2  RELATING TO THE APPROPRIATION TO THE PUBLIC SCHOOLS EDUCATIONAL SUPPORT PRO-
3      GRAM'S DIVISION OF THE IDAHO DIGITAL LEARNING ACADEMY; AMENDING SECTION
4      22 OF SENATE BILL NO. 1362, IF ENACTED BY THE SECOND REGULAR SESSION OF
5      THE SIXTY-EIGHTH IDAHO LEGISLATURE TO REVISE PROVISIONS REGARDING THE
6      IDAHO DIGITAL LEARNING ACADEMY; AND DECLARING AN EMERGENCY AND PROVID-
7      ING AN EFFECTIVE DATE.
8  Be It Enacted by the Legislature of the State of Idaho:
9      SECTION 1. That Section 22 of House Bill No. 1362, if enacted by the
10 Second Regular Session of the Sixty-eighth Idaho Legislature, be, and the
11 same is hereby amended to read as follows:
12SECTION 22. IDAHO DIGITAL LEARNING ACADEMY. The Idaho Digital
13     Learning Academy (IDLA), created pursuant to Chapter 55, Title 33,
14     Idaho Code, shall utilize state-appropriated funds for the period
15     July 1, 2026, through June 30, 2027, to achieve the following:
16(1) Tuition charged by IDLA to Idaho school districts and ch-
17     arter schools shall not exceed $40.00 per enrollment.
18(2) (1) Provide remedial coursework for students failing to
19     achieve proficiency in one or more areas of Idaho's standards-based
20     tests.
21(3) (2) Pursuant to State Board of Education rule, IDAPA
22     08.02.03, provide advanced opportunities, including access to dual
23     credit courses, for students.
24The preceding list shall not be construed as excluding other
25     instruction and training that may be provided by the IDLA.
26     SECTION 2. An emergency existing therefor, which emergency is hereby
27 declared to exist, this act shall be in full force and effect on and after
28 July 1, 2026.
