1.1A bill for an act
1.2relating to capital investment; establishing a sustainable construction and demolition
1.3waste grant program; appropriating money; authorizing the sale and issuance of
1.4state bonds; proposing coding for new law in Minnesota Statutes, chapter 115A.
1.5    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6Section 1. [115A.535] SUSTAINABLE CONSTRUCTION AND DEMOLITION
1.7    WASTE TRANSITION GRANTS PROGRAM.
1.8Subdivision 1. Grant program established. The commissioner may make grants to
1.9    assist with the capital costs of infrastructure projects necessary to assist eligible grantees
1.10   with the transition away from the use of unlined construction and demolition landfills.
1.11Subd. 2. Eligible grantees. For purposes of this section, "eligible grantee" means:
1.12(1) for projects funded from the sustainable construction and demolition waste transition
1.13   grant account in the bond proceeds fund, a city, county, solid waste management district
1.14   established pursuant to sections 115A.62 to 115A.72, sanitary district, or township; or
1.15(2) for projects funded from the sustainable construction demolition waste transition
1.16   grant account in the general fund, any person.
1.17Subd. 3. Accounts. (a) A sustainable construction and demolition waste transition grant
1.18   account is established in the bond proceeds fund. The account consists of state bond proceeds
1.19   appropriated to the commissioner for this purpose. Money in the account may only be
1.20   expended to acquire land or an interest in land, predesign, design, construct, and improve
1.21   public infrastructure projects that further the purposes of this section.

2.1      (b) A sustainable construction and demolition waste transition grant account is established
2.2  in the general fund. The account consists of money as provided by law and any other money
2.3  donated, allotted, transferred, or otherwise provided to the account. Money in the account
2.4  may only be expended to acquire land or an interest in land, predesign, design, construct,
2.5  and improve public or private infrastructure projects that further the purposes of this section.
2.6      Subd. 4. Sustainable construction and demolition waste infrastructure grants. (a)
2.7  The commissioner may make grants to eligible grantees for infrastructure to process and
2.8  manage construction and demolition waste, including projects related to collection,
2.9  processing, waste reduction, reuse, recycling, resource recovery and disposal, and projects
2.10 addressing hazardous substances, toxic pollutants, and problem materials in the construction
2.11 and demolition waste stream. Components may also process and manage nonconstruction
2.12 and demolition waste as an ancillary function. Projects must be consistent with the policies
2.13 established under section 115A.02.
2.14     (b) Grants awarded under this subdivision may cover up to 75 percent of the eligible
2.15 expenses of a project.
2.16     (c) In awarding a grant under this subdivision, preference shall be given to projects that:
2.17     (1) assist with the creation of a regional system to transition away from unlined landfilling
2.18 of construction and demolition waste;
2.19     (2) reduce the amount of construction and demolition waste that is disposed of through
2.20 the prioritization of waste reduction, reuse, recycling, resource recovery, and other means
2.21 to prevent disposal;
2.22     (3) serve environmental justice areas; and
2.23     (4) maximize environmental, human health, and economic benefits.
2.24     Subd. 5. Construction and demolition enhanced landfill cover grants. (a) The
2.25 commissioner may make grants to eligible grantees for final enhanced cover systems to
2.26 assist with the closure of unlined construction and demolition landfills.
2.27     (b) Grants awarded under this subdivision may cover up to 50 percent of the eligible
2.28 expenses of a project.
2.29     (c) In awarding a grant under this subdivision, preference shall be given to projects that:
2.30     (1) assist with the creation of a system to transition away from unlined landfilling of
2.31 construction and demolition waste;
2.32     (2) serve environmental justice areas;

3.1      (3) demonstrate an effective cover design based on the Hydrologic Evaluation of Landfill
3.2  Performance (HELP) model that will protect groundwater by mitigating the release and
3.3  spread of contamination due to the landfill; and
3.4      (4) provide a site-specific evaluation of risk to human health and the environment and
3.5  compliance status.
3.6    Sec. 2. SUSTAINABLE CONSTRUCTION AND DEMOLITION WASTE GRANT
3.7  PROGRAM.
3.8      Subdivision 1. Appropriation. $118,000,000 is appropriated to the Pollution Control
3.9  Agency for grants under Minnesota Statutes, section 115A.535. Of this appropriation,
3.10 $59,000,000 is from the general fund in fiscal year 2027 and $59,000,000 is from the bond
3.11 proceeds fund.
3.12     Subd. 2. Bond sale. To provide the money appropriated in this section from the bond
3.13 proceeds fund, the commissioner of management and budget shall sell and issue bonds of
3.14 the state in an amount up to $59,000,000 in the manner, upon the terms, and with the effect
3.15 prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, and by the Minnesota
3.16 Constitution, article XI, sections 4 to 7.
3.17     EFFECTIVE DATE. This section is effective the day following final enactment.
 Sec. 2.  3
