1.1A bill for an act
1.2relating to state government; requiring certain materials used in covered projects
1.3to be manufactured in the United States; providing for waivers; proposing coding
1.4for new law in Minnesota Statutes, chapter 16B.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6Section 1. [16B.313] AMERICAN-MADE MATERIALS USED IN STATE-FUNDED
1.7PROJECTS.
1.8Subdivision 1. Definitions. (a) For purposes of this section, the following terms have
1.9the meanings given.
1.10(b) "Covered project" means an infrastructure, transportation, housing, school, or public
1.11facility project funded by state money.
1.12(c) "Made in the United States" means all the components of cement, concrete, and steel
1.13that were not produced in the United States constitute less than five percent of the total cost
1.14of the cement, concrete, and steel.
1.15Subd. 2. Made in the United States. A covered project receiving state public money
1.16for the project must ensure that cement, concrete, and steel used in the project are made in
1.17the United States.
1.18Subd. 3. Waiver. (a) An agency as defined in section 16B.01, subdivision 2, may grant
1.19a waiver of the requirement in subdivision 2 if the agency determines that any of the
1.20following conditions apply:
1.21(1) there is no cement, concrete, or steel available that meets the requirement in
1.22subdivision 2;

2.1      (2) the procurement of cement, concrete, or steel that meets the requirement in subdivision
2.2  2 would increase the cost of the covered project by more than 25 percent; or
2.3      (3) an emergency exists that requires the immediate procurement of cement, concrete,
2.4  or steel for a covered project and cement, concrete, or steel meeting the requirement in
2.5  subdivision 2 is not immediately available.
2.6      (b) No later than 30 days after the agency grants a waiver under this subdivision, the
2.7  agency must publish a copy of the waiver granted on the agency's website.
2.8      (c) The commissioner shall provide guidance on the requirement and waiver provisions
2.9  of this section to all state procurement employees and update the department's policies to
2.10 include a bid preference for covered projects that commit to using products manufactured
2.11 in this state.
2.12     Subd. 4. Conflict with any other state law. If another state law applies to the
2.13 procurement of cement, concrete, or steel for a covered project, and if this section conflicts
2.14 with that law, this section applies to the procurement of cement, concrete, or steel to the
2.15 extent that it does not conflict with that law.
2.16     EFFECTIVE DATE. This section is effective the day following final enactment and
2.17 applies to all procurement contracts authorized on or after that date.
