eamendedtoreadasfollows:3.Anorderestablishingspacingunitsforapoolshallspecifythesizeandshapeofeachunitandthelocationandnumberofthepermittedwellthereonwellsinaccordancewithareasonablyuniformspacingplan.Uponapplication,ifthedirectorfindsthatawelldrilledattheprescribedlocationwouldnotproduceinpayingquantities,orthatsurfaceconditionswouldsubstantiallyaddtotheburdenorhazardofdrillingsuchwell,thedirectorisauthorizedtoenteranorderpermittingtheawelltobedrilledatalocationotherthanthatprescribedbysuchspacingorder;however,thedirectorshallincludeintheordersuitableprovisionstopreventtheproductionfromthespacingunitofmorethanitsjustandequitableshareoftheoilandgasinthepool.4.Anorderestablishingunitsforapoolshallcoveralllandsdeterminedorbelievedtobeunderlaidbythepool,andmaybemodifiedbythedirectorfromtimetotimetoincludeadditionalareasdeterminedtobeunderlaidbythepool.Whenfoundnecessaryforthepreventionofwaste,ortoavoidtheSenateFile2490,p.5drillingofunnecessarywellsortoprotectcorrelativerights,anorderestablishingspacingunitsinapoolmaybemodifiedbythedirectortoincreasethesizeofspacingunitsinthepooloranyzoneofthepool,ortopermitthedrillingofadditionalwellswithinaspacingunitonareasonableuniformplaninthepool,oranyzoneofthepool.Ordersofthedirectormaybeappealedtothedepartmentwithinthirtydays.Sec.9.Section458A.7,Code2026,isamendedbyaddingthefollowingnewsubsection:NEWSUBSECTION.5.Ifthedepartmentisunabletodeterminetheexistenceofapoolandtheappropriateacreagetobeembracedwithinaspacingunitandtheshapethereofbasedontheevidenceintroducedathearing,thedepartmentmayestablishanexploratoryspacingunitforthepurposeofdrillingoneormoreexploratorywellsinordertoestablishtheexistenceofapoolandtheappropriatesizeandshapeofthespacingunittobeappliedforfuturedevelopmentofthepool.Inestablishingthesizeandshapeoftheexploratoryspacingunit,thedepartmentmayconsiderthesizeandshapeofspacingunitsestablishedbythedepartmentforthesamepoolorformationinotherareas,thesizeandshapeofunitsforsimilardevelopmentinotherbasins,reservoirmodelingorotherpreliminarydataonthepoolorformation,andanyotherinformationthedepartmentdeemsrelevant.Sec.10.Section458A.8,Code2026,isamendedtoreadasfollows:458A.8Integrationoffractionaltracts.1.Whentwoormoreseparatelyownedtractsareembracedwithinaspacingunit,orwhenthereareseparatelyownedinterestsinallorapartofthespacingunit,thentheownersandroyaltyownersofthetractsmaypooltheirinterestsforthedevelopmentandoperationofthespacingunit.Intheabsenceofvoluntarypooling,thedepartment,upontheapplicationofanyinterestedperson,shallenteranorderpoolingallinterestsinthespacingunitforthedevelopmentandoperationsoftheunit.Eachpoolingordershallbemadeafternoticeandhearing,andshallbeupontermsandconditionsthatarejustandreasonable,andthataffordtotheownerofeachtractorinterestinthespacingunittheSenateFile2490,p.6opportunitytorecoverorreceive,withoutunnecessaryexpense,ajustandequitableshare.Operationsincidenttothedrillingofawelluponanyportionofaspacingunitcoveredbyapoolingordershallbedeemedforallpurposestobetheconductoftheoperationsuponeachseparatelyownedtractinthedrillingunitbytheseveralownersoftheunit.Thatportionoftheproductionallocatedtoeachtractincludedinaspacingunitcoveredbyapoolingordershall,whenproduced,bedeemedforallpurposestohavebeenproducedfromthetractbyawelldrilledonit.2.Eachpoolingordershallmakeprovisionforthedrillingandoperationofawellonthespacingunit,andforthepaymentofthereasonableactualcostofthewellbytheownersofinterestsinthespacingunit,plusareasonablechargeforsupervision.Intheeventofanydisputeastosuchcosts,thedepartmentshalldeterminethepropercosts.Ifanownershalldrillandoperate,orpaytheexpensesofdrillingandoperatingthewellforthebenefitofothers,then,theownersodrillingoroperatingshall,uponcomplyingwiththetermsofsection458A.10,havealienontheshareofproductionfromthespacingunitaccruingtotheinterestofeachoftheotherownersforthepaymentofaproportionateshareoftheexpenses.Alltheoilandgassubjecttothelienshallbemarketedandsoldandtheproceedsappliedinpaymentoftheexpensessecuredbythelienasprovidedforinsection458A.10.2.Intheabsenceofvoluntarypoolingpursuanttosubsection1,andonlyiftheproducerhasidentifiedpoolsofexistingnaturalhydrogenwithinthespacingunit,thedirector,upontheapplicationbytheownerorownersofnotlessthantwenty-fivepercentoftheareaofthespacingunit,shallenteranorderpoolingallinterestsinthespacingunitforthedevelopmentandoperationthereof.Anysuchpoolingordermayauthorizecostrecoveryandriskpenaltiesagainstnonconsentingownersforaspecificwell.Eachsuchpoolingordershallbemadeafternoticeandhearingandwithtermsandconditionsthatarejustandreasonable.OperationsincidenttothedrillingofawelluponanyportionofaspacingunitcoveredbyapoolingordershallbedeemedforallpurposesSenateFile2490,p.7tobetheconductofsuchoperationsuponeachseparatelyownedtractintheunitbytheseveralownersthereof.Whenproduced,thatportionoftheproductionallocatedorapplicabletoeachtractincludedinaunitcoveredbyapoolingordershallbedeemedforallpurposestohavebeenproducedfromsuchtractbyawelldrilledthereon.3.Eachpoolingordershallprovideforthedrillingandoperationofawellinthespacingunit,andforthepaymentofthecostthereof,asprovidedinthissubsection.Thedirectorisspecificallyauthorizedtoprovidethattheproducershallbeentitledtoallproductionfromthewellthatwouldbereceivedbytheownerorowners,forwhosebenefitthewellwasdrilledoroperated,afterpaymentofroyaltyasprovidedinthelease,ifany,applicabletoeachtractorinterestorafterpaymentoftheroyaltyifrequiredundersubsection4,andobligationspayableoutofproduction,untiltheproducershavebeenpaidtheamountdueunderthetermsofthepoolingorderorordersettlingthedispute.Intheeventofanydisputedcost,thedirectorshalldeterminethepropercost.Thepoolingordershalldeterminetheinterestofeachownerintheunit,andmayprovidethateachownerwhoagreeswiththeproducerforthepaymentbytheowneroftheowner’sshareofthecosts,unlesstheownerhasagreedotherwise,shallbeentitledtoreceive,subjecttoroyaltyorsimilarobligations,theshareoftheproductionofthewellapplicabletothetractofthenonconsentingowner.Eachownerwhodoesnotagreeshallbeentitledtoreceivefromtheproducertheowner’sshareoftheproductionapplicabletotheowner’sinterestaftertheproducerhasrecoveredthefollowing,subjecttotheprovisionsofsubsection4:a.Onehundredpercentofthenonconsentingowner’sshareofthecostofanynewlyacquiredsurfaceequipmentbeyondthewellheadconnections,includingstocktanks,separators,treaters,orpumpingequipmentandpiping,plusonehundredpercentofthenonconsentingowner’sshareofthecostofoperatingthewellcommencingwithfirstproductionandcontinuinguntilthenonconsentingowner’srelinquishedinterestrevertsunderotherprovisionsinthissection.b.UptotwohundredpercentofthatportionofthecostsSenateFile2490,p.8andexpensesofdrilling,reworking,deepeningorpluggingback,testing,andcompleting,afterdeductinganycashcontributionsreceived,anduptotwohundredpercentofthatportionofthecostofnewlyacquiredequipmentinthewell,uptoandincludingthewellheadconnections,whichwouldhavebeenchargeabletothenonconsentingowneriftheownerhadparticipatedtherein,ifthenonconsentingowner’stractorinterestissubjecttoaleaseorothercontractforoilandgasdevelopment.4.Duringthetimetheproducerisrecoveringcostsfromanonconsentingownerasauthorizedinapoolingorderissuedpursuanttosubsection2,anonconsentingownerofatractorinterestinaspacingunitthatisnotsubjecttoaleaseorothercontractforoilandgasdevelopmentshallbeentitledtoacost-freeroyaltyinterestequaltotwelveandone-halfpercent.5.Uponfullpaymentoftherecoverablecostsasspecifiedinsubsection3,thefollowingshalloccur:a.Withinthirtydaystheproducershallnotifythenonconsentingownertooffertothenonconsentingownertheopportunitytoparticipateunderthepoolingorderasaworkinginterestowner.Thenoticeshallstatethatthenonconsentingownermayelecttoparticipateinthepoolingorderormayelecttocontinuereceivingtheroyaltyspecifiedinsubsection4.b.Withinsixtydaysafterreceivingnotice,thenonconsentingownershallinformtheproducerwhetherthenonconsentingownerwishestomakeanelectiontoparticipateunderthepoolingorderasaworkinginterestownerorcontinuereceivingtheroyaltyspecifiedinsubsection4.c.Ifthenonconsentingownerfailstorespondtothenoticewithinthetimespecifiedinparagraph“b”,thenonconsentingownershallbedeemedtoelecttocontinuereceivingtheroyaltyspecifiedinsubsection4.d.Withinfivebusinessdaysafterreceivingnoticeofelectionfromanonconsentingowneroruponexpirationofthetimespecifiedinparagraph“b”,theproducershallnotifythedirectorregardingthenonconsentingowner’selectionorlackthereof.SenateFile2490,p.96.Anapplicationforpoolingshallprovideatleastthefollowing:a.Acertificateofservicecontainingallpersonsthathavearoyaltyinterestorareownersinsidethedrillingandspacingunit.b.Theapplicant’sinteresttypeinthedrillingandspacingunit.c.Thelegaldescriptionofthelandsandthedepartmentdocketnumberestablishingthedrillingandspacingunitsoughttobepooled.d.Astatementthattwoormoreseparatelyownedtractsorseparatelyownedinterestsinthedrillingandspacingunithavenotvoluntarilypooledtheirinterestsandanyvalidpoolingorderforthedrillingandspacingunit.e.TheAmericanpetroleuminstitutewellnumberofthewellsubjecttotheapplication,ifrequestingcostrecoveryorriskpenalties.f.Alistofallnonconsentingownersinthewellthattheapplicantisseekingcostrecoveryandriskpenaltiesagainstatthetimeoffilingtheapplication.g.Thecostrecoveryandriskpenaltiestheapplicantisrequesting,ifany.7.Anapplicantshallprovideathearingatleastthefollowing:a.Acopyoftheelectionletter,wellproposal,andauthorizationforexpendituresenttotheownersinthedrillingandspacingunit.b.Thenamesandinterestsofallnonconsentingownersandunleasednonconsentingownersinthewell.c.Evidencetojustifytheapplicationofariskpenalty.Sec.11.NEWSECTION.458A.26Permissiontoentersite——negotiationofsurfacedamages.1.Beforeenteringasitethatissubjecttoapoolingorderundersection458A.8,orthatiswithinanexploratoryspacingunit,forpurposesofanoilandgasoperation,anoperatorshallreceivewrittenpermissionfromthesurfaceownertoenterthesite.Ifthesurfaceownerdoesnotgrantwrittenpermissiontotheoperatortoenterthesite,theoperatorshallnotenterthesiteforpurposesofanoilandSenateFile2490,p.10gasoperation.2.a.Beforeenteringasitethatissubjecttoapoolingorderundersection458A.8,orthatiswithinanexploratoryspacingunit,withheavyequipmentforthepurposeofdrilling,anoperatorshallnegotiatewiththesurfaceownerforthepaymentofanydamagesthatmaybecausedbythedrillingoperation.Ifthepartiesagreeandexecuteawrittencontractforpaymentofdamages,theoperatormayenterthesitetodrill.Ifthepartiesdonotreachanagreementforpaymentofdamages,theoperatorshallnotenterthesitetodrill.b.Beforeenteringintoanegotiationunderparagraph“a”,theoperatorshallprovideawrittendescriptionoftheopt-outproceduredescribedinparagraph“c”.c.Asurfaceownermaydeclinefurthercommunicationwithanoperatorconcerningapossibleagreementforthepaymentofanydamagethatmaybecausedbythedrillingoperationbyprovidingverbalorwrittennoticetotheoperatorthatstatesthatthesurfaceownerdoesnotwishtodiscussthematterfurther,andbysubmittingtotheattorneygeneralnoticethroughorelectronicmeansstatingthesame.Uponreceiptofsuchnoticefromthesurfaceowner,theattorneygeneralshallforwardacopytotheoperator.d.Afterreceiptofnoticefromthesurfaceownerpursuanttoparagraph“c”,theoperatorshallnotinitiatefurthercontactwiththesurfaceownerforpurposesofanagreementforthepaymentofanydamagesthatmaybecausedbythedrillingoperation,exceptthattheoperatorshallcontinuetoprovidethesurfaceownerwithnoticesotherwiserequiredbylaw.Thesurfaceownermayrescindsuchrefusalbycontactingtheoperatorandnotifyingtheattorneygeneralthroughorelectronicmeans.Unlessthesurfaceownerrescindstherefusal,thesurfaceowner’slandshallbedeemedunavailableforanagreement.e.Anoperatorviolatingthecontactprohibitioninparagraph“d”issubjecttoacivilpenaltyofnotlessthantenthousanddollarsforeachviolation.3.Forpurposesofthissection,“oilandgasoperation”meansthesameasdefinedinsection458A.30.Sec.12.NEWSECTION.458A.27Impositionoftax——taxrateSenateFile2490,p.11——valuationtaxpayers.1.Fortheprivilegeofseveringorextractingoilorgasfromthelandswithinthestate,thereisleviedaseverancetaxonthevalueoftheoilandgasextracted,whichshallbeinadditiontoanyothertaxesimposedbylaw.2.Theseverancetaxshallbesixpercentofthefairmarketvalueoftheoilorgasuponextractionatthewellhead.3.Expensesincurredbytheproducerpriortovaluationarenotdeductiblefromtaxablevalue.4.Whenownershipofoilorgasproducedisshared,eachownershallberesponsibleforpaymentofitsproportionateshareofseverancetax.Ataxpayerpayingseverancetaxonoilorgasproductionmaydeductthetaxespaidfromanyroyaltyorotheramountsdueortobecomeduetotheinterestownersofsuchproduction,inproportiontotheinterestownership,inwhichcasethepersonreceivingtheroyaltyorotherpaymentshallnotbeliableforseverancetax.5.Thedepartmentofrevenuemayadoptrulespursuanttochapter17Atoadministerthissection.Sec.13.NEWSECTION.458A.28Revenuedistribution.1.Revenuesreceivedfromtheseverancetaxcollectedpursuanttosection458A.27shallbedistributedasfollows:a.(1)Theseverancetaxrevenuesshallbedistributedtocountiesasfollows:(a)Nineandnine-tenthspercentofseverancetaxrevenueeachyearshallbedistributedtoeachcountyinthestateinproportiontothecounty’sshareoftotalstatepopulationaccordingtothemostrecentfederaldecennialcensus.(b)Fivepercentofseverancetaxrevenueeachyearshallbedistributedtothecountiesinwhichlandislocatedfromwhichoilorgasisproducedinproportiontoeachcounty’sshareofthevalueofoilandgasproductionforthatyear.(2)Distributionstocountiesunderthisparagraphshallbeusedexclusivelyforanyofthefollowingpurposes:(a)Toconstructandmaintaincountyroads.(b)Tooffsetcountypropertytaxcollections.Fordistributionsusedforpurposesofthissubparagraphdivision,thecountyshalladoptacorrespondinglevyratereduction.b.FivepercentofseverancetaxrevenueeachyearshallbeSenateFile2490,p.12depositedintheroadusetaxfundestablishedundersection312.1.c.(1)Tenpercentofseverancetaxrevenueeachyearshallbedepositedintheseverancetaxaccountwithintheenvironmentfirstfundestablishedundersection8.57Aforpurposesofsupportingthewaterqualityinitiativeadministeredbythedivisionpursuanttosection466B.42,includingsalaries,support,maintenance,andmiscellaneouspurposes,includingasprovidedinthisparagraph,notwithstandingsection8.57A,subsection3.(2)(a)Themoneysdepositedpursuanttothisparagraphshallbeusedtosupportdemonstrationprojectsinsubwatershedsasdesignatedbythedepartmentofagricultureandlandstewardshipthatarepartofhigh-prioritywatershedsidentifiedbythewaterresourcescoordinatingcouncil.(b)Themoneysdepositedpursuanttothisparagraphshallbeusedtosupportdemonstrationprojectsinwatershedsgenerally,includingregionalwatersheds,asdesignatedbythedivision,andhigh-prioritywatershedsidentifiedbythewaterresourcescoordinatingcouncil.(3)Insupportingprojectsinwatershedsandsubwatershedsasprovidedinsubparagraph(2),allofthefollowingapply:(a)ThedemonstrationprojectsmustutilizewaterqualitypracticesasdescribedintheIowanutrientreductionstrategyasdefinedinsection455B.171.(b)Thedivisionshallimplementdemonstrationprojectsasprovidedinsubparagraphdivision(a)byprovidingforparticipationbypersonswhoholdalegalinterestinagriculturallandusedinfarming.Toeveryextentpractical,thedivisionshallprovideforcollaborativeparticipationbysuchpersonswhoholdalegalinterestinagriculturallandlocatedwithinthesamesubwatershed.(c)Thedivisionshallimplementdemonstrationprojectsonacost-sharebasisasdeterminedbythedivision.Exceptforedge-of-fieldpractices,thestate’sshareoftheamountshallnotexceedfiftypercentoftheestimatedcostofestablishingthepracticeasdeterminedbythedivisionorfiftypercentoftheactualcostofestablishingthepractice,whicheverisless.SenateFile2490,p.13(d)Thedemonstrationprojectsshallbeusedtoeducateotherpersonsaboutthefeasibilityandvalueofestablishingsimilarwaterqualitypractices.Thedivisionshallpromotefielddayeventsforpurposesofallowinginterestedpersonstoestablishwaterqualitypracticesonsuchpersons’agriculturalland.(e)Thedivisionshallconductwaterqualityevaluationswithinsupportedsubwatersheds.Withinareasonableperiodafteraccumulatinginformationfromsuchevaluations,thedivisionshallcreateanaggregateddatabaseofwaterqualitypractices.Anyinformationidentifyingapersonholdingalegalinterestinagriculturallandorspecificagriculturallandshallbeaconfidentialrecord.(4)Themoneysdepositedpursuanttothisparagraphshallbeusedtosupporteducationandoutreachinamannerthatencouragespersonswhoholdalegalinterestinagriculturallandusedforfarmingtoimplementwaterqualitypractices,includingtheestablishmentofsuchpracticesinwatershedsgenerally,andnotlimitedtosubwatershedsorhigh-prioritywatersheds.(5)Themoneysdepositedpursuanttothisparagraphmaybeusedtocontractwithpersonstocoordinatetheimplementationofeffortsprovidedinthisparagraph.(6)Themoneysdepositedpursuanttothisparagraphmaybeusedbythedepartmentofagricultureandlandstewardshiptosupporturbansoilandwaterconservationefforts,whichmayincludebutarenotlimitedtomanagementpracticesrelatedtobioretention,landscaping,theuseofpermeableorperviouspavement,andsoilqualityrestoration.Themoneysshallbeallocatedonacost-sharebasisasprovidedinchapter161A.(7)Notwithstandinganyotherprovisionoflawtothecontrary,thedepartmentofagricultureandlandstewardshipmayusemoneysdepositedpursuanttothisparagraphtocarryouttheprovisionsofthisparagraphonacost-sharebasisincombinationwithothermoneysavailabletothedepartmentofagricultureandlandstewardshipfromastateorfederalsource.(8)NotmorethantenpercentofthemoneysdepositedpursuanttothisparagraphmaybeusedforcostsofSenateFile2490,p.14administrationandimplementationofthewaterqualityinitiativeadministeredbythedivision.d.Seventyandone-tenthpercentofseverancetaxrevenueeachyearshallbedepositedinthetaxpayerrelieffundestablishedundersection8.57E.e.Distributionstothecountiesandtothefundsunderthissubsectionshallbemadequarterlyinanamountequaltoone-fourthoftheestimateofannualtotalseverancetaxrevenuesestimatedforthecurrentfiscalyearbytherevenueestimatingcommittee.Theshareforproducingcountiesshallbecalculatedusingcountyproductiondatafromthepriorfiscalyear’sseverancetaxreturns.2.BySeptember15ofeachyear,thedepartmentofrevenueshallreportactualearningsforthemonthsoftheprecedingfiscalyearforwhichestimateswereusedincomputingdistributions.Thedepartmentofrevenueshallmakeadjustmentstodistributionsduringthecurrentfiscalyearinanamountequaltothedifferencebetweenrevenuesearnedandactualdistributionsfortheprecedingfiscalyear.3.Forpurposesofthissection,“division”meansthedivisionofsoilconservationandwaterqualitycreatedwithinthedepartmentofagricultureandlandstewardshippursuanttosection159.5.Sec.14.NEWSECTION.458A.29Administrationconfidentiality.1.Thedepartmentofrevenueshallannuallyvalueandassessoilorgasproductionfortaxation,inappropriateunitmeasures,atthefairmarketvalueoftheproduct,aftertheminingiscompletedortheoilorgasisextractedatthewellhead.2.Annually,onorbeforeJune1,orassoonthereafterasthefairmarketvalueisdeterminedundersubsection1,thedepartmentofrevenueshallcertifythevaluationoftheproducttothecountyassessorofthecountyfromwhichtheoilorgaswasproduced,andsuchvaluationshallbeenteredupontheassessmentrollsofthecounty.3.Recordsreceived,collected,orcreatedintheadministrationoftheseverancetaxshallbeconfidentialasfollows:SenateFile2490,p.15a.Alltaxpayerreturnsandreturninformationshallbeconfidentialand,exceptasauthorizedbelow,nocurrentorformerofficial,officer,employee,oragentofthestateoranypoliticalsubdivisionthereofshalldiscloseanysuchinformationobtainedinthecourseofserviceasanofficial,officer,employee,oragent.Taxpayerreturnsandreturninformationshallincludewithoutlimitationallstatements,reports,summaries,andallotherdataanddocumentsunderauditorprovidedbythetaxpayerinaccordancewiththeprovisionsofthischapterregardingseverancetax.b.Withoutwrittenauthorizationfromthetaxpayer,nocurrentorformerofficial,officer,employee,oragentofthestateoranypoliticalsubdivisionthereofshallreleasetaxpayerreturnsandreturninformationpertainingtotaxesimposedbythischapter,exceptforanyofthefollowingreasons:(1)Informationmaybereleasedtoemployeesofthedepartmentofrevenueandemployeesofthedepartmentofjusticeforofficialpurposes.(2)Uponpriornoticetothetaxpayer,informationmaybereleasedbythedepartmentofrevenue,uponwrittenapplication,toanyothergovernmentalentityiftheentityshowssufficientreasontoobtaintheinformationforofficialbusiness,subjecttoexecutionofaconfidentialityagreement.(3)Informationshallbeadmissibleincourtoradministrativeproceedingsrelatedtotheseverancetaxorothertaxesonoilorgasproductionoronincomeofproducersorowners,orroyalties.c.Unitsofproductionreportedbythetaxpayerandthetaxpayer’staxablevaluearenotconfidentialandmaybereleased.4.Violationsofthissectionshallbesubjecttothesameprohibitionsandpenaltiesthatapplytootherviolationsofconfidentialityrequirementsapplicabletodataandrecordsinthecustodyofthedepartmentofrevenueforpurposesofcarryingoutitsduties.Sec.15.NEWSECTION.458A.30Exclusivejurisdictionandexpresspreemption.1.Forpurposesofthissection:SenateFile2490,p.16a.“Commerciallyreasonable”meansaconditionthatwouldallowareasonablyprudentoperatortofully,effectively,andeconomicallyexploit,develop,produce,process,andtransportoilandgas,asdeterminedbasedontheobjectivestandardofareasonablyprudentoperatorandnotonanindividualizedassessmentofanactualoperator’scapacitytoact.b.“Oilandgasoperation”meansanactivityassociatedwiththeexploration,development,production,processing,andtransportationofoilandgas,includingdrilling,testing,geologicalsampling,boring,excavation,hydraulicfracturestimulation,completion,maintenance,reworking,recompletion,disposal,pluggingandabandonment,secondaryandtertiaryrecovery,geophysicalsurveysrelatedtooilandgasdevelopment,andremediationactivities.2.Anoilandgasoperationissubjecttotheexclusivejurisdictionofthisstate.Exceptasprovidedinsubsection3,acounty,city,orotherpoliticalsubdivisionshallnotenactorenforceanordinanceorothermeasure,oranamendmentorrevisionofanordinanceorothermeasure,thatbans,limits,orotherwiseregulatesanoilandgasoperationwithintheboundariesorjurisdictionoftherespectivecounty,city,orpoliticalsubdivision.3.Theauthorityofacounty,city,orotherpoliticalsubdivisiontoregulateanoilandgasoperationisexpresslypreempted,exceptthatacountyorcitymayenact,amend,orenforceanordinanceorothermeasureiftheordinanceorothermeasuredoesallofthefollowing:a.Onlyregulatesactivityrelatedtoanoilandgasoperationthatoccursatorabovethesurfaceofthegroundandconcernsgoverningfireandemergencyresponse,traffic,lights,ornoise,orimposesnoticeorreasonablesetbackrequirements.b.(1)Iscommerciallyreasonable.(2)Anordinanceorothermeasureisconsideredprimafacietobecommerciallyreasonableiftheordinanceorothermeasurehasbeenineffectforatleastfiveyearsandhasallowedtheoilandgasoperationsatissuetocontinueduringthatperiod.c.Doesnotprohibitoreffectivelyprohibitanoilandgasoperationconductedbyareasonablyprudentoperator.SenateFile2490,p.17d.Isnototherwisepreemptedbystateorfederallaw.Sec.16.REPEAL.Section458A.6,Code2026,isrepealed.______________________________AMYSINCLAIRPresidentoftheSenate______________________________PATGRASSLEYSpeakeroftheHouseIherebycertifythatthisbilloriginatedintheSenateandisknownasSenateFile2490,Ninety-firstGeneralAssembly.______________________________W.CHARLESSMITHSONSecretaryoftheSenateApproved_______________,2026______________________________KIMREYNOLDSGovernor
