MARTINS -- read twice and ordered printed, and whenprinted to be committed to the Committee on RulesAN ACT to amend the Nassau county civil divisions act, in relation tothe Volunteer and Exempt Firefighter's Benevolent Association ofAlbertsonTHE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-BLY, DO ENACT AS FOLLOWS:Section 1. Sections 622.0, 622.4 and 622.5 of the Nassau county civildivisions act, as added by chapter 65 of the laws of 1940, are amendedto read as follows:§ 622.0 Incorporation; membership. a. A corporation by the name of"Volunteer and Exempt [Firemen's] FIREFIGHTER'S Benevolent Associationof Albertson," is hereby created.b. It shall be composed of all persons who now are, or hereafter shallbe volunteer members of the Albertson Hook, Ladder, Engine and HoseCompany No. 1, and such exempt volunteer [firemen] FIREFIGHTERS, asdefined in section two hundred of the general municipal law, who haveacquired such status by virtue of having rendered service in the Albert-son Hook, Ladder, Engine and Hose Company No. 1 of Albertson, town ofNorth Hempstead, as shall:1. Notify the secretary of the Albertson Hook, Ladder, Engine and HoseCompany No. 1, Albertson, Nassau county, New York, in writing, prior tothe organization meeting of the corporation created by this article,which meeting is hereinafter provided for, of their desire to becomemembers, or2. Attend such organization meeting or an adjournment thereof, or3. Notify the secretary of such corporation in writing, within sixtydays after [his] SUCH SECRETARY election, of their desire to becomemembers thereof, and also such other of the exempt volunteer [firemen]FIREFIGHTERS aforesaid, or of those who may hereafter become exemptvolunteer [firemen] FIREFIGHTERS of the Albertson Hook, Ladder, Engineand Hose Company No. 1, as may become members of such corporation pursu-ant to the provisions of its by-laws. Any [fireman] FIREFIGHTER, howev-er, who has been or shall hereafter be removed for cause, expelled orEXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets[ ] is old law to be omitted.LBD14782-01-6S. 10645 2dropped from the rolls of any fire company or department, shall not beeligible for membership in such corporation.§ 622.4 Control and disposal of funds and property. The control anddisposal of the funds, property and estate of such corporation and themanagement of its affairs shall be vested in a board of trustees, whichshall consist of five members of such corporation. The officers of suchcorporation shall be in such number and designated and shall have andexercise such powers and duties as may be provided by the by-laws. Thetrustees and officers shall be elected at the annual meeting of suchcorporation in the manner prescribed by its by-laws. The funds of suchcorporation, by unanimous vote of the trustees, may be used [for therelief, aid and assistance of disabled or indigent active or exemptvolunteer firemen of the Albertson Hook, Ladder, Engine and Hose CompanyNo. 1] IN FURTHERANCE OF ITS PURPOSES SET FORTH IN SECTION 622.1 OF THISARTICLE.§ 622.5 Precept for payment of foreign fire insurance premium taxes.a. Such corporation shall collect and there shall be paid to it all taximposed by section [five hundred and fifty-three] NINE THOUSAND ONEHUNDRED FOUR of the insurance law, for fire department use and benefit,upon premiums on policies of insurance against loss or damage by firecovering property situated within the area protected by the AlbertsonHook, Ladder, Engine and Hose Company No. 1, and within any duly organ-ized territory in which the Albertson Hook, Ladder, Engine and HoseCompany No. 1 is, or may hereafter be, obligated to render fireprotection.b. The officer of such corporation designated by its by-laws tocollect and receive the aforesaid tax shall the same powers as providedby law for the treasurer of a fire department with respect to suchcollection and receipt.c. Such corporation shall also be entitled to receive a share of thetax imposed by section [five hundred and fifty-four] NINE THOUSAND ONEHUNDRED FIVE of the insurance law, based upon premiums written in theterritory with respect to which it is entitled to collect and receivethe tax under section [five hundred and fifty-three] NINE THOUSAND ONEHUNDRED FOUR of the insurance law.d. Such taxes shall only be used [for the care and relief of disabledor indigent volunteer and exempt firemen and their families] BY THECORPORATION IN FURTHERANCE OF ITS PURPOSES SET FORTH IN SECTION 622.1 OFTHIS ARTICLE.§ 2. This act shall take effect immediately.
