otheschoolyearinwhichthecharterschoolcontractisexecutedundersubsection1;provided,however,thattheapprovedcharterschoolmayopenonthefirstdayoftheschoolyearthatisimmediatelysubsequenttotheschoolyearinwhichthecharterschoolcontractisexecutedundersubsection1iftheapprovedcharterschooldemonstratesadequatepreparationtothestateboardortheuniversityofnorthernIowa.Ifthecharterschoolrequiresanopeningdelayofmorethanoneschoolyeartwoschoolyearsimmediatelysubsequenttotheschoolyearinwhichthecharterschoolcontractisexecutedundersubsection1,thecharterschoolmayrequestanextensionfromthestateboardortheuniversityofnorthernIowa.HouseFile2754,p.103.EachcharterschoolcontractshallbesignedbythepresidentofthestateboardorthepresidentoftheuniversityofnorthernIowa,asapplicable,andthepresidentorappropriateofficerofthegoverningbodyofthefoundinggroup.4.WithinfifteendaysoftheexecutionofacharterschoolcontractenteredintobythestateboardortheuniversityofnorthernIowa,thestateboardortheuniversityofnorthernIowashallnotifythedepartmentandthedepartmentofmanagementofthenameofthecharterschoolandanyapplicableeducationserviceprovider,theproposedlocationofthecharterschool,andthecharterschool’sfirstyearprojectedenrollment.5.AcharterschoolapprovedunderthischaptersubchaptershallnotcommenceoperationswithoutavalidcharterschoolcontractexecutedinaccordancewiththissectionandapprovedinanopensessionofthestateboardorbytheuniversityofnorthernIowa.6.Thecontractmayprovideforrequirementsorconditionstogovernandmonitorthestart-upprogressofanapprovedcharterschoolpriortotheopeningofthecharterschoolfromthedatethecharterschoolcontractisexecutedthroughthedatethecharterschoolopens,includingbutnotlimitedtoconditionstoensurethatthecharterschoolmeetsallbuilding,health,safety,insurance,andotherlegalrequirements.7.AcharterschoolcontractmaybeamendedtogovernmultiplecharterschoolsoperatedbythesameapplicantandapprovedbythestateboardortheuniversityofnorthernIowa.However,eachcharterschoolthatispartofacharterschoolcontractshallbeseparateanddistinctfromanyothercharterschoolgovernedbythecontract.Sec.19.Section256E.7,subsection1,unnumberedparagraph1,Code2026,isamendedtoreadasfollows:Inordertofulfillthecharterschool’spublicpurpose,acharterschoolestablishedunderthischaptersubchaptershallbeorganizedasanonprofiteducationorganizationandshallhaveallthepowersnecessaryforcarryingoutthetermsofthecharterschoolcontractincludingbutnotlimitedtotheHouseFile2754,p.11following,asapplicable:Sec.20.Section256E.7,subsection2,unnumberedparagraph1,Code2026,isamendedtoreadasfollows:Acharterschoolestablishedunderthischaptersubchapterisexemptfromallstatestatutesandrulesandanylocalrule,regulation,orpolicy,applicabletoanoncharterschool,exceptthatthecharterschoolshalldoallofthefollowing:Sec.21.Section256E.7,subsection2,paragraphsg,i,andw,Code2026,areamendedtoreadasfollows:g.Besubjecttothesamefinancialaudits,auditprocedures,andauditrequirementsasaschooldistrict.Theauditshallbeconsistentwiththerequirementsofsections11.6,11.14,11.19,and279.29,andsection256.9,subsection20,excepttotheextentdeviationsarenecessarybecauseoftheprogramattheschool.Thedepartment,theuniversityofnorthernIowa,theauditorofstate,orthelegislativeservicesagencymayconductfinancial,program,orcomplianceaudits.i.Provideinstructionforatleastthenumberofdaysorhoursrequiredbysection279.10,subsection1,unlessspecificallywaivedbythestateboardortheuniversityofnorthernIowaaspartoftheapplicationprocess.w.Complywiththerequirementsofthischaptersubchapter.Sec.22.Section256E.7,subsection2,paragraphh,unnumberedparagraph1,Code2026,isamendedtoreadasfollows:Besubjecttoandcomplywiththerequirementsofsection256.7,subsection21,andtheeducationalstandardsofsection256.11,unlessspecificallywaivedbythestateboardortheuniversityofnorthernIowaduringtheapplicationprocess;provided,however,thatthestateboardortheuniversityofnorthernIowashallnotwaiveanyofthefollowingeducationalstandards:Sec.23.Section256E.7,subsection9,Code2026,isamendedtoreadasfollows:9.IndividualscompensatedbyaneducationserviceproviderareprohibitedfromservingasavotingmemberonthegoverningboardofanycharterschoolunlessthestateboardortheuniversityofnorthernIowawaivessuchprohibition.HouseFile2754,p.12Sec.24.Section256E.8,subsections1and4,Code2026,areamendedtoreadasfollows:1.Eachstudentenrolledinacharterschoolestablishedunderthischaptersubchaptershallbecounted,forstateschoolfoundationpurposes,inthestudent’sdistrictofresidencepursuanttosection257.6,subsection1,paragraph“a”,subparagraph(9),includinganyapplicableamountsundersection256B.9.Forpurposesofthissection,residencemeansaresidenceundersection282.1.4.Ifnecessary,andpursuanttorulesadoptedbythestateboard,inconsultationwiththeuniversityofnorthernIowa,fundingamountsrequiredunderthissectionforthefirstschoolyearofanewcharterschoolshallbebasedonenrollmentestimatesforthecharterschoolincludedinthecharterschoolcontract.Thedepartment,inconsultationwiththeuniversityofnorthernIowa,shalladoptrulestoestablishaprocessfordeterminingestimatedenrollmentsforcharterschoolfundingpurposesinschoolyearsafterthefirstschoolyearofacharterschool.Amountspaidusingestimatedenrollmentsshallbereconciledduringsubsequentpaymentsbasedonactualenrollmentofthecharterschoolduringeachschoolyear.Sec.25.Section256E.9,subsection1,unnumberedparagraph1,Code2026,isamendedtoreadasfollows:Theperformanceprovisionswithinthecharterschoolcontractshallbebasedonaperformanceframeworkadoptedbythestateboard,inconsultationwiththeuniversityofnorthernIowa,thatclearlysetsforththeacademicandoperationalperformanceindicators,measures,andmetricsthatwillguidetheevaluationofthecharterschoolbythestateboardortheuniversityofnorthernIowa,withoutcompromisingindividualstudentprivacy.Theperformanceframeworkshallincludebutisnotlimitedtoindicators,measures,andmetricsforallofthefollowing:Sec.26.Section256E.9,subsections2and5,Code2026,areamendedtoreadasfollows:2.Annualperformancetargetsshallbeagreeduponbetweeneachcharterschoolandthestateboard,inconsultationwiththeuniversityofnorthernIowa,ifapplicable.SuchHouseFile2754,p.13performancetargetsshallbecontainedinthecharterschoolcontractandshallbedesignedtohelpeachcharterschoolmeetapplicablefederal,state,andlocalstandards.Theperformancetargetscontainedinthecharterschoolcontractmaybeamendedbymutualagreementafterthecharterschoolisoperatingandhascollectedinitialachievementdataforthecharterschool’sstudents.5.Eachcharterschoolestablishedunderthischaptersubchaptershallbeevaluatedandgradedbythedepartmentpursuanttotheattendancecenterperformancerankingsystemdevelopedandadoptedbythedepartment.Sec.27.Section256E.10,subsections1,2,6,8,12,and13,Code2026,areamendedtoreadasfollows:1.ThestateboardandtheuniversityofnorthernIowashallmonitortheperformanceandcomplianceofeachcharterschoolthestateboardapprovesapprovedbythestateboardortheuniversityofnorthernIowa,includingcollectingandanalyzingdataaccordingtothecharterschoolcontractinordertomeettherequirementsofthischaptersubchapter.Suchoversightmayincludeinquiriesandinvestigationofthecharterschoolsolongastheactivitiesareconsistentwiththeintentofthischaptersubchapter,adheretothetermsofthecharterschoolcontract,anddonotundulyinhibittheautonomygrantedtothecharterschool.Anyperformancereportresultingfromaninquiryorinvestigationunderthissectionshall,uponconclusionofsuchaction,beincludedintheannualreportrequiredundersection256E.12.2.Aspartofthecharterschoolcontract,thecharterschoolshallsubmitanannualreporttothestateboardortheuniversityofnorthernIowatoassistthestateboardortheuniversityofnorthernIowainevaluatingthecharterschool’sperformanceandcompliancewiththeperformanceframework.6.Annually,byJune30,thestateboardortheuniversityofnorthernIowa,asapplicable,shallissueacharterschoolperformancereportandcharterschoolcontractrenewalapplicationguidancetoeachcharterschoolwhosecharterschoolcontractwillexpireduringthefollowingschoolbudgetyear.Theperformancereportshallsummarizethecharterschool’sperformancerecordtodatebasedonthedatarequiredHouseFile2754,p.14bythecharterschoolcontractandbythischaptersubchapterandshallidentifyconcernsthatmayjeopardizerenewalofthecharterschoolcontractifnotremedied.Thecharterschoolshallhavesixtydaystorespondtotheperformancereportandsubmitanycorrectionsorclarificationsforthereport.8.NolaterthanOctober1,thegoverningboardofacharterschoolseekingrenewalshallsubmitarenewalapplicationtothestateboardortheuniversityofnorthernIowapursuanttotherenewalapplicationguidance.Arenewalordenialshallbeapprovedbyresolutionofthestateboard,orbytheuniversityofnorthernIowa,withinsixtydaysfollowingthefilingoftherenewalapplication.12.Adecisiontorevokeortonotrenewacharterschoolcontractshallbebyresolutionofthestateboard,orbytheuniversityofnorthernIowa,andshallclearlystatethereasonsfortherevocationornonrenewal.13.Ifacharterschoolhasbeenevaluatedandgradedtobeintheexceptionalcategory,orthehighestratedcategoryunderasucceedingevaluationsystem,undertheevaluationandgradingrequiredundersection256E.9,subsection5,fortheimmediatelyprecedingtwoschoolyears,andthecharterschoolisincompliancewiththecurrentcharterschoolcontractandallprovisionsofthischaptersubchapter,thecharterschool’sapplicationrenewalundersubsection8shallberenewedforanadditionalperiodoftimeequaltothelengthoftheoriginalcharterschoolcontractorthemostrecentrenewalofthecontract,whicheverislonger,unlessthestateboardortheuniversityofnorthernIowaprovideswrittennoticetothecharterschoolofthestateboard’sortheuniversityofnorthernIowa’srejectionoftheexpeditedrenewalwithinsixtydaysofthefilingoftheapplication.ThestateboardortheuniversityofnorthernIowashallnotrejectanexpeditedrenewalapplicationunlessthestateboardortheuniversityofnorthernIowafindsexceptionalcircumstancesfortherejectionorseeksmaterialchangestothecharterschoolcontract.Sec.28.Section256E.10,subsection9,unnumberedparagraph1,Code2026,isamendedtoreadasfollows:Unlesseligibleforexpeditedrenewalundersubsection13,whenreviewingacharterschoolcontractrenewalapplication,HouseFile2754,p.15thestateboardortheuniversityofnorthernIowashalldoallofthefollowing:Sec.29.Section256E.10,subsection10,unnumberedparagraph1,Code2026,isamend
