REAPPROPRIATION - DIVISION OF AGING, ADULT, AND BEHAVIORAL25 HEALTH SERVICES - RENOVATION FUND. There is hereby appropriated, to the26 Department of Human Services, to be payable from the Department of Human27 Services Renovation Fund, for the Department of Human Services - Division of28 Aging, Adult, and Behavioral Health Services the following:29(A) Effective July 1, 2026, the balance of the appropriation provided30 in Item (A) of Section 1 of Act 132 of 2025, for costs associated with31 construction, replacement, renovation, upgrade, and addition of a warehouse32 distribution building for the Arkansas Health Center, in a sum not to exceed33 ....................................................................$448,902.34(B) Effective July 1, 2026, the balance of the appropriation provided35 in Item (B) of Section 1 of Act 132 of 2025, for repair or replacement of36 roofs at the Arkansas State Hospital, in a sum not to exceed .....$1,175,065.*LCW085* 04/14/2026 2:03:26 PM LCW085HB109512 SECTION 2. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor3 obligations otherwise incurred in relation to the project or projects4 described herein in excess of the State Treasury funds actually available5 therefor as provided by law. Provided, however, that institutions and6 agencies listed herein shall have the authority to accept and use grants and7 donations including Federal funds, and to use its unobligated cash income or8 funds, or both available to it, for the purpose of supplementing the State9 Treasury funds for financing the entire costs of the project or projects10 enumerated herein. Provided further, that the appropriations and funds11 otherwise provided by the General Assembly for Maintenance and General12 Operations of the agency or institutions receiving appropriation herein shall13 not be used for any of the purposes as appropriated in this act.14 (B) The restrictions of any applicable provisions of the State15 Purchasing Law, the General Accounting and Budgetary Procedures Law, the16 Revenue Stabilization Law and any other applicable fiscal control laws of17 this State and regulations promulgated by the Department of Finance and18 Administration, as authorized by law, shall be strictly complied with in19 disbursement of any funds provided by this act unless specifically provided20 otherwise by law.2122 SECTION 3. LEGISLATIVE INTENT. It is the intent of the General23 Assembly that any funds disbursed under the authority of the appropriations24 contained in this act shall be in compliance with the stated reasons for25 which this act was adopted, as evidenced by the Agency Requests, Executive26 Recommendations and Legislative Recommendations contained in the budget27 manuals prepared by the Department of Finance and Administration, letters, or28 summarized oral testimony in the official minutes of the Arkansas Legislative29 Council or Joint Budget Committee which relate to its passage and adoption.3031 SECTION 4. EMERGENCY CLAUSE. It is found and determined by the General32 Assembly, that the Constitution of the State of Arkansas prohibits the33 appropriation of funds for more than a one (1) year period; that the34 effectiveness of this Act on July 1, 2026 is essential to the operation of35 the agency for which the appropriations in this Act are provided, and that in36 the event of an extension of the legislative session, the delay in the204/14/2026 2:03:26 PM LCW085HB10951 effective date of this Act beyond July 1, 2026 could work irreparable harm2 upon the proper administration and provision of essential governmental3 programs.
