b) Unless a person is otherwise prohibited or restricted by law from possessing a firearm,1.15this subdivision does not apply to:1.16(1) licensed peace officers or military personnel who are performing official duties; or1.17(2) a person who has written permission to possess a firearm within the building or space1.18from the person having general control and supervision over the building or space.1.19(c) This subdivision does not apply to locations described in subdivision 1d or 1g.1.20EFFECTIVE DATE. This section is effective August 1, 2026, and applies to crimes1.21committed on or after that date.Section 1. 1
