sb1078/introduced.txtSENATE BILL NO. 1078A bill to amend 1939 PA 3, entitled"An act to provide for the regulation and controlof public and certain private utilities and other services affected with apublic interest within this state; to provide for alternative energy suppliers;to provide for licensing; to include municipally owned utilities and otherproviders of energy under certain provisions of this act; to create a publicservice commission and to prescribe and define its powers and duties; toabolish the Michigan public utilities commission and to confer the powers andduties vested by law on the public service commission; to provide for thepowers and duties of certain state governmental officers and entities; toprovide for the continuance, transfer, and completion of certain matters andproceedings; to abolish automatic adjustment clauses; to prohibit certain rateincreases without notice and hearing; to qualify residential energyconservation programs permitted under state law for certain federal exemption;to create a fund; to encourage the utilization of resource recovery facilities;to prohibit certain acts and practices of providers of energy; to allow for thesecuritization of stranded costs; to reduce rates; to provide for appeals; toprovide appropriations; to declare the effect and purpose of this act; toprescribe remedies and penalties; and to repeal acts and parts of acts,"(MCL 460.1 to 460.11) by adding section 6bb.the people of the state of michigan enact:Sec. 6bb. (1) An electric utilityor natural gas utility shall file a report with the commission every year thatcontains all of the following for that reporting period:(a) A listof contributions to a separate segregated fund established by that utility.(b) Anitemized list of contributions that a separate segregated fund established bythe utility made to, and expenditures that the separate segregated fund made onbehalf of, any of the following:(i) Candidate committees.(ii) Ballot question committees.(iii) Political party committees.(iv) Political committees.(v) Independent expenditure committees.(vi) Independent committees.(vii) Other separate segregated funds.(c) Anymoney given to an organization formed under 26 USC 501(c)(4) or 26 USC501(c)(6), including the amount given and the name of that organization.(d) Anymoney given to an organization formed under 26 USC 527, including the amountgiven and the name of that organization.(e) Anyexpenditures made on lobbying.(f) A listof any contributions or expenditures described in subdivisions (a) to (e) thatwere made by the parent company or an affiliate of the electric utility ornatural gas utility.(2) Thecommission shall post a report received under subsection (1) on its website.(3) As usedin this section:(a)"Ballot question committee" means that term as defined in section 2of the Michigan campaign finance act, 1976 PA 388, MCL 169.202.(b)"Candidate committee" means that term as defined in section 3 of theMichigan campaign finance act, 1976 PA 388, MCL 169.203.(c)"Contribution" means that term as defined in section 4 of theMichigan campaign finance act, 1976 PA 388, MCL 169.204.(d)"Independent committee" means that term as defined in section 8 ofthe Michigan campaign finance act, 1976 PA 388, MCL 169.208.(e)"Independent expenditure committee" means that term as defined insection 9 of the Michigan campaign finance act, 1976 PA 388, MCL 169.209.(f) "Lobbying"means that term as defined in section 5 of 1978 PA 472, MCL 4.415.(g)"Political committee" means that term as defined in section 11 of theMichigan campaign finance act, 1976 PA 388, MCL 169.211.(h)"Political party committee" means that term as defined in section 11of the Michigan campaign finance act, 1976 PA 388, MCL 169.211.
