srm1/introduced.txtSENATE REMONSTRANCE NO. 1Whereas, Brianna Lennon is the elected Boone CountyClerk and has been since 2018; andWhereas, as Boone County Clerk, she is responsible foroverseeing elections within Boone County, includingelections for statewide and federal offices, and has a dutyto comply with the laws of the state of Missouri; andWhereas, during the Second Extraordinary Session of theFirst Regular Session of the 103rd General Assembly, theGeneral Assembly enacted House Bill No. 1, which modifiedthe composition of the U.S. Congressional districts; andWhereas, House Bill No. 1 was signed by Governor Kehoeand became law; andWhereas, the legality of House Bill No. 1 was litigatedand ultimately the Missouri Supreme Court upheld thelegality of the new maps and denied a request to delayimplementation of the new congressional district boundariesas enacted by House Bill No. 1; andWhereas, Ms. Lennon stated that she will not makechanges to her county's voter list to reflect thecomposition of the congressional districts as enacted byHouse Bill No. 1; andWhereas, as the chief election official in BooneCounty, it is Ms. Lennon's duty to comply with the electionlaws of this state, including the maintenance of accuratevoter rolls for congressional district elections;Whereas, even if she disagrees with the decision of theMissouri Supreme Court, she must comply with such decisions;and1Whereas, if she continues to not follow the laws ofthis state and the decisions of the highest court in thisstate, then proceedings under chapter 106 to remove her fromoffice may be justified:Now, therefore, be it resolved that the members of theMissouri Senate, One Hundred and Third General Assembly,Second Regular Session, hereby remonstrate against BooneCounty Clerk Brianna Lennon for her stated intention to notfollow the laws of this state and the decisions of theMissouri Supreme Court; andBe it further resolved that the Secretary of the Senatebe instructed to send a copy of this remonstrance to BooneCounty Clerk Brianna Lennon.2
