STANLEYDistrict 18 (Middlesex)SYNOPSIS���� Authorizes dual employment by certain employees ofRutgers University and affiliated contracting entities.CURRENT VERSION OF TEXT���� As reported by the Assembly Budget Committee on June28, 2026, with amendments.��An Act concerning Rutgers, The State University, andsupplementing P.L.2012, c.45 (C.18A:64M-1 et al.).���� Be ItEnacted by the Senate and General Assembly ofthe State of New Jersey:���� 1.��� As used in this act:���� �Affiliation agreement� meansa long-term agreement that establishes a joint governance structure between anonprofit corporation established in the State pursuant to the "New JerseyNonprofit Corporation Act," N.J.S.15A:1-1 et seq., and Rutgers, The StateUniversity with the purposes of: advancing the provisions of P.L.2012, c.45(C.18A:64M-1 et al.); creating an integrated academic health system that isnationally recognized for its education, research, and clinical care; andimproving access to healthcare in the State.���� �Contracting entity� means anonprofit corporation established in the State pursuant to the "New JerseyNonprofit Corporation Act," N.J.S.15A:1-1 et seq., and any affiliates andsubsidiaries of the nonprofit corporation in the State, that enters into anaffiliation agreement with Rutgers, The State University; or any jointlyformed, managed, or affiliated entity or enterprise that may be formed pursuantto an affiliation agreement, including any affiliates or subsidiariesestablished pursuant to the affiliation agreement.����� 2.�� a.�������� Anyemployee of Rutgers, The State University 1,1 who 1is a managerial executive as defined in section 3 ofP.L.1941, c.100 (C.34:13A-3) and1 has oversight 1or supervisory1 or managerial responsibility for 1[, or involvement in supervising,]1 medical education, research, or clinical careprograms or divisions in connection with an affiliation agreement that has beenentered into between Rutgers, The State University and a contracting entity1,1 may be employed by, and receive compensation from,both Rutgers, The State University and the contracting entity.������ b.��� Anycompensation or other benefits connected to any employment permitted pursuantto subsection a. of this section shall not be subject to the provisions ofsection 13 of P.L.1971, c.182 (C.52:13D-24) or any provision of the code ofethics adopted pursuant to section 12 of P.L.1971, c.182 (C.52:13D-23). Theemployment permitted pursuant to subsection a. of this section shall not bedeemed in violation of 1[paragraphs (1) and]paragraph1 (5) of subsection (e) of section 12 of P.L.1971,c.182 (C.52:13D-23) 1[but shall otherwise be subject to the provisions ofsubsection (e) of section 12 of P.L.1971, c.182 (C.52:13D-23)] or any provision of the code of ethics adoptedpursuant thereto1.���� 13.�a.� Nothing in this act shall be construed to modify or contravene the rightsand obligations of employers or employees under the �New JerseyEmployer-Employee Relations Act,� P.L.1941, c.100 (C.34:13A-1 et seq.). Thisact shall be construed in accordance with the requirements of section 139 ofP.L.2012, c.45 (C.18A:64M-40).���� b.��� Nothing in this actshall be construed to exempt any subcontracting agreement from the requirementsof P.L.2021, c.104 (C.34:13A-50 et seq.).1���� 1[3.] 4.1���� Thisact shall take effect immediately.
