Legislative intent. The legislature hereby finds anddeclares that the enactment of these appropriations provides sufficientauthority to the comptroller for the purpose of making payments for thepurposes described herein until such time as appropriation bills submit-ted by the governor pursuant to article VII of the state constitutionfor the support of government for the state fiscal year beginning April1, 2026 are enacted.§ 2. Section 2 of chapter 98 of the laws of 2026, relating to makingappropriations for the support of government, as amended by chapter 116of the laws of 2026, is amended to read as follows:§ 2. The amounts specified in this section, or so much thereof asshall be sufficient to accomplish the purposes designated, is herebyappropriated and authorized to be paid as hereinafter provided, to thepublic officers and for the purpose specified, which amount shall beavailable for the state fiscal year beginning April 1, 2026.ALL STATE DEPARTMENTS AND AGENCIESFor the purpose of making payments forpersonal service, including liabilitiesincurred prior to April 1, 2026, on theEXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets[ ] is old law to be omitted.LBD12043-01-6A. 11465 2payrolls scheduled to be paid during theperiod April 1 through May [20] 26, 2026to state officers and employees of theexecutive branch, including the governor,lieutenant governor, comptroller, andattorney general, and to employees of thelegislature. [13,719,650,000] 14,329,581,000--------------General FundLocal Assistance Account - 10000A. 11465 10For the medical assistance program, includ-ing administrative expenses, for localsocial services districts, and for medicalcare rates for authorized child care agen-cies.Notwithstanding section 40 of the statefinance law or any provision of law to thecontrary, subject to federal approval,department of health state funds medicaidspending, excluding payments for medicalservices provided at state facilitiesoperated by the office of mental health,the office for people with developmentaldisabilities and the office of addictionservices and supports and further exclud-ing any payments which are not appropri-ated within the department of health, inthe aggregate, for the period April 1,2026 through March 31, 2027, shall notexceed $36,099,200,000 except as providedbelow provided, however, such aggregatelimits may be adjusted by the director ofthe budget to account for any changes inthe New York state federal medical assist-ance percentage amount established pursu-ant to the federal social security act,increases in provider revenues, reductionsin local social services district paymentsfor medical assistance administration,minimum wage increases, and beginningApril 1, 2012 the operational costs of theNew York state medical indemnity fund,pursuant to chapter 59 of the laws of2011, and state costs or savings from theessential plan program. Such projectionsmay be adjusted by the director of thebudget to account for increased or expe-dited department of health state fundsmedicaid expenditures as a result of anatural or other type of disaster, includ-ing a governmental declaration of emergen-cy.The director of the budget, in consultationwith the commissioner of health, shallassess on a quarterly basis known andprojected medicaid expenditures by catego-ry of service and by geographic region, asdefined by the commissioner, incurred bothprior to and subsequent to such assessmentfor each such period, and if the directorof the budget determines that such expend-itures are expected to cause medicaidspending for such period to exceed theaggregate limit specified herein for suchperiod, the state medicaid director, inconsultation with the director of theA. 11465 11budget and the commissioner of health,shall develop a medicaid savings allo-cation adjustment to limit such spendingto the aggregate limit specified hereinfor such period.Such medicaid savings allocation adjustmentshall be designed, to reduce the expendi-tures authorized by the appropriationsherein in compliance with the followingguidelines: (1) reductions shall be madein compliance with applicable federal law,including the provisions of the PatientProtection and Affordable Care Act, PublicLaw No. 111-148, and the Health Care andEducation Reconciliation Act of 2010,Public Law No. 111-152 (collectively"Affordable Care Act") and any subsequentamendments thereto or regulations promul-gated thereunder; (2) reductions shall bemade in a manner that complies with thestate medicaid plan approved by the feder-al centers for medicare and medicaidservices, provided, however, that thecommissioner of health is authorized tosubmit any state plan amendment or seekother federal approval, including waiverauthority, to implement the provisions ofthe medicaid savings allocation adjustmentthat meets the other criteria set forthherein; (3) reductions shall be made in amanner that maximizes federal financialparticipation, to the extent practicable,including any federal financial partic-ipation that is available or is reasonablyexpected to become available, in thediscretion of the commissioner, under theAffordable Care Act; (4) reductions shallbe made uniformly among categories ofservices and geographic regions of thestate, to the extent practicable, andshall be made uniformly within a categoryof service, to the extent practicable,except where the commissioner determinesthat there are sufficient grounds fornon-uniformity, including but not limitedto: the extent to which specific catego-ries of services contributed to departmentof health medicaid state funds spending inexcess of the limits specified herein; theneed to maintain safety net services inunderserved communities; or the potentialbenefits of pursuing innovative paymentmodels contemplated by the Affordable CareAct, in which case such grounds shall beset forth in the medicaid savings allo-cation adjustment; and (5) reductionsA. 11465 12shall be made in a manner that does notunnecessarily create administrativeburdens to medicaid applicants and recipi-ents or providers.The commissioner shall seek the input of thelegislature, as well as organizationsrepresenting health care providers,consumers, businesses, workers, healthinsurers, and others with relevant exper-tise, in developing such medicaid savingsallocation adjustment, to the extent thatall or part of such adjustment, in thediscretion of the commissioner, is likelyto have a material impact on the overallmedicaid program, particular categories ofservice or particular geographic regionsof the state.(a) The commissioner shall post the medicaidsavings allocation adjustment on thedepartment of health's website and shallprovide written copies of such adjustmentto the chairs of the senate finance andthe assembly ways and means committees atleast 30 days before the date on whichimplementation is expected to begin.(b) The commissioner may revise the medicaidsavings allocation adjustment subsequentto the provisions of notice and prior toimplementation but needs to provide a newnotice pursuant to subparagraph (i) ofthis paragraph only if the commissionerdetermines, in his or her discretion, thatsuch revisions materially alter theadjustment.Notwithstanding the provisions of paragraphs(a) and (b) of this subdivision, thecommissioner need not seek the inputdescribed in paragraph (a) of this subdi-vision or provide notice pursuant to para-graph (b) of this subdivision if, in thediscretion of the commissioner, expediteddevelopment and implementation of a medi-caid savings allocation adjustment isnecessary due to a public health emergen-cy.For purposes of this section, a publichealth emergency is defined as: (i) adisaster, natural or otherwise, thatsignificantly increases the immediate needfor health care personnel in an area ofthe state; (ii) an event or condition thatcreates a widespread risk of exposure to aserious communicable disease, or thepotential for such widespread risk ofexposure; or (iii) any other event orcondition determined by the commissionerA. 11465 13to constitute an imminent threat to publichealth.Nothing in this paragraph shall be deemed toprevent all or part of such medicaidsavings allocation adjustment from takingeffect retroactively to the extent permit-ted by the federal centers for medicareand medicaid services.In accordance with the medicaid savingsallocation adjustment, the commissioner ofthe department of health shall reducedepartment of health state funds medicaidspending by the amount of the projectedoverspending through, actions including,but not limited to modifying or suspendingreimbursement methods, including but notlimited to all fees, premium levels andrates of payment, notwithstanding anyprovision of law that sets a specificamount or methodology for any suchpayments or rates of payment; The moneys hereby appropriated areavailable to reimburse or advance locali-ties and voluntary non-profit agencies forexpenditures made during local fiscalperiods commencing January 1, 2026, April1, 2026 or July 1, 2026, and for advancesfor the 3 month period beginning January1, 2027.Notwithstanding the provisions of article 41of the mental hygiene law or any otherinconsistent provision of law, rule orregulation, the commissioner, pursuant tosuch contract and in the manner providedtherein, may pay all or a portion of theexpenses incurred by such voluntary agen-cies arising out of loans which are fundedfrom the proceeds of bonds and notesissued by the dormitory authority of thestate of New York.Notwithstanding any other provision of law,the money hereby appropriated may betransferred to state operations and/or anyappropriation of the office for peoplewith developmental disabilities with theapproval of the director of the budget.Notwithstanding any inconsistent provisionof law, moneys from this appropriation maybe used for state aid of up to 100 percentof the net deficit costs of day trainingprograms and family support services.Notwithstanding the provisions of section16.23 of the mental hygiene law and anyother inconsistent provision of law, withrelation to the operation of certifiedfamily care homes, including family carehomes sponsored by voluntary not-for-pro-fit agencies, moneys from this appropri-ation may be used for payments to purchasegeneral services including but not limitedto respite providers, up to a maximum of14 days, at rates to be established by theA. 11465 28commissioner and approved by the directorof the budget in consideration of factorsincluding, but not limited to, geographicarea and number of clients cared for inthe home and for payment in an amountdetermined by the commissioner for thepersonal needs of each client residing inthe family care home.Notwithstanding the provisions of subdivi-sion 12 of section 8 of the state financelaw and any other inconsistent provisionof law, moneys from this appropriation maybe used for expenses of family care homesincluding payments to operators of certi-fied family care homes for damages causedby clients to personal and real propertyin accordance with standards establishedby the commissioner and approved by thedirector of the budget.Notwithstanding any inconsistent provisionof law, moneys from this appropriation maybe used for appropriate day programservices and residential services includ-ing, but not limited to, direct housingsubsidies to individuals, start-upexpenses for family care providers, envi-ronmental modifications, adaptive technol-ogies, appraisals, property options,feasibility studies and preoperationalexpenses.Notwithstanding any inconsistent provisionof law except pursuant to a chapter of thelaws of 2025 authorizing a 2.6 percenttargeted inflationary increase, for theperiod commencing on April 1, 2025 andending March 31, 2026 the commissionershall not apply any other inflationaryincreases, cost of living type increases,inflation factors, or trend factors forthe purpose of establishing rates ofpayments, contracts or any other form ofreimbursement; provided that this shallnot prevent the commissioner from applyingprior adjustments for the purpose ofestablishing rates resulting from a rebas-ing of base year costs.Notwithstanding section 6908 of the educa-tion law and any other provision of law,rule or regulation to the contrary, directsupport staff in programs certified orapproved by the office for people withdevelopmental disabilities, including thehome and community based services waiverprograms that the office for people withdevelopmental disabilities is authorizedto administer with federal approval pursu-A. 11465 29ant to subdivision (c) of section 1915 ofthe federal social security act, areauthorized to provide such tasks as OPWDDmay specify when performed under thesupervision, training and periodicinspection of a registered professionalnurse and in accordance with an authorizedpractitioner's ordered care.Notwithstanding any other provision of lawto the contrary, and consistent withsection 33.07 of the mental hygiene law,the directors of facilities licensed butnot operated by the office for people withdevelopmental disabilities who act asfederally-appointed representative payeesand who assume management responsibilityover the funds of a resident may continueto use such funds for the cost of theresident's care and treatment, consistentwith federal law and regulations.Funds appropriated herein shall be availablein accordance with the following:Notwithstanding any inconsistent provisionof law, the director of the budget isauthorized to make suballocations fromthis appropriation to the department ofhealth medical assistance program.Notwithstanding any inconsistent provisionof law, and pursuant to criteria estab-lished by the commissioner of the officefor people with developmental disabilitiesand approved by the director of the budg-et, expenditures may be made from thisappropriation for residential facilitieswhich are pending recertification asintermediate care facilities for peoplewith developmental disabilities.Notwithstanding the provisions of section41.36 of the mental hygiene law and anyother inconsistent provision of law,moneys from this appropriation may be usedfor payment up to $250 per year perclient, at such times and in such manneras determined by the commissioner on thebasis of financial need for the personalneeds of each client residing in voluntar-y-operated community residences and volun-tary-operated community residential alter-natives, including individualizedresidential alternatives under the homeand community based services waiver. Notwithstanding any inconsistentprovision of law, the following appropri-ation shall be net of prior and/or currentyear refunds, rebates, reimbursements, andcredits.Notwithstanding any other provision of law,advances and reimbursement made pursuantto subdivision (d) of section 41.15 andsection 41.18 of the mental hygiene lawshall be allocated pursuant to a plan andin a manner prescribed by the agency headand approved by the director of the budg-et.
