theform,andtheservicecontractformwasfiledwith19thedivisionbeforeJanuary1,2027.20Thecommissionermay,atthecommissioner’sdiscretion21andwithoutadvancednoticeorhearing,immediatelysuspend22aservicecompany’slicenseifthecommissionerfindsthat23anyofthecircumstancesdetailedinthebillaretrue.The24commissionermaysuspendorrevokethelicenseof,denyan25applicationforlicensefrom,orrefusetorenewthelicense26ofaservicecompany,ormaylevyacivilpenaltyagainsta27servicecompany,asdescribedinthebill,andshallnotifythe28servicecompanyinwritingofthereasonforthesuspension,29revocation,nonrenewal,ordenial.Thelicenseeorapplicant30mayrequestahearing.31Aservicecompanythatoffersservicecontractsforsale,32ortheservicecompany’ssupportservices,shallnotrepresent33inanymannerafalse,deceptive,ormisleadingstatementwith34respecttotheservicecompany’saffiliationwithamotor35-21-LSB5468SZ(2)91nls/ko21/22S.F.2505vehiclemanufacturerorimporter,thevalidityorexpiration1ofawarranty,oramotorvehicleservicecontractholder’s2coverageunderamotorvehicleservicecontract,andshallnot3describetheservicecontractasapolicy.4Aservicecompanyshallnotengageinaprohibitedact5orpracticeasdetailedinthebill.Thecommissioner6mayadoptrulesregulatingservicecontractstoprohibit7misrepresentation,falseadvertising,defamation,boycotts,8coercion,intimidation,falsestatementsandentries,and9unfairdiscriminationorpractices.Afterahearing,ifthe10commissionerfindsthatapersonhasviolatedthebillorrules11adoptedunderthebill,thecommissionermayordertheperson12toceaseanddesistfromtheviolationandmayordertheperson13topayacivilpenalty.Aviolationofthebillconstitutes14anunlawfulpractice.Aservicecontractissuedorsoldbya15servicecompanythatwasnotlicensedatthetimetheservice16contractwasissuedorsoldshallbevoidandunenforceable.17Awrittenexplanationtoaservicecontractholderofa18denialofaclaimorofferofasettlementshallincludethe19informationdetailedinthebill.20Thedutiesofthecommissionerduringaninvestigation,21proceeding,examination,orinquiryaredetailedinthebill.22Thecommissionershallmaintaintheconfidentialityof23informationsubmittedtothedivisionorobtainedbythe24divisioninthecourseofaninvestigation,examination,or25inquiry,includingallnotes,workpapers,orotherdocuments26andtheinformationasdescribedinthebill.Thecommissioner27maydiscloseorreleaseinformationthatisotherwise28confidentialinthecircumstancesdetailedinthebill.29ThebilltakeseffectonJanuary1,2027.30-22-LSB5468SZ(2)91nls/ko22/22
