PETERPAULDistrict 11 (Monmouth)SYNOPSIS���� Establishes State grant program fund to incentivizemunicipalities to create senior snow removal programs; appropriates $2 million.CURRENT VERSION OF TEXT���� As introduced.��An Act establishinga grant program fund incentivizing municipalities to create senior snow removalprograms, supplementing chapter 27D of Title 52 of the Revised Statutes, andmaking an appropriation.����� Be ItEnacted by the Senate and General Assembly ofthe State of New Jersey:���� 1.��� For the purposes of P.L.���, c.��� (C.������� ) (pending before the Legislature as this bill):���� "Department" meansthe Department of Community Affairs.���� "Driveway" means aprivate roadway providing access to a public street or highway, including anypathway necessary to access the driveway from the residential property that iseligible to receive snow removal services under a local senior snow removal programestablished pursuant to section 3 of P.L.��� , c.��� (C.������� ) (pendingbefore the Legislature as this bill).���� "Entrance way" meansa private pathway providing access to the abutting sidewalks from theresidential property that is eligible to receive snow removal services under a localsenior snow removal program established pursuant to section 3 of P.L.��� ,c.��� (C.������� ) (pending before the Legislature as this bill).����� "Fund" means the �SeniorSnow Removal Grant Program Fund� established pursuant to section 2 of P.L.��� ,c.��� (C.������� ) (pending before the Legislature as this bill).���� "Qualified senior"means a person 62 years of age or older with a household income not exceeding65 percent of the area median income for the area in which the municipality islocated.�������� 2.��� There is established inthe Department of Community Affairs a nonlapsing fund to be known as the �SeniorSnow Removal Grant Program Fund.�� Monies deposited into the fund shall be usedto provide grants to municipalities to create and implement local senior snow removalprograms.� A grant awarded to a municipality from the fund shall not exceed $100,000.������ 3.��� a.�� A municipality mayestablish by ordinance a local senior snow removal program for removal of snowand ice from the entrance ways, driveways, and abutting sidewalks of a residentialproperty located within the municipality that is occupied by one or more qualifiedseniors.���� b.��� A municipality thatestablishes a local senior snow removal program pursuant to subsection a. ofthis section may apply, in a form and manner determined by the department, fora grant from the Senior Snow Removal Grant Program Fund for the operation ofthe local senior snow removal program.����� c.���� (1)������� State grant moneyprovided to a municipality to operate a local senior snow removal program shallnot be made available to otherwise qualified seniors living in a rental unit,the lease of which requires the landlord to provide snow and ice removalequivalent to that provided under the local senior snow removal program.���� (2)�� State grant moneyprovided to a municipality to operate a local senior snow removal program shallnot be made available to otherwise qualified seniors living in a unit in aresidential condominium, cooperative, fee simple community, horizontal propertyregime, or mobile home park comprised of a community trust or other trustdevice, condominium association, homeowners' association, or council ofco-owners, the governing documents of which require the entity responsible formanaging the common elements and facilities of the community to provide snowand ice removal equivalent to that provided under the local senior snow removalprogram.� ������ 4.��� In accordance with the"Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.),the Commissioner of Community Affairs shall adopt rules and regulationsnecessary to effectuate the provisions of P.L.��� , c.��� (C.������� ) (pendingbefore the Legislature as this bill).����� 5.��� There is appropriated tothe Senior Snow Removal Grant Program Fund, established pursuant to section 2of P.L. , c. (C. ) (pendingbefore the Legislature as this bill) from the General Fund, a sum of $2,000,000to effectuate the provisions of P.L.��� , c.��� (C.������� ) (pending beforethe Legislature as this bill).���� 6.��� This act shall takeeffect immediately.�STATEMENT���� This bill establishes anonlapsing fund to be known as the �Senior Snow Removal Grant Program Fund� (fund)in the Department of Community Affairs to provide municipalities with grants ofno more than $100,000 each to create and implement local senior snow removal programs(local programs).� A municipality may establish by ordinance a local programfor removal of snow and ice from the entrance ways, driveways, and abuttingsidewalks of a residential property located within the municipality that isoccupied by a person or persons 62 years of age or older with a householdincome not exceeding 65 percent of the area median income for the area in whichthe municipality is located.���� A municipality thatestablishes a local program may apply to the department for funding from the fundfor the operation of the local program. �State grant money provided to a localprogram is not to be made available to those living in certain residences, as specifiedin the bill.����� The bill appropriates $2million to the Department of Community Affairs for the purpose of awarding grantsto municipalities to create and implement local programs.����� The bill directs theCommissioner of Community Affairs to adopt rules and regulations necessary toeffectuate the provisions of the bill.� The bill is to take effectimmediately.� �
