1 A HOUSE RESOLUTION ENCOURAGING CONGRESS TO PRESERVE NORTH
2     CAROLINA'S AUTHORITY TO REGULATE ARTIFICIAL INTELLIGENCE IN
3     MATTERS RELATED TO CONSUMER PROTECTION AND TO OPPOSE FEDERAL
4     MORATORIA THAT WOULD RESTRICT STATES FROM ENFORCING EXISTING
5     LAWS.
6Whereas, states have a legitimate interest in and duty to protect their citizens from
7 fraud, price gouging, unfair and deceptive trade practices, and other harmful or abusive
8 commercial practices; and
9Whereas, artificial intelligence and automated systems are increasingly being used by
10 malicious actors in the commercial space to take unfair advantage of consumers; and
11Whereas, many states, including North Carolina, have laws providing for consumer
12 protection and such laws should be enforceable and remain within the province of the State to
13 the extent necessary to conform and apply the laws as the circumstances require to address these
14 new systems of abuse; and
15Whereas, states should proactively continue to monitor the commercial space and take
16 actions against abusive practices in order to protect consumers regardless of the modalities used
17 by malicious actors to prey upon others; and
18Whereas, North Carolina affirms its authority to enforce consumer protection laws
19 when AI is involved and rejects limitations imposed by federal action where that action material
20 diminishes or compromises the State's duty to protect its citizenry; Now, therefore,
21 Be it resolved by the House of Representatives:
22SECTION 1. The United States Congress is urged to take any and all necessary steps
23 to continue to allow states to regulate harmful uses of artificial intelligence, to allow State entities
24 to retain full investigative and enforcement authority over such harmful uses, to affirm that states
25 may enact laws addressing consumer harms arising from artificial intelligence usage, and to
26 otherwise preserve North Carolina's authority and duty to investigate, regulate, and enforce laws
27 against harmful and deceptive trade practices perpetrated by unlawful actors, regardless of
28 whether those actors use artificial intelligence or more traditional means of subterfuge.
29SECTION 2. This resolution is effective upon adoption.
