(Public)Sponsors: Representatives Almond, Echevarria, and Campbell (Primary Sponsors).For a complete list of sponsors, refer to the North Carolina General Assembly web site.Referred to: Agriculture and Environment, if favorable, Appropriations, if favorable, Rules,Calendar, and Operations of the HouseMay 4, 20261A BILL TO BE ENTITLED2 AN ACT TO PROVIDE FLEXIBILITY IN THE CALCULATION OF WASTEWATER3 DESIGN FLOW RATES FOR PERMITTED WASTEWATER TREATMENT SYSTEMS.4 The General Assembly of North Carolina enacts:5SECTION 1. G.S. 143-215.1(f3) reads as rewritten:6 "(f3) The permittee for a wastewater system:7(1) May calculate its wastewater flows for new dwelling units discharging to8wastewater systems serving two or more dwelling units that have yet to be9connected and for which the permittee has allocated capacity, at 75 gallons10per day per bedroom, or at a lower rate approved by the Department.11Department in accordance with subdivision (3) of this subsection. If12wastewater flows are calculated pursuant to this subdivision, the minimum13volume of sewage from each dwelling unit is 75 gallons per day and each14additional bedroom above one bedroom increases the volume by 75 gallons15per day.16(2) Shall calculate its wastewater flows for new dwelling units discharging to17wastewater systems serving two or more dwelling units that have yet to be18connected and for which the permittee has not allocated capacity at 75 gallons19per day per bedroom, or at a lower rate approved by the Department.20Department in accordance with subdivision (3) of this subsection. For21wastewater flows calculated pursuant to this subdivision, the minimum22volume of sewage from each dwelling unit is 75 gallons per day and each23additional bedroom above one bedroom increases the volume by 75 gallons24per day.25(3) May calculate its wastewater flows for new dwelling units discharging to26wastewater systems serving two or more dwelling units that have yet to be27connected at a flow rate less than 75 gallons per day per bedroom if approved28by the Department based on the permittee demonstrating that the calculated29flow rate corresponds to the average actual flow experienced during the last30calendar year and that using this flow rate will not result in any adverse impact31on public health or the environment. The Department shall not approve any32flow rates for new dwelling units calculated at less than 55 gallons per day per33bedroom."*H1156-v-1*General Assembly Of North Carolina Session 20251SECTION 2. There is appropriated from the General Fund to the Department of2 Environmental Quality the sum of ten thousand dollars ($10,000) in nonrecurring funds for the3 2026-2027 fiscal year to be used by the Department for the purpose of reviewing wastewater4 design flow rates proposed by permitted wastewater treatment systems in accordance with5 Section 1 of this act.6SECTION 3.
