21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23SECTION 1. REGULAR SALARIES - OPERATIONS.  There is hereby established
24 for the Department of the Military for the 2026-2027 fiscal year, the
25 following maximum number of regular employees.

16SECTION 2. EXTRA HELP.    There is hereby authorized, for the Department
17 of the Military for the 2026-2027 fiscal year, the following maximum number
18 of part-time or temporary employees, to be known as "Extra Help", payable
19 from funds appropriated herein for such purposes: one hundred twenty-seven
20 (127) temporary or part-time employees, when needed, at rates of pay not to
21 exceed those provided in the Uniform Classification and Compensation Act, or
22 its successor, or this act for the appropriate classification.

22SECTION 12. SPECIAL LANGUAGE.      NOT TO BE INCORPORATED INTO THE
23 ARKANSAS CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
24 GENERALS SALARY. The line item maximums for the State of Arkansas Adjutant
25 General and Deputy Adjutant General are based on the salary grid by the
26 United States Department of Defense. Incumbents in these positions shall be
27 compensated in accordance with the Department of Defense Advisory Service Pay
28 Plan and are not guaranteed placement at the maximum level.        The line item
29 maximum salaries may be adjusted on July 1 of each fiscal year to incorporate
30 salary rate changes that have been implemented by the U.S. Department of
31 Defense.
32    The provisions of this section shall be in effect only from July 1, 2025
33 2026 through June 30, 2026 2027.

35SECTION 13. SPECIAL LANGUAGE.       NOT TO BE INCORPORATED INTO THE ARKANSAS
36 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.

1 PROMOTIONAL ITEMS.     The State Military Department is hereby authorized to
2 transfer appropriation from Operating Expenses to Promotional Items in the
3 General Operations Appropriation and/or Cash Operations Appropriation
4 provided by this Act in an amount not to exceed ten thousand dollars
5 ($10,000) each fiscal year, as authorized by the Director of State Resources,
6 and with the approval of the Chief Fiscal Officer of the State.
7   The provisions of this section shall be in effect only from July 1, 2025
8 2026 through June 30, 2026 2027.

10      SECTION 14. SPECIAL LANGUAGE.        NOT TO BE INCORPORATED INTO THE ARKANSAS
11 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
12 CARRY FORWARD OF FUNDS.
13      (a) The Chief Fiscal Officer of the State shall cause to be transferred
14 on his or her books and those of the State Treasurer and Auditor of State the
15 balance of funds remaining in the Department of Military Fund Account on June
16 30, 2026 2027 into a sub-fund created within the Department of Military Fund
17 to be used exclusively for construction, maintenance and operating expenses
18 or for future construction projects of the State Military Department.
19      (b) Any carry forward of unexpended balance of funding as authorized
20 herein, may be carried forward under the following conditions:
21(1) The Office of Budget of the Department of Finance and
22 Administration shall report to the Legislative Council all amounts carried
23 forward by the September meeting of the Legislative Council or the Joint
24 Budget Committee meeting which report shall include the name of the agency,
25 board, commission, or institution and the amount of funding carried forward,
26 the program name or line item and the funding source; and
27(2) The State Military Department shall provide a written report
28 to the Legislative Council or Joint Budget Committee containing all
29 information set forth in subdivision (b)(1) of this section no later than
30 thirty (30) days prior to the time the Department presents its budget request
31 to the Legislative Council or Joint Budget Committee, or both; and
32(3) Thereupon, the Department of Finance and Administration shall
33 include all information obtained in subdivision (b)(2) of this section in the
34 budget manuals.
35      The provisions of this section shall be in effect only from July
36 1, 2025 2026 through June 30, 2026 2027.

2      SECTION 15. COMPLIANCE WITH OTHER LAWS.      Disbursement of funds
3 authorized by this act shall be limited to the appropriation for such agency
4 and funds made available by law for the support of such appropriations; and
5 the restrictions of the State Procurement Law, the General Accounting and
6 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
7 Procedures and Restrictions Act, or their successors, and other fiscal
8 control laws of this State, where applicable, and regulations promulgated by
9 the Department of Finance and Administration, as authorized by law, shall be
10 strictly complied with in disbursement of said funds.

12      SECTION 16. LEGISLATIVE INTENT.     It is the intent of the General
13 Assembly that any funds disbursed under the authority of the appropriations
14 contained in this act shall be in compliance with the stated reasons for
15 which this act was adopted, as evidenced by the Agency Requests, Executive
16 Recommendations and Legislative Recommendations contained in the budget
17 manuals prepared by the Department of Finance and Administration, letters, or
18 summarized oral testimony in the official minutes of the Arkansas Legislative
19 Council or Joint Budget Committee which relate to its passage and adoption.

21      SECTION 17. EMERGENCY CLAUSE.      It is found and determined by the
22 General Assembly, that the Constitution of the State of Arkansas prohibits
23 the appropriation of funds for more than a one (1) year period; that the
24 effectiveness of this Act on July 1, 2026 is essential to the operation of
25 the agency for which the appropriations in this Act are provided, and that in
26 the event of an extension of the legislative session, the delay in the
27 effective date of this Act beyond July 1, 2026 could work irreparable harm
28 upon the proper administration and provision of essential governmental
29 programs. Therefore, an emergency is hereby declared to exist and this Act
30 being necessary for the immediate preservation of the public peace, health
31 and safety shall be in full force and effect from and after July 1, 2026.
