13 STATE BOARD OF CHIROPRACTIC EXAMINERS - INVESTIGATIVE SERVICES FOR CONSUMER
14 COMPLAINTS. Ten thousand dollars ($10,000) of the available appropriation in
15 the Professional Fees Line item of this act shall be made available to the
16 board for the purpose of contracting an independent or private investigator
17 for investigative services regarding complaints submitted by consumers.
18 (a)(1)     The Arkansas State Board of Chiropractic Examiners shall contract
19 with an outside investigator as needed to perform investigations and conduct
20 inspections of alleged wrongdoing.
21(2)    An outside investigator contracted under subdivision (a)(1) of
22 this section shall have expertise or background in the subject matter in
23 which he or she is being contracted to investigate.
24(b)    The duties of an investigator hired under this section shall
25 include without limitation investigation and inspection of all complaints, as
26 determined by the board, to determine whether a person has:
27 (1)    Practiced his or her profession in such a way as to endanger the general
28 health and welfare of the public; or
29(2)    Otherwise violated this chapter or rules of the board.
30(c)(1)     The board shall file a report annually on or before December 1
31 with the Senate Committee on State Agencies and Governmental Affairs and the
32 House Committee on State Agencies and Governmental Affairs for the
33 committees' review.
34(2)   The report shall include:
35(A)    The number of complaints that have been filed;
36(B)    A list of who has been investigated and the purported

1 violation; and
2(C)    A summary of the findings of each investigation.
3      The provisions of this section shall be in effect only from July 1,
4 2025 2026 through June 30, 2026 2027.

6      SECTION 51. SPECIAL LANGUAGE.        NOT TO BE INCORPORATED INTO THE ARKANSAS
7 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ARKANSAS
8 STATE BOARD OF DENTAL EXAMINERS - EDUCATIONAL PROGRAMS. The Arkansas State
9 Board of Dental Examiners is hereby authorized to expend from monies
10 authorized herein, $15 from each licensed dentist licensed by the State Board
11 of Dental Examiners each year to be paid by the Arkansas State Board of
12 Dental Examiners to 501(c)(3) Arkansas foundations that have healthcare
13 professionals on their board and provide for identification, treatment and
14 monitoring of healthcare professionals who suffer from alcohol or drug abuse
15 problems, in order to promote the public health and safety and to insure the
16 continued availability of skilled and highly trained dental professionals for
17 the benefit of the public.
18   The provisions of this section shall be in effect only from July 1, 2025
19 2026 through June 30, 2026 2027.

21      SECTION 52. SPECIAL LANGUAGE.        NOT TO BE INCORPORATED INTO THE ARKANSAS
22 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ARKANSAS
23 STATE MEDICAL BOARD - EDUCATIONAL PROGRAMS. The State Medical Board is hereby
24 authorized to expend from monies authorized herein, $30 from each licensed
25 physician licensed by the State Medical Board each year to be paid by the
26 State Medical Board to 501(c)(3) Arkansas foundations that have healthcare
27 professionals on their board and provide for identification, treatment and
28 monitoring of healthcare professionals who suffer from alcohol or drug abuse
29 problems, in order to promote the public health and safety and to insure the
30 continued availability of skilled and highly trained medical professionals
31 for the benefit of the public.
32   The provisions of this section shall be in effect only from July 1, 2025

1 STATE BOARD OF NURSING - FUNDING TRANSFER.        The Arkansas State Board of
2 Nursing may request a fund transfer in an amount not to exceed one hundred
3 thousand dollars ($100,000) each fiscal year from the State Board of Nursing
4 Fund to the cash in State Treasury fund as determined by the Chief Fiscal
5 Officer of the State to provide funds for the Student Loan Program
6 appropriation provided herein.      Upon approval of the Chief Fiscal Officer of
7 the State, the amount requested shall be transferred on his or her books and
8 those of the State Treasurer and the Auditor of State.
9      The provisions of this section shall be in effect only from July 30,
10 2025 2026 through June 30, 2026 2027.

12      SECTION 54. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS
13 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ARKANSAS
14 BOARD OF PODIATRIC MEDICINE - EDUCATIONAL PROGRAMS. The Arkansas Board of
15 Podiatric Medicine is hereby authorized to expend from monies authorized
16 herein, $10 from each licensed podiatrist licensed by the Arkansas Board of
17 Podiatric Medicine each year to be paid by the Arkansas Board of Podiatric
18 Medicine to 501(c)(3) Arkansas foundations that have healthcare professionals
19 on their board and provide for identification, treatment and monitoring of
20 healthcare professionals who suffer from alcohol or drug abuse problems, in
21 order to promote the public health and safety and to insure the continued
22 availability of skilled and highly trained podiatric professionals for the
23 benefit of the public.
24   The provisions of this section shall be in effect only from July 1, 2025
25 2026 through June 30, 2026 2027.

27      SECTION 55. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS
28 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
29 ARKANSAS SPINAL CORD COMMISSION - LINE ITEM TRANSFER. Any savings made in the
30 State Appropriation may, after receiving advice and approval of the
31 Department of Finance and Administration, be transferred to the Spinal
32 Treatment Program.
33   The provisions of this section shall be in effect only from July 1, 2025
34 2026 through June 30, 2026 2027.

2 OF FUNDS. Immediately upon the effective date of this act, the Arkansas State
3 Medical Board shall transfer annually the sum of five hundred thousand
4 dollars ($500,000), or so much as is available, from the unobligated and
5 unallocated monies remaining in the Arkansas State Medical Board's cash
6 funds, to the Department of Education - Division of Higher Education's
7 Graduate Medical Education Fund to be used exclusively for the Graduate
8 Medical Education Residency Expansion Board appropriation.

10SECTION 57.   SPECIAL LANGUAGE - CODE AMENDMENT.   Arkansas Code § 17-95-
11 403(b)(3)(A)(iii)(c), concerning the qualifications for a license to practice
12 medicine in this state, is amended to read as follows:
13(c)   If he or she has been offered full-time
14 employment as a physician from a healthcare provider that operates in a
15 medically underserved population or a federally designated area that is a
16 medically underserved area, medically partially underserved area, or a
17 primary care health professional shortage area in this state, he or she
18 shall:
19(1)   Hold an active, unencumbered license
20 to practice medicine in a foreign country;
21(2)   Have actively practiced medicine
22 during the four-year period preceding the date of an application under this
23 section;
24(3)   Have the Educational Commission for
25 Foreign Medical Graduates evaluate his or her medical credentials;
26(4)   Hold an active, valid certificate
27 issued by the Educational Commission for Foreign Medical Graduates; and
28(5)   Pass the examination used by the
29 Educational Commission for Foreign Medical Graduates.

31SECTION 58. COMPLIANCE WITH OTHER LAWS.    Disbursement of funds
32 authorized by this act shall be limited to the appropriation for such agency
33 and funds made available by law for the support of such appropriations; and
34 the restrictions of the State Procurement Law, the General Accounting and
35 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
36 Procedures and Restrictions Act, or their successors, and other fiscal

1 control laws of this State, where applicable, and regulations promulgated by
2 the Department of Finance and Administration, as authorized by law, shall be
3 strictly complied with in disbursement of said funds.

5      SECTION 59. LEGISLATIVE INTENT.      It is the intent of the General
6 Assembly that any funds disbursed under the authority of the appropriations
7 contained in this act shall be in compliance with the stated reasons for
8 which this act was adopted, as evidenced by the Agency Requests, Executive
9 Recommendations and Legislative Recommendations contained in the budget
10 manuals prepared by the Department of Finance and Administration, letters, or
11 summarized oral testimony in the official minutes of the Arkansas Legislative
12 Council or Joint Budget Committee which relate to its passage and adoption.

14      SECTION 60. EMERGENCY CLAUSE.       It is found and determined by the
15 General Assembly, that the Constitution of the State of Arkansas prohibits
16 the appropriation of funds for more than a one (1) year period; that the
17 effectiveness of this Act on July 1, 2026 is essential to the operation of
18 the agency for which the appropriations in this Act are provided, and that in
19 the event of an extension of the legislative session, the delay in the
20 effective date of this Act beyond July 1, 2026 could work irreparable harm
21 upon the proper administration and provision of essential governmental
22 programs. Therefore, an emergency is hereby declared to exist and this Act
23 being necessary for the immediate preservation of the public peace, health
24 and safety shall be in full force and effect from and after July 1, 2026.
