Otis) --read once and referred to the Committee on Election LawAN ACT to amend the election law, in relation to actions that may besought in cases of voter intimidation, deception, or obstructionTHE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-BLY, DO ENACT AS FOLLOWS:Section 1. Subdivision 3 of section 17-212 of the election law, asadded by chapter 226 of the laws of 2022, is amended to read as follows:3. Remedies. Upon a finding of a violation of any provision of thissection, the court shall implement appropriate remedies that aretailored to remedy the violation, including but not limited to providingfor additional time to cast a ballot that may be counted in the electionat issue. ACTIONS SOUGHT PURSUANT TO THIS SECTION MAY INCLUDE IMMEDIATEINJUNCTIVE RELIEF, RESTRAINING ORDERS, OR CEASE AND DESIST ORDERS TOPREVENT IRREPARABLE HARM TO THE ABILITY OF VOTERS TO CAST BALLOTS ONDAYS WHEN VOTING IS HELD. Any party who shall violate any of theprovisions of the foregoing section or who shall aid the violation ofany of said provisions shall be liable to any prevailing plaintiff partyfor damages, including nominal damages for any violation, and compensa-tory or punitive damages for any intentional violation.§ 2.
