27 ASSEMBLY OF THE STATE OF ARKANSAS:

29THAT Senator King is authorized to introduce a bill which as introduced
30 will read substantially as follows:

33 AN ACT TO PROHIBIT THE USE OF A COMPUTER MANUFACTURED OR ASSEMBLED BY A
34 COVERED FOREIGN ENTITY IN DIGITAL ASSET MINING; TO PROHIBIT THE USE OF
35 SOFTWARE DEVELOPED BY A COVERED FOREIGN ENTITY IN DIGITAL ASSET MINING; AND
36 FOR OTHER PURPOSES.

1 Subtitle
2 TO PROHIBIT THE USE OF A COMPUTER MANUFACTURED OR ASSEMBLED BY A COVERED
3 FOREIGN ENTITY IN DIGITAL ASSET MINING; AND TO PROHIBIT THE USE OF SOFTWARE
4 DEVELOPED BY A COVERED FOREIGN ENTITY IN DIGITAL ASSET MINING.

6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

8      SECTION 1.    Arkansas Code § 14-1-603, concerning definitions under the
9 Arkansas Data Centers Act of 2023, is amended to add an additional
10 subdivision to read as follows:
11(13)   "Covered foreign entity" means an individual, foreign
12 government, or a party other than an individual or foreign government:
13(A)   On the Consolidated Screening List or Entity List as
14 designated by the United States Secretary of Commerce;
15(B)   Domiciled in the People's Republic of China or the
16 Russian Federation;
17(C)   Under the influence of or control by the government of
18 the People's Republic of China or the Russian Federation; or
19(D)   That is a subsidiary or affiliate of an individual,
20 government, or party referred to in subdivisions (13)(A)-(C) of this section.

22      SECTION 2.    Arkansas Code Title 14, Chapter 1, Subchapter 6, is amended
23 to add an additional section to read as follows:
24      14-1-607.    Use of computer manufactured by covered foreign entity or
25 software developed by covered foreign entity prohibited — Penalty.
26      (a)   A digital asset mining business or digital asset miner shall not
27 use in the course of digital asset mining or home digital asset mining:
28(1)    A computer that is manufactured or assembled by a covered
29 foreign entity; or
30(2)    Software that is developed by a covered foreign entity.
31      (b)   A digital asset mining business or digital asset miner in
32 violation of this section upon conviction is guilty of a:
33(1)    Class A misdemeanor for a first offense; and
34(2)    Class D felony for a second or subsequent offense."
