1A BILL TO BE ENTITLED
2 AN ACT DESIGNATING THE MONTH OF NOVEMBER AS MARROW DONATION
3     AWARENESS MONTH; ALLOWING INDIVIDUALS TO INDICATE THEIR
4     INTENTION TO BECOME MARROW DONORS WHEN APPLYING FOR OR
5     RENEWING A DRIVERS LICENSE; DIRECTING THE DEPARTMENT OF HEALTH
6     AND HUMAN SERVICES AND THE DEPARTMENT OF MOTOR VEHICLES TO
7     RAISE AWARENESS THROUGH PUBLIC SERVICE ANNOUNCEMENTS ABOUT
8     BONE MARROW DONATION AND BONE MARROW DONATION REGISTRIES;
9     AND APPROPRIATING FUNDS TO THE DEPARTMENT OF HEALTH AND HUMAN
10     SERVICES TO CONDUCT A PUBLIC AWARENESS CAMPAIGN ON MARROW
11     DONATION AWARENESS MONTH.
12Whereas, there are thousands of persons across the United States with blood cancers
13 such as leukemia and lymphoma, as well as sickle cell disease and other diseases, who could
14 benefit from receiving a lifesaving bone marrow or peripheral blood stem cell (PBSC) transplant;
15 and
16Whereas, the National Marrow Donor Program (NMDP) operates the "Be the Match
17 Registry," and the first step to becoming a donor is to join this registry; and
18Whereas, all that is required to register with the NMDP is to complete the online form,
19 order a registration kit, follow the instructions in the kit to collect a swab of cheek cells, and
20 return the kit to the NMDP in order to determine any potential patient matches; and
21Whereas, a potential donor who matches a patient is asked to make either a bone
22 marrow or PBSC donation; and
23Whereas, bone marrow donation is a surgical outpatient hospital procedure in which
24 the donor receives anesthesia and feels no pain, and the donated liquid marrow replaces itself
25 completely within four to six weeks; and
26Whereas, PBSC donation is a nonsurgical procedure that takes place at a blood center
27 or outpatient hospital unit and involves a transplant of cells from circulating blood, with the donor
28 receiving injections of a drug called Filgrastim over a five-day period leading up to donation in
29 order to increase the number of blood-forming cells in the bloodstream, and then having blood
30 removed through a needle in one arm and passed through a machine that separates out the
31 blood-forming cells, with the remaining blood returned to the donor through the other arm; and
32Whereas, the donor's blood-forming cells return to normal levels within four to six
33 weeks; and
34Whereas, all medical costs for the donation procedure are covered by the NMDP or
35 the donor's health insurance, as are travel expenses and other nonmedical costs, leaving only the
36 potential cost to the donor being time taken off from work; Now, therefore,

1 The General Assembly of North Carolina enacts:
2SECTION 1. This act shall be known and may be cited as the "Mike Clampitt
3 Advocacy for Marrow Education and Registration Act" or "Clampitt Act."
4SECTION 2. Chapter 103 of the General Statutes is amended by adding a new
5 section to read:
6 "§ 103-12.5. Marrow Donation Awareness Month.
7      The month of November of each year is designated as Marrow Donation Awareness Month
8 in North Carolina."
9SECTION 3.(a) G.S. 20-7.3 reads as rewritten:
10 "§ 20-7.3. Availability of organ, eye, and tissue donor cards at motor vehicle offices.offices;
11marrow donor registration.
12      (a)    The Division shall make organ, eye, and tissue donor cards available to interested
13 individuals in each office authorized to issue drivers licenses or special identification cards. The
14 Division shall obtain donor cards from qualified organ, eye, or tissue procurement organizations
15 or tissue banks, as defined in G.S. 130A-412.4(31). The Division shall offer organ donation
16 information and a donor card to each applicant for a drivers license. The organ donation
17 information shall include the following:
18(1)     A statement informing the individual that federally designated organ
19procurement organizations and eye banks have read-only access to the
20Department-operated Organ Donor Registry website (hereafter "Donor
21Registry") listing those individuals who have stated to the Division of Motor
22Vehicles the individual's intent to be an organ donor and have an organ
23donation symbol on the individual's drivers license or special identification
24card.
25(2)     The type of information that will be made available on the Donor Registry.
26      (b)    Individuals between the ages of 18 and 40 may indicate their intention to be a bone
27 marrow donor on an initial application for, or renewal of, a drivers license. Individuals indicating
28 an intention to be a bone marrow donor shall give written consent for the Division to share their
29 personal identifying information and contact information with the National Marrow Donor
30 Program. The Division shall provide that information to the National Marrow Donor Program,
31 so the Program can contact the individuals intending to be bone marrow donors to facilitate their
32 enrollment in the Program."
33SECTION 3.(b) No later than July 1, 2028, the Division of Motor Vehicles shall
34 adopt the rules necessary to implement the provisions of this section.
35SECTION 3.(c) Subsection (a) of this section becomes effective July 1, 2028. The
36 remainder of this section is effective when it becomes law.
37SECTION 4.(a) In order to raise public awareness about bone marrow donation and
38 transplantation and encourage North Carolina residents to consider joining a bone marrow
39 donation registry, the Department of Health and Human Services shall make available on its
40 internet website a public service announcement containing medically accurate information
41 regarding bone marrow donation and transplantation that is sufficient to allow an individual to
42 make an informed decision about whether to participate in a local or national bone marrow
43 donation registry.
44SECTION 4.(b) The Department of Health and Human Services shall provide to the
45 Department of Motor Vehicles an internet link to the public service announcement authorized by
46 subsection (a) of this section, which the Department of Motor Vehicles shall make available on
47 its internet website. In addition, the Department of Motor Vehicles shall broadcast the public
48 service announcement authorized by subsection (a) of this section on monitors at drivers license
49 office locations across the State.
50SECTION 5. There is appropriated from the General Fund to the Department of
51 Health and Human Services, Division of Public Health, the sum of one hundred thousand dollars

1 ($100,000) in nonrecurring funds for the 2026-2027 fiscal year to conduct a public awareness
2 campaign regarding Marrow Donation Awareness Month.
3SECTION 6. Except as otherwise provided, this act becomes effective July 1, 2026.
