HOUSE RESOLUTION NO. 333
BY REPRESENTATIVES CHASSION AND SPELL
A RESOLUTION
To urge and request public school governing authorities and employees to comply with and
enforce, as applicable, the bullying laws of the state of Louisiana.
WHEREAS, as stated in the Constitution of Louisiana, it is the goal of the public
education system to provide learning environments and experiences at all stages of human
development that are humane, just, and designed to promote excellence in order that every
individual may be afforded an equal opportunity to develop to his full potential; and
WHEREAS, current law, R.S. 17:416.13, requires the governing authority of each
public elementary and secondary school to adopt and incorporate into the student code of
conduct a policy prohibiting the bullying of a student by another student and requires that
this policy be implemented in a manner that is ongoing throughout the school year and
integrated with a school's curriculum, a school's discipline policies, and other violence
prevention efforts; and
WHEREAS, current law, R.S. 17:416.14, further requires the governing authority of
each public elementary and secondary school to institute a program to prohibit and prevent
bullying; and
WHEREAS, this law provides that such a program shall ensure that each student,
each student's parent or legal guardian, and each school administrator, teacher, counselor,
bus operator, school employee, and volunteer is aware of his duties and responsibilities
relative to preventing and stopping bullying; provide for a process for reporting and
investigating alleged incidents of bullying; provide for appropriate discipline of a student
found guilty of bullying; provide for appropriate remedies for a student found to have been
bullied; and provide for procedures for investigating and reporting each school administrator,
teacher, counselor, bus operator, and school employee for failure to act as provided by law;

WHEREAS, this law further requires each governing authority to conduct a review
of the student code of conduct and amend the code as may be necessary to assure that the
policy prohibiting the bullying of a student by another student specifically addresses the
behavior constituting bullying, the effect the behavior has on others, including bystanders,
and the disciplinary and criminal consequences and includes the definition of bullying as
provided by law; and
WHEREAS, student safety should be the utmost priority at both the state and local
levels, and in spite of current law, there are students who are bullied by other students; and
WHEREAS, in order for the public education system to meet its constitutional goal
of providing learning environments and experiences at all stages of human development that
are humane, just, and designed to promote excellence, it is imperative that all public school
governing authorities and employees comply with and enforce, as applicable, the laws of the
state relative to bullying.
THEREFORE, BE IT RESOLVED that the House of Representatives of the
Legislature of Louisiana does hereby urge and request public school governing authorities
and employees to comply with and enforce, as applicable, the bullying laws of the state of
Louisiana.
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
state superintendent of education, who shall disseminate a copy to the superintendent of each
city, parish, or other local public school system and to the governing authority of each
charter school.
