1.1A bill for an act
1.2relating to transportation; requiring establishment of graffiti abatement policy;
1.3requiring a report; proposing coding for new law in Minnesota Statutes, chapter
1.4174.
1.5    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6Section 1. [174.76] GRAFFITI ABATEMENT.
1.7Subdivision 1. Graffiti abatement policy. The commissioner of transportation must
1.8    develop and implement a policy for preventing and abating graffiti on properties maintained
1.9    by the Department of Transportation.
1.10Subd. 2. Consultation; best practices. In developing the policy and identifying best
1.11   practices for prevention and abatement, the commissioner must consult with organizations
1.12   or individuals that have experience in successful graffiti abatement, including local
1.13   governments, law enforcement, regional planning agencies, and business improvement
1.14   associations.
1.15Subd. 3. High-priority properties. The graffiti abatement policy must include a process
1.16   for identifying properties that are a high priority for abatement measures, including properties
1.17   that receive a high volume of graffiti-related complaints from the surrounding community,
1.18   are highly visible to the public, are frequent targets of graffiti, and the commissioner deems
1.19   are high priorities for other reasons. The commissioner must maintain a list of high-priority
1.20   properties that includes the type of abatement measures applied to each property and the
1.21   date the measures were taken.
1.22Subd. 4. Requirements. The graffiti abatement policy must provide:

2.1      (1) best practices for preventing and abating graffiti;
2.2      (2) a process for identifying and designating high-priority properties;
2.3      (3) minimum time periods for abating graffiti on high-priority properties identified under
2.4  subdivision 3; and
2.5      (4) minimum time periods for abating graffiti on other properties.
2.6      Subd. 5. Report required. By February 1, 2027, and annually thereafter, the
2.7  commissioner must submit a report to the chairs and ranking minority members of the
2.8  legislative committees with jurisdiction over transportation policy and finance. At a
2.9  minimum, the report must:
2.10     (1) provide the most recent version of the graffiti abatement policy;
2.11     (2) include the list of high-priority properties and the measures taken to address graffiti
2.12 on those properties; and
2.13     (3) identify areas for improvement in graffiti maintenance and challenges in making
2.14 those improvements.
