hb1174/chaptered.txtENROLLED2026 Regular SessionACT No. 338HOUSE BILL NO. 1174BY REPRESENTATIVES BOURRIAQUE AND CHASSION1AN ACT2 To enact R.S. 49:191(3)(b) and to repeal R.S. 49:191(1)(o), relative to the Department of3Transportation and Development, including provisions to provide for the re-creation4of the Department of Transportation and Development and the statutory entities5made a part of the department by law; to provide for the effective termination date6for all statutory authority for the existence of such statutory entities; and to provide7for related matters.8 Be it enacted by the Legislature of Louisiana:9Section 1. Pursuant to R.S. 49:193, the Department of Transportation and10 Development and the statutory entities made a part of the department by law shall be re-11 created effective June 30, 2026, and all statutory authority therefor is continued in12 accordance with the provisions of Part XII of Chapter 1 of Title 49 of the Louisiana Revised13 Statutes of 1950.14Section 2. All statutory authority for the existence of the Department of15 Transportation and Development and the statutory entities made a part of the department as16 re-created by Section 1 of this Act shall cease as of July 1, 2031, pursuant to R.S. 49:191.17 However, the Department of Transportation and Development may be re-created prior to18 such date in accordance with the provisions of Part XII of Chapter 1 of Title 49 of the19 Louisiana Revised Statutes of 1950.20Section 3. The provisions of R.S. 49:193 are hereby superseded to the extent that21 those provisions are in conflict with the provisions of this Act.22Section 4. R.S. 49:191(3)(b) is hereby enacted to read as follows:Page 1 of 2CODING: Words in struck through type are deletions from existing law; words underscoredare additions.HB NO. 1174 ENROLLED1§191. Termination of legislative authority for existence of statutory entities; phase-2out period for statutory entities; table of dates3Notwithstanding any termination dates set by any previous Act of the4legislature, the statutory entities set forth in this Section shall begin to terminate their5operations on July first of each of the following years, and all legislative authority6for the existence of any statutory entity, as defined in R.S. 49:190, shall cease as of7July first of the following year, which shall be the termination date:8* * *9(3) July 1, 2030:10* * *11(b) The Department of Transportation and Development and all statutory12entities made a part of the department by law.13* * *14Section 5. R.S. 49:191(1)(o) is hereby repealed in its entirety.15Section 6.
