Minnesota Statutes 2024, section 327C.015, is amended by adding a subdivision1.10 to read:1.11Subd. 4a. Economic displacement. "Economic displacement" means an event that1.12 causes a manufactured home owner to relocate and the decision to relocate is attributable1.13 to the lot rent of the manufactured home owner increasing by either: (1) an amount exceeding1.14 ten percent in one year or 20 percent over a period of three years; or (2) 30 percent over the1.15 adjusted income of the manufactured home owner's annual income. For purposes of this1.16 subdivision, the lot rent includes any increase in utility and service charges over the periods1.17 of time indicated in the preceding sentence.1.18Sec. 2. Minnesota Statutes 2024, section 327C.03, subdivision 6, is amended to read:1.19Subd. 6. Payment to the Minnesota manufactured home relocation trust fund. In1.20 the event a park owner has been assessed under section 327C.095, subdivision 12, paragraph1.21 (c), the park owner may collect the $15 $....... annual payment required by section 327C.095,1.22 subdivision 12, for participation in the relocation trust fund, as a lump sum or, along with1.23 monthly lot rent, a fee of no more than $1.25 per month to cover the cost of participatingSec. 2. 104/17/26 REVISOR MS/EN 26-07129 as introduced2.1 in the relocation trust fund. The $1.25 fee must be separately itemized and clearly labeled2.2 "Minnesota manufactured home relocation trust fund."2.3 Sec. 3. Minnesota Statutes 2025 Supplement, section 327C.095, subdivision 12, is amended2.4 to read:2.5 Subd. 12. Payment to the Minnesota manufactured home relocation trust fund. (a)2.6 If a manufactured home owner is required to move due to the conversion of all or a portion2.7 of a manufactured home park to another use, the closure of a park, or cessation of use of2.8 the land as a manufactured home park, or economic displacement as defined in section2.9 327C.015, subdivision 4a, the manufactured park owner shall, upon the change in use, pay2.10 to the Minnesota Housing Finance Agency for deposit in the Minnesota manufactured home2.11 relocation trust fund under section 462A.35, the lesser amount of the actual costs of moving2.12 or purchasing the manufactured home approved by the neutral third party and paid by the2.13 Minnesota Housing Finance Agency under subdivision 13, paragraph (a) or (e), or $3,2502.14 for each single section manufactured home, and $6,000 for each multisection manufactured2.15 home, for which a manufactured home owner has made application for payment of relocation2.16 costs under subdivision 13, paragraph (c). The manufactured home park owner shall make2.17 payments required under this section to the Minnesota manufactured home relocation trust2.18 fund within 60 days of receipt of invoice from the neutral third party.2.19 (b) A manufactured home park owner is not required to make the payment prescribed2.20 under paragraph (a), nor is a manufactured home owner entitled to compensation under2.21 subdivision 13, paragraph (a) or (e), if:2.22 (1) the manufactured home park owner relocates the manufactured home owner to2.23 another space in the manufactured home park or to another manufactured home park at the2.24 park owner's expense;2.25 (2) the manufactured home owner is vacating the premises and has informed the2.26 manufactured home park owner or manager of this prior to the mailing date of the closure2.27 statement under subdivision 1;2.28 (3) a manufactured home owner has abandoned the manufactured home, or the2.29 manufactured home owner is not current on the monthly lot rental, personal property taxes;2.30 (4) the manufactured home owner has a pending eviction action for nonpayment of lot2.31 rental amount under section 327C.09, which was filed against the manufactured home owner2.32 prior to the mailing date of the closure statement under subdivision 1, and the writ of recovery2.33 has been ordered by the district court;Sec. 3. 204/17/26 REVISOR MS/EN 26-07129 as introduced3.1 (5) the conversion of all or a portion of a manufactured home park to another use, the3.2 closure of a park, or cessation of use of the land as a manufactured home park is the result3.3 of a taking or exercise of the power of eminent domain by a governmental entity or public3.4 utility; or3.5 (6) the owner of the manufactured home is not a resident of the manufactured home3.6 park, as defined in section 327C.015, subdivision 14; the owner of the manufactured home3.7 is a resident, but came to reside in the manufactured home park after the mailing date of3.8 the closure statement under subdivision 1; or the owner of the manufactured home has not3.9 paid the $15 $....... assessment when due under paragraph (c).3.10 (c) If the unencumbered fund balance in the manufactured home relocation trust fund3.11 is less than $2,000,000 $....... as of June 30 of each year, the Minnesota Housing Finance3.12 Agency shall assess each manufactured home park owner by mail the total amount of $153.13 $....... for each licensed lot in their park, payable on or before December 15 of that year.3.14 Failure to notify and timely assess the manufactured home park owner by July 31 of any3.15 year shall waive the assessment and payment obligations of the manufactured home park3.16 owner for that year. Together with said assessment notice, each year the Minnesota Housing3.17 Finance Agency shall prepare and distribute to park owners a letter explaining whether3.18 funds are being collected for that year, information about the collection, an invoice for all3.19 licensed lots, a notice for distribution to the residents, and a sample form for the park owners3.20 to collect information on which park residents and lots have been accounted for. The agency3.21 must also include information in the letter about the tax credit available for sales of3.22 manufactured home parks to cooperatives in section 290.0694 and about notice requirements3.23 for unsolicited sales in section 327C.097. The agency may include additional information3.24 in the letter about programs and resources available to manufactured home park residents3.25 and owners. In a font no smaller than 14-point, the notice provided by the Minnesota Housing3.26 Finance Agency for distribution to residents by the park owner will include the payment3.27 deadline of October 31 and the following language: "THIS IS NOT AN OPTIONAL FEE.3.28 IF YOU OWN A MANUFACTURED HOME ON A LOT YOU RENT IN A3.29 MANUFACTURED HOME PARK, AND YOU RESIDE IN THAT HOME, YOU MUST3.30 PAY WHEN PROVIDED NOTICE." If assessed under this paragraph, the park owner may3.31 recoup the cost of the $15 $....... assessment as a lump sum or as a monthly fee of no more3.32 than $1.25 collected from park residents together with monthly lot rent as provided in section3.33 327C.03, subdivision 6. If, by September 15, a park owner provides the notice to residents3.34 for the $15 $....... lump sum, a park owner may adjust payment for lots in their park that are3.35 vacant or otherwise not eligible for contribution to the trust fund under section 327C.095,Sec. 3. 304/17/26 REVISOR MS/EN 26-07129 as introduced4.1 subdivision 12, paragraph (b), and for park residents who have not paid the $15 $.......4.2 assessment when due to the park owner by October 31, and deduct from the assessment4.3 accordingly. The Minnesota Housing Finance Agency shall deposit any payments in the4.4 Minnesota manufactured home relocation trust fund and maintain an annual record for each4.5 manufactured home park of the amount received for that park and the number of deductions4.6 made for each of the following reasons: vacant lots, ineligible lots, and uncollected fees.4.7 (d) This subdivision and subdivision 13, paragraph (c), clause (5), are enforceable by4.8 the neutral third party, on behalf of the Minnesota Housing Finance Agency, or by action4.9 in a court of appropriate jurisdiction. The court may award a prevailing party reasonable4.10 attorney fees, court costs, and disbursements.4.11 Sec. 4. Minnesota Statutes 2024, section 327C.095, subdivision 13, is amended to read:4.12 Subd. 13. Change in use, relocation expenses; payments by park owner. (a) If a4.13 manufactured home owner is required to relocate due to the conversion of all or a portion4.14 of a manufactured home park to another use, the closure of a manufactured home park, or4.15 cessation of use of the land as a manufactured home park under subdivision 1, or economic4.16 displacement as defined in section 327C.015, subdivision 4a, and the manufactured home4.17 owner complies with the requirements of this section, the manufactured home owner is4.18 entitled to payment from the Minnesota manufactured home relocation trust fund equal to4.19 the manufactured home owner's actual relocation costs for relocating the manufactured4.20 home to a new location within a 50-mile radius of the park that is being closed, up to a4.21 maximum of $7,000 for a single-section and $12,500 for a multisection manufactured home.4.22 The actual relocation costs must include the reasonable cost of taking down, moving, and4.23 setting up the manufactured home, including equipment rental, utility connection and4.24 disconnection charges, minor repairs, modifications necessary for transportation of the4.25 home, necessary moving permits and insurance, moving costs for any appurtenances, which4.26 meet applicable local, state, and federal building and construction codes.4.27 (b) A manufactured home owner is not entitled to compensation under paragraph (a) if4.28 the manufactured home park owner is not required to make a payment to the Minnesota4.29 manufactured home relocation trust fund under subdivision 12, paragraph (b).4.30 (c) Except as provided in paragraph (e), in order to obtain payment from the Minnesota4.31 manufactured home relocation trust fund, the manufactured home owner shall submit to the4.32 neutral third party and the Minnesota Housing Finance Agency, with a copy to the park4.33 owner, an application for payment, which includes:4.34 (1) a copy of the closure statement under subdivision 1;Sec. 4. 404/17/26 REVISOR MS/EN 26-07129 as introduced5.1 (2) a copy of the contract with a moving or towing contractor, which includes the5.2 relocation costs for relocating the manufactured home;5.3 (3) a statement with supporting materials of any additional relocation costs as outlined5.4 in subdivision 1;5.5 (4) a statement certifying that none of the exceptions to receipt of compensation under5.6 subdivision 12, paragraph (b), apply to the manufactured home owner;5.7 (5) a statement from the manufactured park owner that the lot rental is current and that5.8 the annual $15 $....... payment to the Minnesota manufactured home relocation trust fund5.9 has been paid when due; and5.10 (6) a statement from the county where the manufactured home is located certifying that5.11 personal property taxes for the manufactured home are paid through the end of that year.5.12 (d) The neutral third party shall promptly process all payments for completed applications5.13 within 14 days. If the neutral third party has acted reasonably and does not approve or deny5.14 payment within 45 days after receipt of the information set forth in paragraph (c), the5.15 payment is deemed approved. Upon approval and request by the neutral third party, the5.16 Minnesota Housing Finance Agency shall issue two checks in equal amount for 50 percent5.17 of the contract price payable to the mover and towing contractor for relocating the5.18 manufactured home in the amount of the actual relocation cost, plus a check to the home5.19 owner for additional certified costs associated with third-party vendors, that were necessary5.20 in relocating the manufactured home. The moving or towing contractor shall receive 505.21 percent upon execution of the contract and 50 percent upon completion of the relocation5.22 and approval by the manufactured home owner. The moving or towing contractor may not5.23 apply the funds to any other purpose other than relocation of the manufactured home as5.24 provided in the contract. A copy of the approval must be forwarded by the neutral third5.25 party to the park owner with an invoice for payment of the amount specified in subdivision5.26 12, paragraph (a).5.27 (e) In lieu of collecting a relocation payment from the Minnesota manufactured home5.28 relocation trust fund under paragraph (a), the manufactured home owner may collect an5.29 amount from the fund after reasonable efforts to relocate the manufactured home have failed5.30 due to the age or condition of the manufactured home, or because there are no manufactured5.31 home parks willing or able to accept the manufactured home within a 25-mile radius. A5.32 manufactured home owner may tender title of the manufactured home in the manufactured5.33 home park to the manufactured home park owner, and collect an amount to be determined5.34 by an independent appraisal. The appraiser must be agreed to by both the manufacturedSec. 4. 504/17/26 REVISOR MS/EN 26-07129 as introduced6.1 home park owner and the manufactured home owner. If the appraised market value cannot6.2 be determined, the tax market value, averaged over a period of five years, can be used as a6.3 substitute. The maximum amount that may be reimbursed under the fund is $8,000 for a6.4 single-section and $14,500 for a multisection manufactured home. The minimum amount6.5 that may be reimbursed under the fund is $2,000 for a single section and $4,000 for a6.6 multisection manufactured home, or ....... percent of the appraised value, whichever is6.7 greater. The manufactured home owner shall deliver to the manufactured home park owner6.8 the current certificate of title to the manufactured home duly endorsed by the owner of6.9 record, and valid releases of all liens shown on the certificate of title, and a statement from6.10 the county where the manufactured home is located evidencing that the personal property6.11 taxes have been paid. The manufactured home owner's application for funds under this6.12 paragraph must include a document certifying that the manufactured home cannot be6.13 relocated, that the lot rental is current, that the annual $15 $....... payments to the Minnesota6.14 manufactured home relocation trust fund have been paid when due, that the manufactured6.15 home owner has chosen to tender title under this section, and that the park owner agrees to6.16 make a payment to the Minnesota Housing Finance Agency in the amount established in6.17 subdivision 12, paragraph (a), less any documented costs submitted to the neutral third6.18 party, required for demolition and removal of the home, and any debris or refuse left on the6.19 lot, not to exceed $1,500. The manufactured home owner must also provide a copy of the6.20 certificate of title endorsed by the owner of record, and certify to the neutral third party,6.21 with a copy to the park owner, that none of the exceptions to receipt of compensation under6.22 subdivision 12, paragraph (b), clauses (1) to (6), apply to the manufactured home owner,6.23 and that the home owner will vacate the home within 60 days after receipt of payment or6.24 the date of park closure, whichever is earlier, provided that the monthly lot rent is kept6.25 current.6.26 (f) Notwithstanding paragraph (a), the manufactured home owner's compensation for6.27 relocation costs from the fund under section 462A.35, is the greater of the amount provided6.28 under this subdivision, or the amount under the local ordinance in effect on May 26, 2007,6.29 that is applicable to the manufactured home owner. Nothing in this paragraph is intended6.30 to increase the liability of the park owner.6.31 (g) Neither the neutral third party nor the Minnesota Housing Finance Agency shall be6.32 liable to any person for recovery if the funds in the Minnesota manufactured home relocation6.33 trust fund are insufficient to pay the amounts claimed. The Minnesota Housing Finance6.34 Agency shall keep a record of the time and date of its approval of payment to a claimant.Sec. 4. 604/17/26 REVISOR MS/EN 26-07129 as introduced7.1 (h)(1) By October 15, 2019, the Minnesota Housing Finance Agency shall post on its7.2 website and report to the chairs of the senate Finance Committee and house of representatives7.3 Ways and Means Committee on the Minnesota manufactured home relocation trust fund,7.4 including the account balance, payments to claimants, the amount of any advances to the7.5 fund, the amount of any insufficiencies encountered during the previous calendar year, and7.6 any itemized administrative charges or expenses deducted from the trust fund balance. If7.7 sufficient funds become available, the Minnesota Housing Finance Agency shall pay the7.8 manufactured home owner whose unpaid claim is the earliest by time and date of approval.7.9 (2) Beginning in 2019, the Minnesota Housing Finance Agency shall post on its website7.10 and report to the chairs of the senate Finance Committee and house of representatives Ways7.11 and Means Committee by October 15 of each year on the Minnesota manufactured home7.12 relocation trust fund, including the aggregate account balance, the aggregate assessment7.13 payments received, summary information regarding each closed park including the total7.14 payments to claimants and payments received from each closed park, the amount of any7.15 advances to the fund, the amount of any insufficiencies encountered during the previous7.16 fiscal year, reports of neutral third parties provided pursuant to subdivision 4, and any7.17 itemized administrative charges or expenses deducted from the trust fund balance, all of7.18 which should be reconciled to the previous year's trust fund balance. If sufficient funds7.19 become available, the Minnesota Housing Finance Agency shall pay the manufactured home7.20 owner whose unpaid claim is the earliest by time and date of approval.Sec. 4. 7
