REAPPROPRIATION - NCRC GRANT. There is hereby appropriated,23 to the Department of Parks, Heritage, and Tourism, to be payable from the24 Arkansas Natural and Cultural Resources Grant and Trust Fund, for the25 Department of Parks, Heritage, and Tourism - State Parks and Tourism26 Divisions the following:27(A) Effective July 1, 2026, the balance of the appropriation provided28 in Section 24 of Act 297 of 2025, for the acquisition, management,29 stewardship, or preservation of state owned lands, historic sites, buildings,30 structures, or objects, in a sum not to exceed ..................$20,000,000.3132SECTION 2. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor33 obligations otherwise incurred in relation to the project or projects34 described herein in excess of the State Treasury funds actually available35 therefor as provided by law. Provided, however, that institutions and36 agencies listed herein shall have the authority to accept and use grants and*WFP034* 04/14/2026 2:53:50 PM WFP034HB10981 donations including Federal funds, and to use its unobligated cash income or2 funds, or both available to it, for the purpose of supplementing the State3 Treasury funds for financing the entire costs of the project or projects4 enumerated herein. Provided further, that the appropriations and funds5 otherwise provided by the General Assembly for Maintenance and General6 Operations of the agency or institutions receiving appropriation herein shall7 not be used for any of the purposes as appropriated in this act.8 (B) The restrictions of any applicable provisions of the State9 Purchasing Law, the General Accounting and Budgetary Procedures Law, the10 Revenue Stabilization Law and any other applicable fiscal control laws of11 this State and regulations promulgated by the Department of Finance and12 Administration, as authorized by law, shall be strictly complied with in13 disbursement of any funds provided by this act unless specifically provided14 otherwise by law.1516 SECTION 3. LEGISLATIVE INTENT. It is the intent of the General17 Assembly that any funds disbursed under the authority of the appropriations18 contained in this act shall be in compliance with the stated reasons for19 which this act was adopted, as evidenced by the Agency Requests, Executive20 Recommendations and Legislative Recommendations contained in the budget21 manuals prepared by the Department of Finance and Administration, letters, or22 summarized oral testimony in the official minutes of the Arkansas Legislative23 Council or Joint Budget Committee which relate to its passage and adoption.2425SECTION 4. EMERGENCY CLAUSE. It is found and determined by the General26 Assembly, that the Constitution of the State of Arkansas prohibits the27 appropriation of funds for more than a one (1) year period; that the28 effectiveness of this Act on July 1, 2026 is essential to the operation of29 the agency for which the appropriations in this Act are provided, and that in30 the event of an extension of the legislative session, the delay in the31 effective date of this Act beyond July 1, 2026 could work irreparable harm32 upon the proper administration and provision of essential governmental33 programs. Therefore, an emergency is hereby declared to exist and this Act34 being necessary for the immediate preservation of the public peace, health35 and safety shall be in full force and effect from and after July 1, 2026.36APPROVED: 4/29/26204/14/2026 2:53:50 PM WFP034
