28THAT Senator King is authorized to introduce a bill which as introduced
29 will read substantially as follows:

32 AN ACT TO AMEND THE ARKANSAS DATA CENTERS ACT OF 2023; TO REQUIRE A DIGITAL
33 ASSET MINER OR DIGITAL ASSET MINING BUSINESS TO PROVIDE NOTIFICATION BEFORE
34 PURCHASING OR LEASING LAND OR A BUILDING OR BEGINNING CONSTRUCTION OF A
35 DIGITAL ASSET MINING FACILITY; AND FOR OTHER PURPOSES.

4 PURCHASING OR LEASING LAND OR A BUILDING OR BEGINNING CONSTRUCTION.

6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

8      SECTION 1.    Arkansas Code Title 14, Chapter 1, Subchapter 6, is amended
9 to add an additional section to read as follows:
10      14-1-607.    Purchase or lease of land for or construction or operation
11 of facility for digital asset mining or utilization of blockchain network —
12 Notification — Definition.
13      (a)   A digital asset miner, digital asset mining business, or business
14 utilizing a blockchain network that is seeking to purchase or lease land or a
15 building or construction for the operation of digital asset mining or the
16 utilization of a blockchain network shall file a written notification with
17 the Arkansas Public Service Commission and the local government of the area
18 where the purchasing, leasing, or construction is anticipated to occur no
19 fewer than six (6) months before:
20(1)    The purchasing or leasing occurs, if no purchasing or
21 leasing has occurred before the effective date of this act; or
22(2)    Construction starts, if a purchase has been made or leasing
23 has occurred before the effective date of this act.
24      (b)   As used in this section, "construction" includes any sitework to
25 clear or prepare land for building."
