SPECIAL LANGUAGE. The State Military Department is hereby authorized to2 transfer appropriation from Operating Expenses to Promotional Items in the3 General Operations Appropriation and/or Cash Operations Appropriation4 provided by this Act in an amount not to exceed ten thousand dollars5 ($10,000) each fiscal year, as authorized by the Director of State Resources,6 and with the approval of the Chief Fiscal Officer of the State.7 The provisions of this section shall be in effect only from July 1, 20258 2026 through June 30, 2026 2027.910 SECTION 14. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS11 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.12 CARRY FORWARD OF FUNDS.13 (a) The Chief Fiscal Officer of the State shall cause to be transferred14 on his or her books and those of the State Treasurer and Auditor of State the15 balance of funds remaining in the Department of Military Fund Account on June16 30, 2026 2027 into a sub-fund created within the Department of Military Fund17 to be used exclusively for construction, maintenance and operating expenses18 or for future construction projects of the State Military Department.19 (b) Any carry forward of unexpended balance of funding as authorized20 herein, may be carried forward under the following conditions:21(1) The Office of Budget of the Department of Finance and22 Administration shall report to the Legislative Council all amounts carried23 forward by the September meeting of the Legislative Council or the Joint24 Budget Committee meeting which report shall include the name of the agency,25 board, commission, or institution and the amount of funding carried forward,26 the program name or line item and the funding source; and27(2) The State Military Department shall provide a written report28 to the Legislative Council or Joint Budget Committee containing all29 information set forth in subdivision (b)(1) of this section no later than30 thirty (30) days prior to the time the Department presents its budget request31 to the Legislative Council or Joint Budget Committee, or both; and32(3) Thereupon, the Department of Finance and Administration shall33 include all information obtained in subdivision (b)(2) of this section in the34 budget manuals.35 The provisions of this section shall be in effect only from July36 1, 2025 2026 through June 30, 2026 2027.904-15-2026 14:52:07 BSS036As Engrossed: H4/15/26 HB107812 SECTION 15. COMPLIANCE WITH OTHER LAWS. Disbursement of funds3 authorized by this act shall be limited to the appropriation for such agency4 and funds made available by law for the support of such appropriations; and5 the restrictions of the State Procurement Law, the General Accounting and6 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary7 Procedures and Restrictions Act, or their successors, and other fiscal8 control laws of this State, where applicable, and regulations promulgated by9 the Department of Finance and Administration, as authorized by law, shall be10 strictly complied with in disbursement of said funds.1112 SECTION 16. LEGISLATIVE INTENT. It is the intent of the General13 Assembly that any funds disbursed under the authority of the appropriations14 contained in this act shall be in compliance with the stated reasons for15 which this act was adopted, as evidenced by the Agency Requests, Executive16 Recommendations and Legislative Recommendations contained in the budget17 manuals prepared by the Department of Finance and Administration, letters, or18 summarized oral testimony in the official minutes of the Arkansas Legislative19 Council or Joint Budget Committee which relate to its passage and adoption.2021 SECTION 17. EMERGENCY CLAUSE. It is found and determined by the22 General Assembly, that the Constitution of the State of Arkansas prohibits23 the appropriation of funds for more than a one (1) year period; that the24 effectiveness of this Act on July 1, 2026 is essential to the operation of25 the agency for which the appropriations in this Act are provided, and that in26 the event of an extension of the legislative session, the delay in the27 effective date of this Act beyond July 1, 2026 could work irreparable harm28 upon the proper administration and provision of essential governmental29 programs.
