hcr118/enrolled.txtENROLLED2026 Regular SessionHOUSE CONCURRENT RESOLUTION NO. 118BY REPRESENTATIVE MARTINEZA CONCURRENT RESOLUTIONTo urge and request the Louisiana Department of Insurance (department) to annuallycompile and publish comprehensive data and information concerning theaffordability, availability, transparency, and accountability of the homeowners' andprivate passenger automobile insurance markets in Louisiana.WHEREAS, Louisiana has faced a crisis in affordability and availability in thehomeowners' and private passenger automobile insurance markets for several years; andWHEREAS, Louisiana residents continue to face severe affordability and availabilitychallenges in the homeowners' and private passenger automobile insurance markets, withmany families experiencing substantial premium increases, nonrenewals, and difficultyobtaining coverage; andWHEREAS, rising insurance costs have placed significant financial strain on seniors,working families, small business owners, and residents living on fixed incomes throughoutthe state; andWHEREAS, it often takes some time for the full effect of legislative and regulatoryreforms to develop into an insurance premium impact; andWHEREAS, despite such premium impacts often being delayed, Louisiana hasalready begun to see positive signs in the form of homeowners' and private passengerautomobile insurers filing for rate decreases; andWHEREAS, many policyholders have still expressed frustration regarding deniedclaims, delayed claims processing, increasing deductibles, and the lack of accessible andunderstandable information regarding how insurance rates are determined; andPage 1 of 3HCR NO. 118 ENROLLEDWHEREAS, public confidence in Louisiana's insurance market depends upontransparency, accountability, and the availability of reliable market data for consumers,policymakers, and the public; andWHEREAS, Commissioner of Insurance Tim Temple has supported the passage ofvarious legislative reforms aimed at making insurance more available, affordable, andaccountable in Louisiana with a commitment to ensure competitiveness while enhancing theattractiveness of Louisiana's insurance market; andWHEREAS the Legislature took a great step toward better informing consumers withthe passage of Act No. 428 of the 2025 Regular Session, which requires insurers to providehomeowners' insurance and private passenger automobile insurance consumers with a ratetransparency report upon issuing and renewing policies on and after January 1, 2027; andWHEREAS, the department issued Bulletin 2026-05 to provide a model ratetransparency report for insurers to personalize, adopt, and begin issuing to consumers whenAct No. 428 takes effect on January 1, 2027; andWHEREAS, rate transparency reports will offer useful insight into how homeowners'and private passenger automobile rates are formulated but do not provide information withrespect to overall trends in the market; andWHEREAS, the legislature and the department have undertaken various reformsintended to improve market conditions, and continued transparency is necessary to evaluatethe effectiveness of those efforts; andWHEREAS, the publication of meaningful market data would better informLouisiana residents and policymakers regarding the causes of premium increases, claimstrends, market participation, and coverage availability; andWHEREAS, comparative regional and nationwide data would assist policymakersand consumers in determining whether market conditions in Louisiana are unique orreflective of broader national trends.THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does herebyurge and request the Louisiana Department of Insurance to annually compile and publishdata concerning the homeowners' and private passenger automobile insurance markets inLouisiana in a format that is accessible, understandable, and publicly available.Page 2 of 3HCR NO. 118 ENROLLEDBE IT FURTHER RESOLVED that the annually reported data may include but notbe limited to the following information with respect to homeowners' and private passengerautomobile insurance:(1) Number of claims and statistics regarding the disposition of those claims.(2) Average insurance premium rate changes.(3) Comparative regional and national trend data related to rates and marketparticipation.(4) Market concentration and market share data.(5) Number of insurers entering or withdrawing from the Louisiana market.(6) Number of policies that were written and nonrenewed.(7) Number of policies placed into Louisiana Citizens Property InsuranceCorporation.(8) Pure loss ratio, expense ratio, and combined loss ratio data.BE IT FURTHER RESOLVED that the Louisiana Department of Insurance shallensure that all reported data is presented in a format understandable and accessible tomembers of the general public.BE IT FURTHER RESOLVED that the Louisiana Department of Insurance shallsubmit a written copy of the report produced pursuant to this Resolution to the House andSenate committees on insurance and the David R. Poynter Legislative Research Librarypursuant to the provisions of R.S. 24:772 no later than February 1, 2027.BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to thecommissioner of insurance.SPEAKER OF THE HOUSE OF REPRESENTATIVESPRESIDENT OF THE SENATEPage 3 of 3
