hf2794/enrolled.txtHouseFile2794-EnrolledHouseFile2794ANACTESTABLISHINGASEXUALASSAULTFORENSICEXAMINATIONCENTERGRANTPROGRAMANDTRUSTFUND.BEITENACTEDBYTHEGENERALASSEMBLYOFTHESTATEOFIOWA:Section1.NEWSECTION.915.47Sexualassaultforensicexaminationcentergrantprogram——fund.1.Thetermsdefinedinsection915.46shallhavethesamemeaningwhenusedinthissection.2.Asexualassaultforensicexaminationcentergrantprogramisestablishedinthedepartmentofjustice.Contingentuponfunding,theattorneygeneralshallcontractwithaneligiblenonprofitorganizationtooperateandmaintainsexualassaultforensicexaminationcentersinthisstate.3.Anonprofitorganizationmustcomplywithallofthefollowingtobeeligibleforacontractunderthissection:a.Beanonprofitorganizationincorporatedinthisstatepursuanttochapter504thatisnotowned,controlled,oraffiliatedwithanyhospital,healthsystem,orinpatientmedicalfacility.b.Employorotherwiseretainservicesfromsexualassaultnurseexaminers.c.Maintain,orbeintheprocessofestablishing,oneormoretreatmentfacilitiesinthisstatethatareprimarilydedicatedtoprovidingadiverserangeofservicestosexualassaultsurvivors,includingbutnotlimitedtomedicalforensicservices.HouseFile2794,p.2d.Provideservicesforsexualassaultsurvivors,includingprovidingsexualassaultcareandrelatedtrainings,astheoverallprimarypurposeoftheorganization.4.Thecontractingnonprofitorganizationshalldoallofthefollowing:a.Provideservices,includingmedicalforensicservices,tosexualassaultsurvivorsincludingadults,personswithdisabilities,ruralIowans,andotherunderservedpopulations.b.Offerorfacilitatetrainingstolawenforcementofficers,prosecutingattorneys,healthcareprofessionals,andmembersofthepublicregardingsexualassaultservicesandsexualassaultprevention.c.Provideacooperativeteamapproachregardingsexualassaultservices,deliveraccessibleservicestosexualassaultsurvivors,andestablishanapproachthatemphasizesthebestinterestsofthesexualassaultsurvivorandthatprovidesinvestigation,assessment,andrehabilitativeservices.d.Involveorconsultwithpersonsfromvariousprofessionaldisciplineswhohavetrainingandexpertiseinaddressingspecialtypesofsexualassaultasnecessarytoaddressseriouscasesofsexualassaultsuchasthoseinvolvingintimatepartnerviolence,datingviolence,domesticviolence,incest,humantrafficking,anddrug-facilitatedsexualassault.Thesepersonsmayincludebutarenotlimitedtophysiciansandotherhealthcareprofessionals,lawenforcement,mentalhealthprofessionals,socialworkers,childprotectionworkers,attorneys,juvenilecourtofficers,publichealthworkers,educators,andadvocates.e.SubmitanannualreporttotheattorneygeneralandthegeneralassemblynolaterthanJanuary15ofeachcalendaryeardescribing,inaggregatedandanonymizedform,thetypesofservicesoffered,totalnumberofunduplicatedclientsserved,demographicbreakdownofclientsservedincludingage,gender,andcountyofresidence,numberofindividualsbycountytrained,referralsmadetootheragenciesorservices,descriptionofservicegapsidentifiedduringthereportingperiod,andbarrierstoserviceaccessidentified.5.Therequirementsinsubsection4arenotintendedtorestrictorotherwiselimitthecontractingnonprofitHouseFile2794,p.3organizationfromseekingfundingorreimbursementfromothersources.6.Asexualassaultforensicexaminationcentergrantprogramtrustfundiscreatedinthestatetreasuryunderthecontrolofthedepartmentofjustice.Thedepartmentofjusticemayacceptgifts,grants,bequests,andotherprivatecontributions,aswellasstateorfederalmoneys,fordepositinthefund.Allmoneysdepositedinthetrustfundareappropriatedandmadeavailabletothedepartmentofjusticetobeusedforthepurposesmeetingtherequirementsofthissectionandtoprovidegrantstosexualassaultforensicexaminationcentersinthisstate.Notwithstandingsection12C.7,subsection2,interestorearningsonmoneysinthefundshallbecreditedtothefund.______________________________PATGRASSLEYSpeakeroftheHouse______________________________AMYSINCLAIRPresidentoftheSenateIherebycertifythatthisbilloriginatedintheHouseandisknownasHouseFile2794,Ninety-firstGeneralAssembly.______________________________MEGHANNELSONChiefClerkoftheHouseApproved_______________,2026______________________________KIMREYNOLDSGovernor
